'Smart A**': Witness Snaps at Accused Killer Ice Cream Man's Attorney

Clearly annoyed with having to testify and answer questions in the Ice Cream Man Double Murder trial, witness and former co-worker of defendant Michael Keetley, David Beckwith, snapped at the defense attorney while on the stand. "You want to be a smart ass to me, I mean I'll be a smartass back,” Beckwith said to defense attorney Richard Escobar. Keetley is currently on trial for a Florida double murder - accused of killing two brothers on Thanksgiving Day in 2010.

    They are desperate. This case is entirely circumstantial. Only one of the four survivors of the shooting claims that he is certain it was the defendant but that guy has his own credibility issues. And then there's this guy who's supposed to testify that the defendant had nothing preventing his from doing the crime, but all he's proving is that he's a wicked person holding a 13 year grudge and is willing to say anything.

    It’s already laid out pre-trial via the depositions. Neither side is surprised by the line of questioning and already have the answers in writing. Now the behavior of the witness is possibly unexpected, but he may have acted that way during the deposition too.

    This is a terrible witness for the prosecution. Most jurors dislike argumentative witnesses as they want to be the ones to decide innocence or guilt. The prosecutor should tell witnesses that if you want the accused to walk free, get on the stand and have a bad attitude towards the defense.

    @@ogami1972 courtrooms are for justice and civility, not pettiness. If you can’t act like an adult in court, you shouldn’t be there as a credible witness. Trolling right? The lawyer isn’t on trial for a crime so why would it be negative to be polite to the defense’s attorney? So yes, I could imagine that and I’d prefer a friendly exchange over a malicious one. Thank you.

    Apparently the lawyer knew the answer for most questions, that's why if you watch the entire questioning the lawyer brings up inconsistencies in what he's testifying.

    @@kalei91 He's trying to prove that the accused wasn't fit enough to shoot a gun. Total fail, if you ask me. Plus, as the witness says, he's not any kind of an expert, so why would a jury give his testimony any weight? He's clearly an unreliable witness, so trying to pin him down is pointless and can only damage the defence.

It only shows that he is a liar that would lie under oath, and of course he may be lying this time too. Huge error from the prosecution to bring this witness, it only hurts their case.

    Defense was twisting the witnesses words quite a bit there. Not mention stretching the meaning of words to their limit. It didn’t seem like the witness was lying so much as just not necessarily expressing himself in a way that holds up under this kind of pedantic scrutiny.

    He wasn’t sued. Witnesses can be deposed in criminal cases, and when they are it becomes part of discovery and can be used during trial testimony.
