She Ra - her own brand? IP ownership and rewriting toy history, the curious case of POP and MOTU

Ойын-сауық

Scott ToyGuru Neitlich discusses the odd loopholes that have befallen the Princess of Power brand after being juggled by multiple owners over the years. Is She-Ra still He-Man's brother? Is Madam Razz a Twigget? What the heck is Loo-kee? Only one of these questions will be addressed in the video today!

It's kind of funny how Predator and Alien became so connected that crossover between them is the first thing which comes to mind, but She-Ra and He-Man got divided behind the scenes when origin of one takes roots from lore of the other. Originally I thought new She-Ra show being separate from He-Man was novel idea from writers, but the fact it's some IP shenanigans is weird.

Rights issues are what ALWAYS ruin EVERYTHING. @Spector Creative 1st, I'm a little mild ocd about keeping my youtube subscriptions trim atm, but I so appreciate your He-Man&She-Ra fandom & expertise, & I so admire your commitment to responding to those who post on your videos, that I went ahead & subscribed. 2nd... I'm still having consternation & confusion over why @Mattel has played so shy about using She-Ra & including her in their He-Man reboots. I understand that Classics Media semi-split the FILMATION He-Man/She-Ra franchise ( easy enough to remedy on Dreamworks end by just unifying & running fully Filmation based He-Man&She-Ra content together again )... but that shouldn't have had any effect on Mattel's rights to make content based on the earlier She-Ra toys & pre-existing toy prototypes, anymore than it did with He-Man & especially Hordak. Mattel's She-Ra & Catra toys & minicomics predate the FILMATION He-Man/She-Ra movie, and even further predate Filmation's She-Ra series airing ( to quote Gandalf regarding the 3 Rings of The Elves, & Sauron, "...his hand has never touched nor sullied them", [ meaning NO disrespect to Filmation: their hand did a wonderful job with He-Man & She-Ra in many ways, & they certainly did a MUCH better job of keeping MOTU&POP unified, rather than the offensively divisive mess 80s Mattel did with that aspect... if they'd been more thorough about keeping the unity in the minicomics, they'd have had less ip ambiguity later down the road, & we wouldn't be having this discussion]). The She-Ra & Catra toys have significant differences from their filmation variants etc. And the core story, from Hordak's classic/archiac ( & narrative gold ) mythic/fairytale abduction of Adora "Suffer all Eternia, I, Hordak... have come to claim my prize...", to the essential revelation of Adora/She-Ra & Adam/He-Man being twins, to her birth name being Adora, all are present in the 1984 Story of She-Ra minicomic, as is a particularly powerful & pretty version of Catra. Mattel shouldn't have any greater problem creating content with She-Ra, so long as it is based on their 1984 copyrights & illustrations of the character, than they do using He-Man, & ESPECIALLY no more problems than they do in using characters who were created after the FILMATION collaboration began, like Orko, Hordak, The Horde etc. ( Orko was specifically created for the Filmation show, & voiced by company president Lou Schimmer, for goodness sake, but it didn't stop him appearing in both the 2002 & MOTU:revelation reboots ). I read a comment of yours about Mattel not using the fact that their blue-skinned Hordak ( via his, possibly first published appearances in the, produced at about the same time, 1984 "The Story of She-Ra" & "Grizzlor: the legend comes alive" minicomics [ I do note your commentary regarding the Bruce Timm illustrated "The Power of The Evil Horde" story book that came with the Hordak and Grizzlor two pack & audio cassette tape, but it's notable that the Bruce Timm cover illustration for that is signed & dated to 1985, as are the copyrights on that books illustrations, whereas the Story of She-Ra & Grizzlor illustrations & copyrights date to 1984 [ with Bruce Timm notably having also illustrated the aforementioned Grizzlor minicomic, and PROBABLY being the uncredited illustrator of The Story of She-Ra minicomic: the styles, especially the looks of Hordak, the Sorceress & He-Man are EXTREMELY similar, & Bruce Timm is known to have done uncredited illustration for last of the 1st wave She-Ra minicomics, "Adventure of the Blue Diamond" ] , a year earlier.. more on those illustrations & copyrights later, as it seems rather important on the whole ) actually predates FILMATION'S blue-skin Hordak as a technicality to use blue-skin Hordak without getting the Filmation related licensing: whether it's a fair use or a loophole trick can be debated. But this is something different: this is a greater matter of seniority, priority & rights, & Mattel has every bit as much moral right ( & SHOULD, unless there was some strange as-yet-secret further & frankly foolish concession ) to use their pre-Filmation-version, older illustrations & minicomics based She-Ra & Catra, at the least, as they do to use Orko, Hordak, Sy-Klone, Spikor, Fisto, the Sorceress ( falcon [ or hawk... is it a falcon or a hawk, I know you know lol ] costume version ) et al. The argument could be made that Mattel would or should have rights to make new content with the entire first wave of She-Ra toys, since they all ( She-Ra, Catra, Frosta, Bow, Castaspella, Angella, Glimmer, Double Trouble & Kowl ) have illustrations & prototypes copyrighted to Mattel in 1984, prior to the Filmation animations: www.he-man.org/publishing/item.php?id=726&image=27479. I recall you saying that the 1987 character guide/style guide was the technicality you guys first used to bring She-Ra into the Classics toyline, but this is a MUCH bigger and clearer rights slamdunk than that: that really was a barest technicality, since that guide directly featured the exact Filmation variants likenesses: this is very different; those old 1st wave She-Ra illustrations & minicomics take nothing from the FILMATION movie & series, and the first ones predate it: in fact, it's on record that the designer for FILMATION Frosta based her directly on the pre-existing prototype that Mattel's teams had created for that character ( also, notably, minicomic Catra, like minicomic Hordak, is more powerful than the Filmation variant: I hope whenever the studious, presumably Dreamworks once it has all the content access, make a fully reunified MOTU&POP show, they will MERGE the power aspects of Filmation & minicomics Hordak & those of Filmation & minicomics Catra, respectively, to give us the most formidable & old school nod versions of both ). So what is the exact situation, & why has Mattel been so shamefully unassertive about doing anything with She-Ra??

  • @spectorcreative1872

@@spectorcreative1872 loopholes are one thing, but this is an area where they have a clear and strong case & right ( unless they gave away more rights than have been reported ), really as clear and as strong as the ones for Orko & Hordak, for thsoe first few She-Ra characters: She-Ra, Catra, Frosta, Bow, Castespella, basically the WHOLE first wave, but ESPECIALLY She-Ra & Catra who have story content et al in 1984 Mattel copyright. The Filmation animators for Catra , Frosta & Castespella BASED their work on Mattels toy prototypes & prototype artwork, & the same is largely true for She-Ra, and there are still distinct differences between 1st wave minicomic & toy She-Ra & Catra, and Filmation She-Ra & Catra. Orko is more a pure Filmation creation than She-Ra is, and clearly Mattel has never yet applied this kids' gloves approach with him: he's in the 2002 & MOTU revelation reboots etc. ( & hey, I'm glad he is, I've always been fond of Orko, but I'm even more fond of She-Ra, and Mattel just doesn't seem to put as much effort into or fight up for her, the exception being in some of the toy lines, especially Classics, & I tip my hat to you for all the inclusion you did & for doing a lot [ esp. via your bio cards ] to make up for the fact that Mattel had kept so many of the old minicomics, with the exception of The Story of She-Ra, largely MOTU(POP) segregated ). & Filmation She-Ra is one thing, but She-Ra, as she appeared in her original minicomic debut ( & Catra right along with her ) ARE Mattel Trademarks/Copyrights. We're not talking about Shadowweaver here who, as you note, never appeared outside of the Filmation series & was made specifically for it ( She-Ra's Orko, but female, dark, & not humourous... Hordak's answer to Orko, I guess ). The 1984 copyrights of those illustrations and stories of She-Ra & Catra, abduction by Hordak et al, & just as old as Hordak & Leech, and older than King Hiss or the Slime Pit, are copyrighted to Mattel. If Mattel were that concerned with not "infringing" on anything Filmation's hands had ever touched, then they would never use Orko, they would never use Hordak, they would never use any character appearing in Filmation's shows who was created after Filmation began collaborating with them in 1982, so that just can't be the answer. Classics Media wrongly splitting He-Man & She-Ra in the Filmation library shouldn't have any effect at all on Mattel's 1984 She-Ra minicomics version, no more than it effected Orko, Grizzlor, & Sy-Clone. Classics Media never had any trademark or copyright rights to Mattel's minicomics & toy versions of She-Ra, Catra, & Frosta. Mattel wouldn't be using a loophole, they would be assertively using character variations they already had a pre-existing right to, JUST as they do everytime they use Orko & Hordak, and I'm hoping you can explain to me where the legal difference lies, if there is one at all. & I understand this may be something that the legal teams just haven't properly addressed... but if not, why hasn't Mattel taken it up with them?? Do they just not care as much about She-Ra's ip and the rights they almost certainly have to the early minicomic & toy versions of her & Catra etc. ( NOT loopholes, Scott, but RIGHTS, they have those copyrights, She-Ra & Catra are at least as much Mattel's as they are Filmations, & the minicomics & those 1st wave toys that were modeled in line with the comics & NOT the Filmation show, are fully Mattel's, unless I've quite missed something [ which is possible ] The way you noted using the 1987 style guide to open a narrow "maybe" door to using the Filmation style She-Ra was a loophole.... this is something WAY different: this is Mattel original content, copyrighted to & by Mattel before the Filmation versions of She-Ra & Catra were even finalized, let alone released, & it's mindboggling that Mattel would take such a hands-off & lassiez faire approach to their own property).

There's also a black sheep in this whole conversation that I wanna know the specifics to: Mara. Don't get me wrong, I know she was supposed to have a toy release in the New He-Man Adventures and it never got past the prototype stage. And I also know Mara was from a series that wasn't well received back then or even today. However, Mara is unique because she's the only character exclusively from a He-Man series who managed to find her way into the Dreamworks She-Ra reboot after the company got the rights to the She-Ra side. So I'm wondering if it was a case where her rights were just floating around because Warner Brothers and Sony didn't really care what happened to her rights and she was able to be used by ND and crew. And if that's the case then GOOD. Because reboot Mara's backstory is one of the most emotionally touching scenes in the entire MotU franchise.

I'm not gonna lie, the fact that She-Ra and He-man can't appear in each other's worlds story-wise really sucks. This would explain why the lore in the SPOP Netflix series is so far removed and doesn't have even a remote connection to MOTU. Again, that's a real shame, because the Netflix reboot was really good and brought many new and interested fans to the franchise; being able to involve MOTU would have not only added more to the story of the reboot, but would have potentially added a lot of new customers for Mattel. I know many MOTU fans (mostly the men) are perfectly good with the fact that both worlds are separate, but to me and most other She-Ra fans, both franchises went hand-in-hand and we enjoyed both In their many forms. I don't know, all I can say is that this was all around a loss for me, personally.

For how the rights are split up for he-man and she-ra in entertainment, talk about a nasty divorce. At least that's how i see it beside netflik is getting two different he-man shows.Which means not even a guest appearance for she-ra. By the way it's a shame the 2002 reboot didn't get another season wasn't there talk it would have she-ra ?

@Spector Creative: Wrong. We got figures of Shadow Weaver in both of Super7's recent toylines (retro 5.5 and vintage 3.75 style). Mattel can totally make her and the rest of the POP cast.

You seem confused. Even if they are 2 different distinct brands it just takes an entertainment company paying for both ips. This might be prohibitively expensive but not impossible. Money talks

I don't know if it was Mattel or Filmation's idea, but I thought it was terrible back in '85 (and still do) how Hordak and She-Ra were retconned into MOTU. Years were spent having The Most Powerful Man In The Universe vs. The Evil Lord Of Destruction only to be insulted to find out that there was somebody just as strong/fast as He-Man (but with extra powers and a shape changing sword) and that Skeletor was only a pupil, not the ultimate evil. After seeing that as a kid, I couldn't watch He-Man again, and neither did other kids that I knew. Savage MOTU forever!

The girls was already enjoying the line, so why mess that up? Glad they got she ra, but they legit was enjoying what was already there. Like the new fake she ra pushing girl power, when the brand already had a strong women. A adult kids could look up too. Weird.
