    Can we get this stuff out of the Auckland Council budget? Why is there a section on Te Tiriti for what to do with North Harbour Stadium? If that is contested land (it's not) leave that up to the Tribunal. The stadium wasn't there in 1840 and it has nothing to do with the treaty or any parties to that agreement. Of course there should be cultural considerations but that should be part of any pro/cons not having to put a special row under every budget item for the treaty. I never knew how bad this confusion had gotten and how far the infection had spread. Wipe it out from where it doesn't belong otherwise it undermines the support for the treaty where it does belong.

    Where are we going to get the government departments and hospitals to start using English? I rang Nelson Hospital today. And was surprised at the continuing use of Māori I had to ask the lady was this the Nelson Hospital? She showed me it was now while I don’t object to the use of Maori I thought the new coalition government was going to bring in all English names as the dominant language of the country etc.?

    Many years ago, just after I arrived in NZ, I had occasion to ring a government department. The lady who answered said "Kia ora" and, without thinking, I responded "bore da". At this point she became quite septic, demanding to know what I had said. My response was "Well, you spoke to me in your language, so I replied in mine." She insisted on knowing what I had said, so I replied "Good morning." There was more to this, but I won't go into it here. Needless to say, she was not a happy bunny.

    I'm actually gutted reading all of this. I'm half Maori and in the middle of learning te reo. All my life I have been disappointed that I wasn't taught how to speak maori from a kid. If anything I think there should be more Maori spoken . It was normal before colonization. My own mum was bullied and told to marry a white man my dad who I love with all my heart but come on guys this is ridiculous you are all just wanting to erase the language and culture completely. Sorry but this podcast is really sad with alot of racism in the comments. You wonder why the hard core Maori get so upset. If it's so bad here go back to the country you're ancestors came from. Maori language and culture is just getting stronger tbh it's not going anywhere. Kia ora 😊

    To a large degree the system of law that we use in New Zealand Has its origins like many other aspects of Western Society, in Christian principles. So why is there not a requirement to study Christianity within the legal and real estate industries, If it is a spiritual dynamic that is needed?

    I’m so sick of hearing about the bloody treaty. It’s very simple. There’s only 3 principles to it. 1 the govt is sovereign, 2 maori are sovereign only on their own land in the same way as everyone else is and 3 maori and all will be treated equally, end of story. Now the govt needs to grow some balls and say this is how it is and if you don’t like it bad luck. If you want to protest it and break the law then under the treaty article three you’ll be treated equally and thrown in jail.

    Correction Sean it does not require the government to have a partnership with Maori - Lord Cook in the 80's said that the relationship between Maori and the Crown is "akin" to a partnership. It was specifically outlined as "akin" because you cannot have two seperate governance structures in a democracy. Even David Lange outlined this - it's only recently and it sounds like you've been fooled by it that the word "akin" and now simply partnership is being implied.

    Nelson city council as I understand, it is also working on the basis of partnership so where does that lead other councils are probably doing the same so it’s everywhere

    Nelson's previous Mayor was an Arden puppet of the first order. She did a number of things that no other council in New Zealand had agreed to, and without consultation with Nelsonians. This lined up specifically with Ms Arden's view of the world.

    I think it should be clarified that tikanga is not specifically superstition or religion - it is ritual. However, of course, much social ritual is tied into superstition and religion, but not all. E.g. tikanga kōti, the ritual of the court, such as referring to the judge as 'your honour' or a JP as 'your worship'; and the process of examination, crossexamination, reexamination, and questions from the court are all a process of tikanga. Or say, tikanga kai or food rituals in your family, who gets the biggest steak? Do oldest or youngest get served first? Or maybe tikanga mahi, how do you go about your work? Is it practical or theoretical, is it solo or group? This is all tikanga, tikanga as 'ritual' is universal, and in my mind instead of superstition the ritual is tied to ethical orientations (i.e. what is 'good' for me and the situation, and 'good' for those i work with). The issue is that Maori elitists refuse to accept that their cultural artefacts are shared with other cultures simply with different names, and this leds them to believe that Maoritanga is somehow superior or better suited because they perceive these rituals as being uniquely theirs and uniquely valuable (by nature of the whole 'bad white man' yarn). This is terribly wrong. Strong cultural values are superior to weak ones, that is the crux. The appropriate rituals (i.e. in this case the appropriate social contracts and methodologies) exist regardless of culture or place. One such amazing and appropriate tikanga is the common law we enjoy that has whakapapa all the way back to the Domesday Book and the Magna Carta. Mana is universal, Charlemange sourced authority from the same place as Hongi Hika. It is the biological response to social standing - humans respect strong and wise leadership. Whakapapa is universal, the lineage of my Irish and Scottish tupuna are equally as valuable as my Maori tupuna and their genetics are my whakapapa. It is the genomic link that ties us together as a human species with shared propagative history - individuals have varied constructions but are based on the same universal blueprint. Thus, pono tika (or correct values) exist as universal facts, not varied cultural interpretations and tribalized narratives. One such fact is that, if you wish to abandon cynicism and nihilism, all people are equal regardless of sex, breed, or creed - what makes us different is our individual capacities which people have to accept. Are you lacking because society has you down, or because you dont thrive to make yourself a capable, strong, passionate, and knowledgeable individual? The only way to make that happen is good tikanga: personal, social, and ethical.

    Thank you, Shane, really appreciate your approach which is very balanced and fear and I think most New Zealanders want to be fair but we also recognise that we need to get this country moving. We have many different ethnicities in this country and if we end up going down the path we are big trouble. It’s very clear that a lot of institutions, i.e. government departments, universities etc news. Media are pushing back obviously clearly there’s a battle

    How does this work for lawyers from overseas. This I would. Think becomes a great barrier to attracting skilled workers in law wanting to consider New Zealand as a place of opportunity. On a wider scale this ongoing needing to imbed a language that is only spoken by a tiny majority or a tiny country does not help us move forward and be a competitive country people want to come to.
