Severing a Joint Tenancy | Land Law

Subscribe to my personal channel for videos on how to study law effectively & efficiently: / @heygarethevans A relationship which begins as a joint tenancy need not remain so, for in certain circumstances it is possible for a joint tenant to sever his or her interest and thereby to convert it into a tenancy in common. A primary reason for severance may be to avoid the effects of the right of survivorship. It is never possible these days to sever a joint tenancy of the legal estate, for to do this would be to create a legal tenancy in common, which is prohibited by LPA 1925 s.34(1).

    my jointly owned home owner has sent me an severence order but upon looking at paperwork noticed that there was a seven week gap from date of my joint owners signature and solicitors signature .i asked severence solicitor why and they stated that it was for joint owners son to explain of its occurrence...my dispute is why is the son acting when he has no power of attorney.upon this i never returned severence paper as i wasnt happy with it.....i also informed land registry and put an alert on my jointly owned home..

    hank you for your elaborate explanation. However, I would like to ask you a confusing question that in joint tenancy where there are 6 joint tenants and the first four are holding the property on the trust for the remaining two in equity, and one of the joint tenants of legal estate has severed his share in tenant in common, and later on, the tenant in equity (let's suppose the 5th tenant) wants to sever his part of share then do he needs to serve notice to the all the joint tenants including the one who has already severed and became a tenant in common or just the remaining joint tenants?
