    I love this because it puts NFT bros into a tough spot. If they say he should go ahead anyway because "he's the real owner", they're admitting the receipt is literally meaningless. If they admit he doesn't own it anymore, they're admitting how easy it is to get your NFTs stolen.

    So I heard somewhere that "the code is law", that's the scariest thing I have heard as a software developer. The code is actually full of bugs and no one should take it as law. Only the law is law.

    The law is also code. It's just written for a machine that works probabilistically, rather than deterministically. By which, of course, I mean the human brain. Of course, the downside there is that not only are you dealing with buggy code, but also buggy hardware. The human brain makes the original Pentium and Windows ME look reliable. Nothing should be treated as law, not even the law. A suggestion, sure, but it should never be followed blindly like a computer does code.

    @@Roxor128 The law is not anything like code and isn't usually followed blindly, hence the existence of trials to determine actual guilt. It is subject to interpretation on purpose due to the case-by-case nature of many court cases, and code is not up to interpretation. Code works exactly the way it is written every time you run it. It is the exact opposite of the law. This is a terrible comparison and a piss-poor understanding of how the law works. The law being subject to human interpretation and imperfection is a feature, not a bug. It's the feature that prevents you from going to jail without a trial to determine if you actually broke a law or not. It's not perfect, but perfection in law is a ridiculous standard. You can never write a law that works perfectly in every scenario, and the same is true of code.

    The greatest comedy of all is that Darkwing84 is probably about to make millions off of a JPEG he paid a little over a hundred bucks for. Now that he knows that it's tied to a major creative project from a huge media figurehead, he can basically name whatever price he wants. It all comes down to how desperate Seth is for this show of his to get off the ground. And to think this all could have been avoided if Seth would have just created his own character instead of taking the lazy route. Multimillion-dollar screw-ups: the best kind of screw-up!

    Pretty sure he could take the scammers to court (or possibly even see them hit with criminal charges) ... if he could, you know, identify them. Probably hit them pretty hard and win too... But it would be over the Phishing incident itself, and help him little or not at all with regards to commercial usage rights or regaining ownership of the NFT itself. Though he could probably extract enough money out of them in compensation (assuming they had such money) to heavily mitigate his losses, at least. Pretty sure he's just fucked when it comes to getting the NFT back though. For reference, I am not a lawyer, so, you know...

    "Work" might be giving them too much credit... Unlike food or real estate, these NFTs mostly have no actual value. Their values derive from people speculating on them. I am no economist, but it kinda sounds like an economic bubble waiting to burst...

    @@randallb2179 Even other bubbles were tied to things with real world value. Real estate has real world value because everyone needs a roof over their heads. Tulip bulbs have real world value not just as flowers but for the various compounds that can be extracted from them. Even Beanie Babies are good if you treat them like the plushies that they are instead of staking your life's savings on them. NFTs are just lines of code pointing to links, most often pointing to a combination of pixels that only counts as art in the same way that prison hooch counts as champagne. As far as bases for bubbles go NFTs are by far the most nonsensical, and will be the most cratered once the bubble bursts.

    This is a big problem with NFTs. If they represent absolute proof of ownership, stealing them transfers the ownership. If they are not proof of ownership they mean nothing and you would need a legally binding contract on top of any NFT transfer to actually transfer the rights.

    That's the thing. A NFT acts as a receipt, deed, and a certificate of authenticity. They could actually be very useful for tracking physical goods such as antiques or even deeds for cars or land. However, that is a very niche, practical, and low-cost application. No one is going to get rich quick that way, so they ignore the beneficial use to focus on ever-inflating art sales for art that no one in their right mind would ever display.

    The issue is that it is _so much_ easier to steal NFTs than Runescape memberships. Allegedly, a better comparison would be to see some strange items in your inventory, clicking on them, then immediately having your entire account sucked away before your very eyes. And the rights to the account as well, in this case. Except instead of $7/month and a boatload of time, you have potentially millions of dollars stolen from you. Just like that.

    There is nothing NFTs can do that the furry community hasn't been doing for decades. Commissions, adopts, ref sheets, YCHes, the protocols for all of these things have been pretty well hammered out and are about as well agreed upon as such standards can be. When your "wave of the future" is getting circles run round it by people in animal costumes who jack off to Judy Hopps you should just give up.

    The really funny thing is that NFTs don't have any legal rights such as copyright attached to them, so Seth Green wouldn't have even been allowed to make his awful show, but if he'd paid an artist the same amount and signed a contract for the rights to their picture of a monkey smoking crack, he then could make a show about it.

    thats been my reaction since day 1... everywhere i went all i could get from people was "NFTs are BAD" with no explanation of why or what NFTs even ARE and theyre always getting shot down before devs even reveal what they heck theyre doing with them... the more i figure out about their anti-NFT arguments the less sense it makes and the more im questioning why theyre freaking out in the first place... simple logic dictates that something that does nothing that hasnt been done before (yong yea says this in almost every NFT-related video) should not be worthy of being singled out as everything wrong with the world... the "it hurts the environment because its on a server" argument (which took me SO LONG to find someone that told me something beyond it hurting the environment) becomes hypocritical the moment you realize the very website we are commenting on is hosted on a server and theres many MANY other websites and online games that are the same way... and finally the whole "its riddled with CRIME" argument has been stupid from the get-go considering the fact that if it exists then some prick is inevitably going to try to steal it and/or use it as a platform for some kind of crime (and thats even disregarding the fact that just about every single instance of such mentioned on this channel the NFTs have been an irrelevant minor detail... the most notable instance i remember being the axie infinity hack where NFTs only factored into the story because the game is NFT based and the devs loosened security to speed up transactions to meet demand which led to the hack)... really everyone's anger is better spent elsewhere... mine was too until the line was crossed by laughing at someone who got ROBBED and who's sole crime was purchasing something the internet decided to hate........

    Looking at the tweet from Seth Green, he appears to have confirmed the buyer has the legal "bona fide purchaser" argument. His tweet saying the NFTs were stolen mentioned them being purchased - meaning the buyer would have had NO WAY to know they were stolen at the time of purchase! Now that's what I call priceless!

    As someone who works in cybersecurity the idea code is law is both ridiculous and terrifying, a lot of code is buggy and insecure, now you have code running in the blockchain , whatever code is actually interpreting it and the underlying operating system and you really trust all of these things always run perfectly? How do you patch code running in the blockchain? Fortunately code isn't law, law is law and its the law that decides if you have the right to something not tthr blockchain.

    NFTs do not include copyright. That's what makes them worthless. Additionally because of the nature of blockchains there is no way to be 100% sure the buyer isn't the same person as the seller trying to create the illusion of value.

    As far as know, bored apes are somewhat of an expetion. You do get a license to use those apes if you buy the NFT. But yeah, for most NFTs, the rights to the image and the NFT that contains the link to the image have nothing to do with each other.

The creators of the bored ape Yacht Club have specifically expressed that you get a copyright license to use those images, including comercial use, when you purchase one of those NFTs. They cannot sue you for copyright infringement if they give you permission to use their copyrighted material. This isn't something new, it applies to any other media, as well. If I specifically told you that you can use my profile picture on your KZread account, I have no recourse in case you actually do use my profile picture on your KZread account. You can legally use copyrighted material if you have the permission of the copyright holder. Btw I'm not advocating for Bored Apes or any other NFT. I think they are stupid and not worth any significant amount of money. But in this case, purchasing a Bored Ape does actually give you a copyright license to that specific image because the copyright holders have specifically said so.

    It's not cause he doesn't have the assets, it's cause he no longer has commercial rights to them Like you could have an image of a character saved, but you wouldn't be able to do anything with that picture because you don't own the rights to them He lost the rights when he got scammed out of the "deed" to the characters

Yeah sure he acquired the "art" but that's not what he bought or gave away so in essence; he's got the picture framed in his house but someone took the artist's signature off and sold it to yet a further person with a map to Seth Green's house and, because the signature is what was the thing that Seth bought in the first place before handing it willingly to someone else to do as they want with is the only thing of value, now he is unable to even legally touch the art while some random can come and go as they please.

LegalEagle already analyzed NFTs and concludes that the sales of these may not even be legal to begin with as copywrite only guarantees ownership for things created by a person and the ownership certificate is only valid on the initial sale but no sales after

    I just want to be here for the day that NFT's and cryptocurrencies are the subject of a high profile divorce case, in front of an elderly judge. Watching two overly emotional crypto enthusiasts trying to argue they should own the receipt to a link to a picture of a monkey has value, then watching a court try to figure out how to compel someone to give up a wallet password, then watching everyone try to find the damn things after the loser of the case quickly sells the assets to some vault like what happened here... the whole thing is going to be a goddamn shitshow.

    NFTs are so stupid. The other day I was explaining what and NFT was to a co-worker and I felt like such a crazy person having to explain the block chain and all that stuff. And I don't even own any nfts just the fact of explaining what it is makes me feel like I'm crazy let alone buying them

    Bitcoin is at least a sensible choice and has been around for decades. Maybe it won't be Bitcoin but I definitely believe crypto will be the future given more and more places are becoming cashless societies. It's pretty sturdy. Something like Shitcoin...obviously not. Don't put your money in to a damn meme that'll fall through the floor within a couple months at best...

    the do for the monkey stuff, several of the NFT sets tie the ownership to the image (as its just AI generated trash anyway) and have it written into them that you can use that image to do anything you want. What you are thinking of is when someone steals artwork, or doesn't tie the NFT to the ...'art'....which is the norm but not always the case. The bigger issue in this case is the 'artwork' itself as even if you own the right to use it you own the right to use JUST it not the 10,000 other images which are basically identical just with a different background or slight pose changes. Even if Seth Green still owned his NFT unless his cartoon was a static image that never moved from one spot then he would be using other peoples NFTs and opening himself up to lawsuits.

    To add more confusion, legal eagle suggests NFTs can’t even be copyrighted. In a video, he pointed out that only human made art is allowed to be copyrighted. Since NFTs aren’t human made, he argued they can’t be copyrighted. Whether they change copyright to change this, we will see. Edit: After rewatching his video on it, I have to clarify this is in association with things like the bored ape yacht club.

    They lost me at NFTs stolen and somehow it causes them to lose the rights to the jpgs for the tv show. Like wat's the point of this decentralized block chain if u're going to link it through a centralized company giving rights to the art through it and going through the government/legal system to enforce it.
