Sir clause 5 talks about discharge u/s 258 which is stoppage of proceeding in certain cases.. due to discontinuation of case such person is acquitted or released ( shall have the effect of discharge)

person who cannot be prosecuted consequently mean he cannot be tried, i mean think no trial can be held, if he is not prosecuted
