If you treat fct as the 37th states it will give you 2/3 X 37= 24.66 states. We can't have fraction state but a whole number state. So the best and workable calculation is 2/3 X36 = 24 and Abuja (+1 ) which is the intent of the constitution

Are you saying this as a constitutional lawyer or as a partisan LP supporter. If law was as simple as you present it, people would not be spending 6 years to become lawyers and many years to learn under senior lawyers. By the way, in 1979 we had 19 states inclusive of FCT and the Supreme Court then calculated it exactly as you calculated it in favor of Shagari against Awolowo.

@@olukoredefakorede1422the Constitution and the Supreme Court did NOT count the FCT as a state in 1979 (refer to Section 125(b) of the 1979 Constitution) for electing the president. The FCT was only inserted as a specific ADDITIONAL requirement to elected the president in the 1999 Constitution.

I see the APC/Tinubu lawyer talk as if he doesn't know what transpired. The plan for INEC to refuse or delay the release of the materials until late, was the strategy. PEPT also relied on it. I don't think it would have been this way if the materials were released when requested.

I just smile at those on social media or physically defending the rubbish being done in this country by our leaders... although it hurts me very much. but we all will suffer it and our children will suffer it. First tenure of buhari, many of the northerners didn't see any incompetence.....but from middle of second tenure. they couldn't bear the suffering and hardship, so they started agreeing with the incompetence.... but some people still believe that buhari did very well. those supporting the fraud now will still cry later on, because they won't be better than the masses. the tokens/favours they are getting now will not be sufficient to cover them from bad leadership effects. We can't compare with Ghana, north African countries talk more of Indonesia/Malaysia that we have better potential than.

This Professor said all these when he was yet to be bought over. But everything changed when our election was dollarized.

176k polling units across the country, should have at least 1 party agent of each party in this case 18 depending on ur resources with every polling unit manned with security officials e.g army to promote law and order. So by that the likes of pdp, lp and apc should have that sort out. First, at the end of the election they(i.e party agents) have the right to see the final copy of the results, and i assume take pictures of it or at least videos per polling unit(176k plus) of the presiding officers(p.o) reading those results and if elections didn't hold in certain polling unit have video evidence of that too with a time-line stamp, if they had such evidence i reckon that will be overly substantial in court. I find it terribly stupid the lp and the pdp didn't take that route, that would have been a slam dunk in my opinion. That seems like the only way to substantially prove this, yes it is tedious but with that all angles are covered. All in all inec and the security officials e.g the army, police, dss, e.t.c should also be held to account for at least 70% of this mess, by no means did the pres election held in February show transparency. That being said, the final result per polling unit irev transmission could have easily covered several loopholes and put inec in good light, that is what is suspect. By all counts if our judiciary was fair, INEC should be the one on trial for not following their guidelines.

That is why each party must have their own situation room that collates the results from each polling agents who captured the already signed result because that is what the Bivas will upload to INEC server. This is the foundation to build a concrete evidence for their petition. They didn't but concentrated on the easier ones, forged certificate , confiscation of money and Abuja 25% which can easily be knocked out. None of petitioner worked on the numbers which is the key to the election.

I always like to learn in every situation, When I was arguing with a learned person in my office, I was told A court is not a place of TRUTH but a place of FACT. The question we must ask ourselves is that how factual the petitioners was able to proof their cases

This is exactly what makes Nigeria a 3rd world shithole. No Western agency will dare try what INEC did because they know their justice systems frown seriously on Estoppel. Look at the US system....and how they are dealing with the Donald Trump case without fear or favour. A country cannot thrive when rules of gangsterism apply. One of the things that makes governments different from mobs is accountability. Where is the accountability if we cannot curb estoppels. Estoppel will be the new challenge to Nigeria's growth and development and this is something the PEPT has reinforced. 1-INEC makes their own law. Nobody held a gun to INECs head when INEC said they will do this and that and even went further to say they have plans in place to deal with glitches. There was no recanting of these on any platforms before the event. 2- The tribunal judges said their decision will be made on merit not technicality. Their judgement was all about technicalities. The judges seem to be basing their judgement on their annoyance with youths who took to social media to try to hold the country accountable. Based on this, I am a strong proponent of Nigeria outsourcing the conduct of elections and the adjudication of tribunals. We do not know what we are doing in Nigeria. Both INEC and the hiding PEPC judges have shown why Nigeria will never add value to the world.

The question I expected Channels to ask these men is how useful to the integrity of Nigeria as a Nation are the rejection of the charges against Tinubu by the 5 Judges. Throwing out charges like Certificate forgery, has legitimized acquiring certificates anyhow without proper proof of its authenticity. What we expect is that the court should ask for unquestionable proof that the certificate is authentic. The courts should not shove any confusing ideology upon Nigerians. We are not desperate, psychopathic, heartless, power drunk, corrupt politicians and judges who have estranged desires and want to obtain it through governing Nigeria.

Things for Nigeria to do soon to succeed as a country is to dissolve INEC for other organizations to use that as an example, and fire the INEC chairman Mahmood Yakubu, impeach and fire Tinubu as soon as possible, and give back the mandate to Obi.

Imagine this shameless man defending criminality on national television.

For every reasonable person, the video of the imec chairman stating with certainty what he was going to do should be troubling. Something grievous must have happened to Mr Yakubu to make him renage on all his promises. I think he must have been instructed at a pont by his masters not to follow the guidelines.

Nigeria can never succeed by all the twisting by lawyers who know the truth. It is very criminal and mindless for anyone to praise inec for all the malpractices perpetuated by inec chairman and the power that be. This destroys the image of our country internationally.

If the FCT is to be treated as other states what it means is that if a candidate scores 25%in 23 states and miss out one state, it doesn’t make that one state that could have completed it special. If they are translating the constitution, and means and, no less no more. The constitution should stand and if it makes Abuja special, so be it. This is where the seat of power is and it MUST be respected. Because if Abuja is taken over by any dissident, Nigeria is gone. Let the constitution be amended to allow matters in courts be concluded before winners are sworn in. It will be a difficult task and deed embarassing to the country to unseat some one who has been sworn in and presented to the world as president.

I was a bit shocked by the judgement. I didn't expect the tribunal to declare anybody victorious. But I was shocked when the tribunal said the petitioners did not provide any evidence to support their claims. Are these judges not present when the cases were going on or they were asleep when those documents were tendered? The judges have not done the Nigerian judiciary any favour at all. Their judgement is abysmal and not legally procedural.

Did you (yourself) read any of the tribunal proceedings or listening to what lawyers and TV analysis or bloggers commentary? I asked because I did and already knew the lawyers to LP and PDP were just going putting up bravado to fulfill all righteousness knowing fully well that they had no case.

First, PEPT judges should be asked if USA constitution does not believe in the equality of votes. Why are some states in US known as swing states? If Abuja is now to be treated as a state the constitution has made it a swing state not that the state must be won but the President must score at least 25% as a test of it's popularity. What PEPT is doing is treating FCT as an inferior state if it is now the 37th state. All the paraphernalia of a state must be given to it such as the position of an elected governor, house of assembly and local governments. There should be no special and discriminatory practice against FCT. If FCT is not a special case, then PEPT is mischievous to make it look as if it is inferior and disadvantaged state.

Why should our constitution be a problem for us. It gives room for different interpretations for same issue depending on who is handling the case.
