Will these lawsuits apply to Goodwill and Thrift Stores? That would put them ALL out of business. I see counterfeits all the time. What about EVERY SINGLE FLEA MARKET with tables and racks of imported obvious counterfeits? Those would be easy to shut down. This is really annoying.

Answer is no. Shop Safe applies strictly to online third party reseller marketplaces. It would apply to Goodwill items at eBay for example as it reads now. The Trademark amendment reads very vague right now in its usage of "Mark." That is intentional as once passed into law articles can be added further defining the amendment. The original Sho Safe Act of 2021 sought to fine third party marketplaces directly as matter of law for any offerings that used Trademark or Trademark Terms. Law firms all over the nation said its the end of eBay, Poshmark and the rest short of Amazon or Walmart as both are retailers and have authorizations. They'd need alter their third party business models towards consignment and set whatever terms they please. Goodwill does not buy goods with intent for resale they are donated. That makes a difference of intent lawfully, they are not purposefully offering fake products. Flea Markets are easy, simply contact you're local police or State police and report the crime.

I haven't been directly affected yet but the fear of the wrath of these people, and the oppressive nature of eBay on its sellers, has made me afraid to sell things legally on eBay. I'm so grateful to hear that there are some lawyers out there ready to challenge the big companies in favor of the consumers and the sellers

In this video you mention we should contact our representatives about the ridiculous class action lawsuits coming out of Indiana. I totally agree and therefore propose that as a former teacher and great orator that you might consider putting together a letter such that your viewers and the millions of other concerned resellers could just copy and send to their respective lawmakers. Such as AARP, NRA, and so forth have done over the years. Thanks for all you do for the community. Best wishes on your NO death pile goal, I too would love to accomplish that.

You’re absolutely right about refunding. Last month someone claimed that their package arrived empty. I had a feeling they were lying! But it was a five dollar item. they claimed they could not figure out how to open a claim, with eBay. I figured it was a problem buyer, didn’t wanna negative feedback over five dollars But the crazy part is that they left me a review saying that the mouse was cute! The item they purchased was a little vintage felt mouse. And I just shake my head after I read the review. Because they claimed that item never arrived. And I gave 100 refund.

I been trying to list the items quickly after getting them since they don't get put away until they are listed, so I can't lose them in a deathpile. I'll typically clean and take pics of them right away. Then as I put the items away I'll create a folder for the pics of where items are located so I'll already know where they are before the listing ever goes up. Also helps since I can list at a later date if I need to since the pics are already organized by location

Hey Kevin, I'm the one who bought the Cassette lot! Already sold them all (my Whatnot show). Only made about $18 in profit but took very little work and they went quick! Not the margins I usually shoot for but I love supporting creators I like (and learn from) so it's all good :).

Sold a hdmi projector early dec and it was returned shortly after Xmas saying it didn’t work. Worked perfectly when we received it back so can only assume it was used over Xmas and then returned.

If you get a cease and desist… most lawyer friends will tell you that its the cheapest form of scare tactic without actually filing a suit that companies try. Once you argue ir stand up to the request, they do the math and never enforce. Good food for thought.

When ignored it can become evidentiary towards legal proceeding or in case of business vs business incorporated into filing with a State Attorney General. State AG's tend require the Plaintiff attempt contact and attempt resolution before they step in. Some accounts you might hear of who get a permanent suspension at an online marketplace yet no reasoning are due to ignoring communications of a rights holder and subsequent intervention of a State AG and a summary judgement serviced upon in this case, point of sale. If a creditors attempts at contact of a private citizen go ignored for example that creditor will seek a summary judgement. Suddenly every bank account the citizen has gets a lawful restraint placed upon it stopping all capability to withdraw funds. In most States the bank cannot tell you anything more than "A legal restraint exists on you're account(s)." They cannot tell you the creditor, reasons, none of it that is for you to find out. This one of the issues that makes identity theft so very difficult to navigate. Another is even if the creditor, some collections firm is found that you don't even own the debt they are accountable to a maximum of $2500 in fines in most States. In other words the citizens ability to do banking might be impacted for a year, two years yet the debt they attempt collect isn't even the citizens doing yet the collections firms legal liability doesn't exceed $2500 and thats not the citizens $2500, its State fines.

I wish returns were only allowed within 10 days. I never understood why someone would need 30 days to start a return. It sounds more like a warranty.

I do 30 day return and I actually had a lady by a set of 6 Danielle Steele Books and tried to return them 180 days later, and I called eBay and they were like I don’t think so. Those were the days you could actually get someone on the phone. I guess because she used a credit card she thought she was going to get away with it. Ppl are ludicrous insane and try to take advantage of the system. I should contact Bryon Donald’s (R)our Fl Representative who takes no crap no matter what that may help us all. Yet; We need people from all over different states. Awesome video Kevin great seeing the children-Grown so fast in all the years that I’ve been watching; just like me grandchildren have! I see new mom’s today and tell them to enjoy as much as you can while they are young (when they are getting upset w/ them over stupid stuff that takes a simple NO” because they grow up so fast before our eyes. Lots of stores now days only give 10 to 14 days....It's fair. Also the person knows pretty quick if they want it or not.

I agree with you about asking the buyer to send it back. Normally I get only 50% of items returned that asked for a refund. Thank you for your information.

The playboy story reminded me of my own playboy event as a young teen. I hid my only copy (gift from a friend whose dad had a subscription) in the hallway bathroom across from my bedroom under the rug (the rug was cut to fit the room wall to wall but wasn’t secured down) in the corner by the toilet. You can imagine the panic when I returned from school one evening and the rug was gone! I never said a word and either did my mom. Decades later we shared a good laugh!

I do buyer pays return shipping and I make them send it back. I’ve had somethings happen where I made a mistake and like you said I just take care of them because I messed up.

Unintended consequences? I don't think so. This is 100% what they were trying to accomplish. These bills/laws are not written by any true organizations that are actually looking out for consumers. They are written by the organizations that are held up by the corporations trying to do this stuff.

about the vcr, I also got a return and the vcr worked just fine sold it again. A few times, the buyer did not know how to work the device, I had to messsage them back and forth telling them about the 3 audio video cables and how to hook it up, sound like the kids are buying these old vintage vcr's and were never around when they came out, so they do not know how to work them. 3 times I had to tell them how to use it.

Another great video and very appropriate content. There are lot of challenges for resellers these days but I am not letting that stop us. I really want to know how many Enemen you have sold! I am guessing around 5,200 as long as you have been selling them! Take care!

Only one return on an instant pot that the post office destroyed. Had another post office related incident where the package was opened, the charger removed and retaped shut. Had to send another charger for $6 from Amazon. Had a guy also say a vcr/dvd combo didn’t work and it was completely tested and working when shipped I refused the return and got a bad review. I even had a photo of the unit running in the listing.

There are people selling those famous mugs,everyone likes, wrapped in high end logo. The high end wrap starts with a G.

I have the opposite problem. If for some reason I approve a return and say please do not ship the item back. They still return it

The problem with VCRs can often be the old tapes rather than the machine itself. I have had that exact same story multiple times.

I do end up just issuing the return on a lot of the items that have return requests for me though lately I've found even after I have issued the return they still are able to print the label and I get it back when I didn't even want them to so I get charged for the label. I'm at a point where I'm thinking I should just wait until they ship items back but I also don't want to do anything to risk my top rated.

My eBay account was sued in one of these lawsuits, it was terrifying. They are allowed to serve you via email. I wound up being able to settle, and my lawyer said he spoke with the judge and the judge said these lawsuits are increasing and agrees they are abusive. They sue you via your eBay name and can freeze your bank account.

Kevin, I think you made an excellent point in contacting your State Legislators if concerned about a Reseller Law Suit. They are the ones to introduce bills that become law . They are good people who can intervene since they represent the needs of their constituents.

And they should be concerned about these types of bills taking away income opportunities especially for rural communities that don’t have the same job opportunities close by to replace the reselling income…they’ll devastate rural communities who rely on this sort of thing to supplement their incomes

They definitely abuse the returns. They try to do this so you just refund them and dont ask for the item. I had a buyer tell me that on a 35 dollar Wii Game when they claimed didnt work but did. The buyer told me sellers usually don't wont the item back and just refund them fully. I asked for the game back and never got it back. Reported it to eBay nothing happened just blocked the buyer.

I offer refunds with the buyer paying return shipping unless I was at fault. The other day I received a return due to fit (yes measurements were included) on a NWT pair of pants. I opened the package and the tags were removed. I reached out to eBay and was told that there was no way to prove who removed the tags so they gave him his full refund! Basically calling me a liar. 😮

My little sister was accused of a hit and run accident in a parking lot between her little tiny Honda civic with a plastic aftermarket bumper and a the other person accusing her of hitting her parked 90s model ford explorer 4 door suv made of solid metal for bumpers…..the cops just gave my sister a ticket without any investigation…the cop for some reason had it out for my sister…so instead of just paying the fine and damages….we did our own investigation and hired an attorney for the $500 damages amount they said my sister owed this lady…..the cops even submitted evidence that was made up and not my sisters car etc….when we hired the attorney, he asked why not just pay the fine and get on with life? We looked at him confused and asked why that would even be an option if it’s a false accusation to begin with? If we let them win this bs then it will continue! She did nothing wrong and this woman is lying and attacking my sister for reasons we aren’t aware of and we won’t reward lying! If she did the damages, that’s different. We would rather spend $500 to get this thrown out then to reward liars with our money and damage done to my sisters criminal record. No. Liars shouldn’t be rewarded. It also taught the cops that we aren’t ones to roll belly up at the slightest threat….they think twice about effing with us now! Lol….we won. Very easily! And made the cops and the county attorney look like punks. Always fight any allegations. U didn’t intend to harm anyone and u bought the items from Amazon…wtf?

Unfortunately with clothes you have to suck it up and give the return. You'd be shocked how Many people buy clothes to wear to an event then return them clearly worn after it's over.

I agree on everything regarding returns. Ebay will stop siding with so many buyers who are not legit only when they start losing money because resellers are educated enough to fight and win cases that currently they just let go and rationalize as "the cost of reselling". Nonsense. It is a hassle to deal with ebay, but it is necessary to make it hard for scammers. It will stop being so common to scam when it stops working out in their favor.

I am with you on returns. I do not do partial refunds. I do not refund without them sending the item back. Too many people expect that, so they find a reason to open a return in the hopes of just getting money back. It's encouraging negative behaviors in buyers. I do not return their shipping either. I just had one where she opened a return saying shoes were loose, so not an INAD, but she kept them until the end of the ridiculous return window ebay allows, and sent them back minus my security tags and all scuffed up. I did keep part of the refund because they were no longer new. She appealed to ebay and not only did the give her the full amount of the shoes, but also the shipping costs! So she was rewarded for borrowing my new shoes, but I am glad I was able to keep part of that refund since she clearly used them. My % actually returned sounds close to yours. When they see they have to send it back, they just disappear.

I had a piece of jewerly that someone wanted return so I said as soon as I get it back I will refund. It worked that way. If broken something i dont need it back.

I hardly ever get returns. Of course the way eBay is sometimes a bit of a roller coaster I received 2 in one day. That sometimes can break your spirit but you just have to move on.

I list in the day or next day after buying.

I sold a dark-skinned Lladro cherub with free shipping. I don't offer returns in my policy. The buyer wanted to return the Lladro because she said it was darker-skinned than in the photos which I disagree, but accepted the return. She got annoyed when I didn't return the full amount as I deducted the shipping cost from the return. I told her to take it up with ebay. Why should I pay the shipping because she changed her mind about the figurine. I now put "dark-skinned" for any figurine made with dark clay.

I got a NWT's item last week and they had ripped off the tags. I am going to be Top Rated on 2/20...just a few days away. I had to give her a full refund. Lesson learned.

I only give money back under 15$ for not receiving the item back. They usually will take some money back, I tell them if they want all of it they have to send it back, most of the time they take the cash and keep it, this way cuts down on the negative feed back

I always make the buyer return the item. I haven’t had a situation yet where we have been at fault for anything. It’s just been refunds because they change their mind or they claim doesn’t work. But, I don’t know that it doesn’t work for sure so I just require them to return it. I have free returns so I pay the shipping back. If I test it when it comes back and it works fine then I deduct the shipping cost from the returns. Last month was the most returns I’ve ever had and they were all for reasons like “ changed my mind” or “ didn’t fit”. All but one came back too.

I mean that I knew ahead of time we were at fault lol. We have had electronics not work but it worked when we sent it out or it was brand new in sealed package so not tested so we just always require a return before refund.

I had 3 return requests and only 1actually made it back. All 3 were due to the buyer not reading the detailed description, even though I had good measurements, pics, and other details. Buyers are just not scrolling down to read the description category and are also not looking at all the pics.

That was not the issue here. I have a 30-day return policy, but the shipping is on the buyer. These were 'good' buyers; they just didn't read the description and so it was on them. Ebay has almost always sided with me; in fact, when I first started out, they would message me when they thought someone was trying to scam me.@@DRventura333

I want my item back also!!! So many cases closed because they didn't return the item.

We sell mostly clothes and never allowed returns, we then started and quickly started turned off because we became a rent the runway.

SMH, I am about to end free returns on Ebay for this exact reason and the scammming buyers are flooding Ebay to get free products. I sell hats and vintage clothes. I had my first extortion requests from a scammer by asking for a full refund or I will receive a negative comment on a New Era 59Fifty hat that he purchased. The scammer claimed it was fake by an easily refutable point that a couple words on the fabric tag are different wording (the wording on the fabric tag changes for every hat based on material). He waited till the last day of the 30 day return period. I denied his extortion request. I reported the customer for extortion and a fake review. The scammer then left a fake negative review stating the hat was fake and that I am a scammer. Ebay said they could do nothing even though I showed them the messages of extortion and proof the hat was real. The guy has a history of fake reviews he left other businesses over the years where the seller replied saying it was a fake review and the case has been closed in the favor by Ebay.

I am not a reseller but less than two wks ago, I sold my LL Bean coat online to a woman in California. She sent a personal email to me prior to buying asking about the condition of coat. I red flagged this automatically thinking this sale is going to go sideways as my pictures were very clear on the condition of the coat. I responded that the coat is good with no conditions. Welp, during the Superbowl I was notified that she filed a claim and wants a refund.😮 I have a no refund policy. She pd for shipping when she bought the coat. I have no idea what to do. Ebay has my acct on hold until this is resolved. Thoughts? Kevin your video today discussed requesting the item BACK so at least I know that. I question why she's allowed to even pursue this when there was full disclosure of coat. What options do I have. I've sold on eBay for 10 yrs, no claims and all positive reviews fr buyers. Help please

I have had a LOT of returns the month of February! This is coming from January and first of this month the returns. I will not accept returns of something that was new and they sent pictures showing me they are NOW USED! eBay buyers like that are saying we can return when we are done having fun. They think it’s eBay policy. I’m sick of the returns to the point I stopped listing. I owe well they can wait. I’m retired with very little to live on and this is my extra money to afford clothes soap, etc.. I felt so jaded until I learned on my own how to rebuttal a claim to return. But I’m down hearted. My husband was working and now is to sick to work. Talk about feeling low that’s me. I don’t expect anyone to read this or care that’s me feeling so down about it all. 😢

I have free 30 day returns on my account (parttime reseller). One reason I do not like selling clothes is buyer usually does not pay attention to measurements. If returned because did not like or wrong size, May I omit shipping cost when something is returned?

I don't do free shipping. I give refunds upon receipt of the item. I did a refund on an item and got a negative feedback even though I gave a refund with a great attitude. So dammed if you do, dammed if you dont?

I bought items from a storage unit many items I posted on eBay, such as Harley, Davidson ring, skull, rings, etc. along with other items was in the storage unit a lawyer from Harley. Davidson reached out to me to stop selling copyrighted counterfeit items threaten legal action against me paid out of court settlement. Was this even legal for this person to go after me since these items were used and I tried to explain to Harley Davidson lawyers, if so, will I be able to get my money back?

Plus, didn’t give me an opportunity to respond but threaten legal action. Remove the items without notifying me and I get this email soon after do you have a chance to react to these allegations

Why are death piles soooooooooo hard to work through???? Finally just worked through a little stack of 4 old calculators a friend gave me for free at least a year ago.... Had a feeling they were nothing special, none had batteries nor batteries I have on hand, yet I couldn't trash em or just donate them to a thrift until I at least check em out.... But I let them sit in a corner for a long time (among other death items) and just every time I glanced at them felt no sense of urgency or even interest in digging into them hah. I can't explain it with some things man but it happens............. Turns out they're pretty much worthless, high populated items, probably still will just put them in a cheap lot since they were free if someone bites it's all green money and they take up very little space.... I feel better now that they're dealt with for sure lol

I notice a lot of resellers saying that their returns are due to buyers not reading descriptions. I try to assume that the buyer won’t read the description and only sell things that don’t require notes in the description about damage. Unless I’m selling something “for parts”. If I do sell something that requires the buyers attention to an imperfection I mention it clearly in the title
