Do you remember when the Sauber F1 team and driver Giedo van der Garde kicked off the 2015 season with a legal battle over the Dutchman’s position at the team?
You don’t have to be a mathematician to work out that three into two doesn’t go - but back in 2015, it didn’t stop Sauber from signing three drivers to pilot its F1 cars.
After a miserable 2014 in which the Swiss team failed to score points, the team was struggling to survive with a reduced constructors’ championship payout - and let go of drivers Adrian Sutil and Esteban Gutierrez at the end of the year.
In their place, the team signed ex-Caterham driver Marcus Ericsson and GP2 driver Felipe Nasr - who had just finished third in the second-tier category.
But reserve driver Giedo van der Garde also laid claim to the seat, and infamously emerged in the Sauber garage at the Melbourne season opener following an Australian court ruling that he had the right to drive for the team in 2015.
Although van der Garde never raced, and later settled with Sauber over the controversy, the legal wrangling hardly looked good for the team.

    The most amusing part of all this was that Monisha Katlenborn, Sauber's team principal at the time, had a background working with various legal firms before joining Sauber, and even worked in their legal department in the early 2000's. Of all the teams to get publicly dragged through the courts - it had to be the one run my a former lawyer.

    Maybe lawyers think they can get away with shady practices because they think they know the system whereas non-lawyers probably don't feel ok doing that kind of thing since they're not experts on legal stuff.

    But tbh she was in the paddock for years & did well to keep that team going for as long as she did at a time when teams failed every other month. She's way more qualified than Claire Williams ever was who likes to highlight herself as female empowerment/inspiration when in reality literally no one could replicate her career from PR assistant to principal.

    Her lawyer skills is what saved this team. While everyone was talking about those cases they supposedly lost, Monisha Kaltenborn probably knew exactly what was happening and what the outcome would be for her intended goals.

    Hadn't Sauber also signed Bianchi on the weekend of the Japanese Grand Prix. I'm pretty sure that was emerged at some point....

    I think i read some where, because of Bianchi accident, they panicked and signed nast and erricson because Bianchi was ment to bring enough funding that they could run vandergarde aswell

    And around this time Simona de Silvestro had a developmental contract with the team with the eventual goal of getting her into F1

    On the other hand the team did managed to stay afloat instead of retiring for lack of funds so perhaps this legal manoeuvre paid off…?

    they are not pilots they are drivers and drivers drive the car as a f1 car is a "CAR"

    Giedo wasn't highly capable. He was mediocre; a typical pay driver with money from his father in law. The case with Super Aguri was Giedo thinking he could walk away after having signed as a testing driver at Super Aguri because his then girlfriend, daughter of his financial backer was the one who signed. He also thought he was moving to a better team and had an actual chance or racing. All not true. His girlfriends signature was valid, so he did have a contract at Sauber, and Super Aguri was the faster team, so once he was allowed to go to Spyker, he was at an inferior team, and one of many, MANY testdrivers. I think he only did like one test. This while at Super Aguri, Frank Montagny couldn't pay his sponsor money and if Giedo was still there, there was a good chance that he would end up racing. At Sauber, they simply had to go for Ericsson's money which was a whole lot more than what Giedo's father in law had to offer. Even with all the costs they lost (and probably calculated in) with the Giedo case, Ericsson was still the better option. Not only did he have a lot of money, which Sauber needed to survive, he also had the Tetrapak network, of which Longbow investments was part. Indeed, who are today still the owners of Sauber. Sauber / Kaltenborn did the right thing to serve the continuation of the team, saving hundreds of jobs and a serious F1 instrastructure from the BMW days. Giedo talks a lot about this case like he was the one who has morally right, and unfortunately, we never heard form the side of Sauber here since they cut communication to the media about this. But this is F1 and it's a tough world. Kaltenborn's legal elbows kept this team alive and the outcome of this case, namely Sauber that is still here today is proof of that. Fact is; Giedo was a mediocre driver, with not enough money. Sauber was on the verge of going bankrupt. The option of Ericsson presented itself and they needed to ditch Giedo because Ericsson had more money and the right network, so this is what they made happen.

    Yes, Kaltenborn deserves a lot of praise for what she did for Sauber. He also completed the Honda deal that Vasseur unfortunately cancelled. Since Honda actually inquired what STR would cost to buy, there's a good chance that they would buy and expand Sauber. We've seen how hard Sauber was struggling last year and during the pandemic pause was even struggling to survive. Kaltenborn was a way better teamboss compared to Vasseur that basically turned the organization into a junior formula team, relieving himself of all kinds of responsibilities and independencies by making the Ferrari deal.

    @@TheGhostInMyScreen You could argue that a works Honda team would have been quickly closed, given that they're leaving F1 as things stand, and Honda don't exactly have a record of sticking around in the sport over the long term as a team. I'd even say that having the two Red Bull teams running their power units is what's kept them going this long. A deal with Ferrari and Alfa was the right choice in order to secure a long-term future for Sauber.

    ​@@StuartGarlick They are leaving F1 because they aren't getting the value from the PR display, which would be different if they had their own team. Also, their responsibilities would be different, so the motivation to just leave would be based on different factors. Think about the fact that they would've had a bigger investment in Hinwill with more money and people there. So to just leave it would be a harder decision. Also, the infrastructure in Hinwill offers them many extra options, like developing a sportscar, Formula E car, etc. etc. So I think the comparison with the current situation in Milton Keynes can't be made. But even if they did leave F1, then still Hinwill would be left as an organization in a far better health than they are in right now where they are in financial needs and lost a huge part of their independence to Ferrari, as well as their identity since there are so many Italians working there, even the language has changed from Swiss German to Italian, while this wasn't a problem at Brackley.
