Paid Holiday on the Voting Day? | ISH News
As the Lok Sabha 2024 elections are in full swing, with four out of the seven phases already complete, it's crucial for all voters to understand their rights regarding holidays on polling day. ISH News has released a helpful video about the election dates and the manifestos of BJP and Congress. However, there's often confusion about whether employees get a holiday on polling day. Let's clear this up once and for all.
According to Section 135B of The Representation of the People Act, 1951, all employers must grant a paid holiday to their employees on polling day. This law ensures that every person employed in any business, trade, industrial undertaking, or any other establishment has the right to vote in the Lok Sabha and/or state legislative assembly elections.
The law clearly states that employers cannot deduct or cancel an employee’s salary due to this holiday. Employees must receive the same wages they would have earned if they had worked that day, even if they usually don't get paid for such holidays.
If an employer fails to grant this holiday or deducts wages, they can be fined up to ₹500/-. However, this rule does not apply to employees whose absence could cause significant danger or substantial loss to the business or society.
