One year ago I bought a Ferrari from CNC Motors

I went to the DMV to figure out the title situation so I can officially have this car legally in my name so I can either figure out repairs or sell it and they're giving me the runaround and not returning emails or phone calls. I don't think I have any options at this point. What would you do?

    I’m sorry to hear your frustration about your dream car predicament . Your not the only one who is incurring such a big loss. My prayers to all that are victimized as part of the scam thru CNC and hope you all recover and achieve your dreams once again. I was fortunate enough to acquire my dream car thru a reputable dealer.     One thing: I never rely on email and my response going through without a follow up. "did you get my email"? and if they don't respond to that, I keep writing until I do or phone them. TOO many times email get filtered as spam or blocked for dumb reasons.

    Boggles the mind why CA DMV Registration Dept. did not tell you who is the registered owner and the registration was suspended due to no proof of insurance. CA DMV Registration should have a record of mailing registration renewal notice and notification of a suspended registration. At this point I would stop going to the DMV and focus on the DMV investigator assigned to the CNC investigation. Highly likely, the investigator is trying to find out who consigned the Ferrari to CNC and what happened to your money after you paid CNC. Once their investigation is complete it may show CNC never paid the owner of the Ferrari. If so, the Ferrari goes back to the owner and you have a legal claim to CNC's assets. Perhaps, with that legal standing you can ask your credit union to suspend further payments until you get paid from a court settlement against CNC.

    CNC Motors has been a dealership for over 25 years but in 2017, they decided to open a location near In N Out in Upland, California but a couple years later, the owner was being too greedy and that is how the fraud situations were happening

    Also, many sites offer the service to 'recover titles', whether you lost it or the previous owner lost it. Depending on the state, they may be more lenient with requirements. If you have a bill of sale, can prove insurance, can prove payments for the car loan, etc. These recovery are for services for people who either lost titles or NEVER got them from the previous owners. They are prob used to dealing with DMVs in many and all states and may have contacts to discuss the matter at hand directly with people at the DMV who can help. For a fee. But at this point, offer them their fee and a second amount when they get you the damn title. To motivate them to work hard on your case. Best of luck.

    Here is the problem, he isn't really the owner of the car is he. The owner has the title and this ferrari is basically a stolen car. I get that it's a little more complicated than that but that pretty much sums it up.

    @@Millsprinkles569 once he paid for the car and took possession, he is the new owner in the eyes of the law. The title issue is just bureaucratic red tape. The one issue of the seller’s agent (the dealer) not giving the seller proceeds from the sale does not negate or undo the sale. This gentleman will get his title eventually.

    Depends! If the original owner never contracted CNC to sell the vehicle or pulled some shady shit & he never signed the title over YOU ARE NOT the owner of the car just because you gave some dirtbag your money! If it wasn’t theirs to sell in the first place you are screwed!

    If the investigators are saying the questionnaire was not received. Email them the receipt that the questionnaire was sent. Call the investigator daily. Keep calling because the squeaky wheel gets the grease.

    Google says some states don't require titles just bill of sale if the vehicles 15 years old or 20 years old. Like georgia or maine. Not sure what they will need or not but worth looking into at this point.

    No the VLT stop is because the California DMV is still trying to, or can’t establish ownership. The refers to California transfer of ownership. Under California Law a complete chain of ownership is required and theoretically this was a dealer transfer. The dealer was required to complete the dealer assignment section and they didn’t. Acceptable Evidence of Ownership When a Title Was not Issued-The following must be submitted: A REG 256 from the applicant stating the vehicle is free and clear of any liens other than shown on the application and one of the following: Bill of sale or dealer invoice to the registered owner named on the out-of-state registration that shows no lien against the vehicle and indicates the vehicle was paid in full. The original or certified copy of a conditional sales contract that shows the same lien as shown on the REG 343 or which has been stamped/marked “paid” and countersigned or is cleared by a lien satisfied (a REG 166 is acceptable). Title from a different nonresident jurisdiction or a letter from the nontitle state verifying the title was surrendered to that state unless the out-of-state registration indicates the title was surrendered. Since none of the above is true - there is a prior lien presumably and the title is not clear- they cannot give you one. Get a lawyer and request a hearing.

    All roads lead to its never going to happen. A lawyer only takes money, drags it for years, they hope for an act of god to happen because there's absolutely no sure way to proceed while losing the retainer fee. Attorneys have no idea and want no part in being associated with this negatively publicized KZread example. There's no way to break even or profit from this. I've thought about every option, part it out, buy a donor for a vin, ship it out of country, invest in being a partner at a small dealer for plates, house fire insurance claim, or use it as a business logo advertisement parked out front of your Taco truck😂 Either way you have the saddest story. I recommend writing this into a number one smash hit country song titled 🎶 All The Things Gone Wrong and make sure there's a dog in the lyrics who runs away just to seal the deal. Oh, and the name of your Taco truck business is called Ripoffs 😁 🏁 🚘 ⛽ 🇨🇮

    Sorry if you already explained this and I just missed it, but is this one of those cases where the previous owner gave it to CNC on consignment, CNC never paid them, and the owner is still holding the registration? I understand CNC pulled that with a lot of people. Do you know who the previous owner was? If that is the case you need to talk to a lawyer and find out if you have any recourse at all. It seems that the original owner would still be the legal owner and CNC basically stole your money.

    That’s my understanding of what’s happened with CNC. There are similar stories with titles not necessarily being cleared to transfer as the original owner never agreed to part ways with the vehicle. Some folks mistakenly believe whoever holds the title or pink slip is the rightful owner. Definitely not true.

    Personally, I would have the vehicle towed to the shop of your choice and have them inspect the engine for damage from the overheat. If the engine is damaged in anyway, such as heads warped, etc. You need to part ways with the car. If that means selling it without a title/registration, that is not illegal as long as their was a notarized contract you and the buyer. It would just be sold for off road use only (track car). At least you will get a little money back. If you get it registered with the engine damaged then you are going to have WAY more than the car is worth x2 probably not to mention the other associated costs you have already have to pay for. If the engine is fine and you do get the paperwork, you can probably get away with keeping it at a huge LOSS, but if you like the car, then the loss does not matter at the end of the day. But at this point the financial loss based on mechanical work/parts needed would kill the idea for me.

    He can't sell the car because there's a big loan still on it and he doesn't have the title for it. The car stays in limbo until the DMV or CNC get the paperwork straightened out.

    @@georgespalding7640 the bank had to have seen proof that the car existed in the first place for a loan to ever have been generated. The bank had to know there was collateral to fall back to if the buyer did not pay the loan. Either way. Let's say you are right. My point still stands. That point being is that he has to figure out if the car is still viable to own based on its current mechanical condition. Since, he knows practically nothing about mechanics, he has to get a car to a shop for this to be determined.

Unless he wants to just give it to the bank and let them deal with it which they do not want to do. Once he stops making payments on the loan his credit is ruined because it's such a large loan and he still responsible for the payoff on the car which will go into a lawsuit against him.

    If your problem happened in state of Texas, this would have finished long long time ago , in Texas I personally experienced something similar but not as bad , the State immediately took action, less the 45 minutes at DMV, problem solved, actually they told me there wait 2 weeks, and I had it Cheers🍷

    Move out of California would be the best start. Go after there bond, which hiring an attorney will be the fastest and most efficient route/ with handling the bond.

    Have you considered retaining an attorney? Someone that is fluent in DMV & traffic/DUI stuff may be helpful. I know that it is more money, but you need to get this resolved.

    The weird thing, I've seen this with DMV myself, where if anything goes wrong, they just go 'radio silent.' I know this really sucks, but I think you have to go back to the DMV, over and over. Be a pest over there until they resolve this one way or another.

    It is frightening that in America there is no longer any registration of vehicles and that the customer receives all the paperwork. I live in Sweden. Here, when you buy a car from a car company, the car salesman makes sure that directly on his computer registers the car, insures the car with the insurance company the customer wants it registered. You thus drive directly from the car company with a legal car that is taxed, registered and insured. This was done when I bought a car in 2018 and this had already been done for several years back in Sweden. It is now 2022 and America is lagging behind in development in many areas, I hear and see. Matt, if you had lived in Sweden, you would never have had such problems buying a car. It is no wonder that several Americans are moving to Sweden.

    Make friends with a mechanic's shop. Store it in their high fenced yard. Have them file a mechanic's lien on the title. Then once they get the title through forclosing on their lien you buy the car from them for the cost of the repairs and their time and cost associated. A mechanic's lien will ultimately clear the title. Only threat would be if the person whose name is on the title shows up to get their car out of the impound and pays the mechanic's bill. Thus why you need the mechanic to be a friend. It might be an option.

    I live in California too. You have to speak to your state senators office or your state assembly persons office to speak to Steve Gordon who is the Director of the Department of Motor Vehicles in Sacramento. Please call those offices today and write a letter explaining the problems with CNC and trying to get a title to your car at the DMV and how the DMV has failed you. I know its extra work but speaking to my local representatives have helped me with probelms I had with state offices and federal offices. Those are the people that can help you with the DMV. That is part of their job description. Your federal House member or California Sentator can help you with a federal problem. I am sure once you speak to your state representatives this problem will be solved.

    Who was the previous owner. Perhaps you could get a notorized statement from him as to the transaction he made. If so, you may get past the crap CNC pulled with the title.

    Consider anything you receive or send online to the CA DMV (aside from a registration payment) to be useless. I sold two cars, filled out the online release of liability and submitted them. For two years, I received registration expiration notices and late notices from the DMV for one of the cars. So I guess the DMV works at 50%. It wasn’t until I sent a personal letter explaining that I no longer own the car in question, that the harassment ended. I think their online communication system is flawed, but if your correspondence reaches an actual human, they will act on it. The online system sucks but there are great people working there.

    Very sorry to hear this. If Ed Bolian can't help, I would reach out to one of the lemon law attorney firms. I doubt they can help you, but I suspect they'll know someone who can. You need someone who specializes in these types of matters. A generalist attorney is not going to cut it. Good luck.

    Get ahold of someone at the DMV that you can talk to and each time they can't help you ask for their supervisor. Eventually you will get to someone willing to get to the bottom of it. Then become a squeaky wheel. Get phone numbers for everyone you talk to an wear them out! Call them every day if you have to and tell them you are going to do that until you get satisfaction. If all else fails take them to court. File a suit for them failing to provide a duplicate title. They CAN be sued.

    This absolutely sucks! All options are expensive. Pay the owner to get the title so you are now paying double for a broken car that you have to pay to fix? Ugh. Send car back to prior owner who still hasn’t been paid and so still has title, and that still leaves you paying a loan for a car you don’t own? “Less” expensive “Ugh”. I agree with you not paying to fix it at this juncture, it’d be more money wasted on a car you don’t legally own. I also agree with others suggesting legal counsel to arbitrate between you, your bank, and the prior owner. I’m so sorry to see you continuing in this nightmare.

    There is a procedure in Calif that let’s you get a title by an abandoned vehicle lien statue. Goggle the statue and follow the procedure to file an abandoned vehicle lien, then follow the procedure to get an abandoned vehicle title

    He can’t title it in another state knowing there’s a lien on it. I don’t know every states laws but I’m pretty sure that’s going to be a problem. No false statements in writing, people, no car is worth it.

    This sucks but why do you need a title to fix it? Fix it yourself or tow it to a shop. In Georgia if the DMV isn't helpful you can get temp tag from tax and title department of the county Court. They should easily be able to issue a duplicate title. There is a case against CNC and you have your sale paperwork.

    Sorry to hear this is still going on but not surprised. I don’t think you will ever get a title to the car and I think the end will see you being without the car and dealing with the financial ramifications with your lender. Its a sad sad story and you sure got shafted.

    Form a llc and open your own independent dealership so you can run dealer plates. It's not going to be free but at least you can drive it and not pay additional taxes when you do get the title.

    Your vehicle buying and registering system in the USA is FUBAR. here in Ontario Canada when we take possession of the vehicle we get the title IN OUR NAME if bought from a dealer and if private? You go with the seller to the DOT to get it changed over. I recently bought a used motorcycle privately and it was with the understanding that if there was any issue with the transfer I'd be back and none too pleased. Taking possession of and paying for a vehicle without the registration is looney tunes......

    You need to hire a lawyer obviously that specializes car issues and registration. Title issues etc. if a lawyer went to court on your behalf the judge can issue an instruction to the DMV to register the car to your name once the judge has understood the issues. Get a lawyer- have him go to court and get a court order to register the car into your name.

    bascily , you should just give up on CA ( for now ) and register it , get title in Virginia ! you do not even need to go there ! get a title and registration THEN get one in CA this solution is SO easy , and it will work ! research it i read an article and many do it basically , you are just certifying it is NOT stolen ! ( and it is NOT so no worries !

    If you go to another state and try to say there is no prior lien on a vehicle when it can be established rather easily through public statement that you know that there is, what’s the outcome? Well one outcome is you lose any protection so called good faith statues might hold. Those have a reasonableness of prior warning or awareness element. If you become part of the fraud I don’t think it helps. There’s other possible outcomes worse than losing the car.

    @jack dale If he’d spoken to the prior owner and they’d reached an “understanding” then he’d have the title in his hands. That answer makes no sense. Valid transfer of title = agreement reached. From Virginia DMV: Title or registration card from your previous state of residence or a branch of the United States Armed Forces with your name appearing as owner, OR previous owner's out-of-state title signed over to you. NOTE: If you register a vehicle using an out-of-state registration card, the card must be in the owner's name and either unexpired or expired for less than twelve (12) months. You will only receive a Virginia registration card. You will not receive a Virginia title until you submit the out-of-state title to the Virginia DMV. He does not have a CA registration for this car in his name to attempt this transfer. He does not have a CA title in his name to transfer. He could only attempt to register in VA off a non VA registration if it is in his name and if he had that he wouldn’t have posted. Virginia also requires an address statement.

    All you need to do. Go to a registration service or reach out to me and I will do it for you. You need to get a title bond and get a new title. It's that simple.

    Buy a second Ferrari that has a blown engine and transmission and then sacrifice the car without a title. Offer the holder of the title 50 percent. Take a torch and cut it up for scrap. Part it out. All of those are bad options but they are options.

    why go to the DMV in person ? you could not get an answer over the phone? also isn't there a main office with a supervisor for this investigations team. I would assume a letter would have given you the same answer with out going out in the cold. I have followed your issue for over a year and feel your pain in many ways. I used to live in california so I know what a pain in the butt, the DMV can be but once you get over a certain level of staff, usually it is pretty good on answers. I would assume you are on the home stretch and you can get another title especially since you have the bill of sale. as for the coolant line. its an old car. The plastic and rubber on old cars fail. its a Ferrari, unless you severely over heated the car the motor should be fine. I would say good luck, but it will all work out. you just need patience and persistence.

    What a tough situation. You could torch your credit and stop making payments but then how to get another car? Wish you could get this resolved. you look stressed.

    With al the money involved with this car have you talked to a lawyer? You have waited 1 year too long. I am not familiar with your situation as this is the first video I watch, but I feel this is important enough for you to get a good lawyer involved. Sucks really, but being a nice guy wont get you anywhere. Good luck.

    I haven’t watched all of your posts but I watched a few, so if you’ve covered this, disregard. You mentioned that you’ve made all the payments….I’m assuming you financed it through a bank? In most cases the lender gets the title until you pay it off. So why hasn’t the lender pursued this title. Sounds like it’s the lender’s problem if the title isn’t available.
