It’s a common tactic for cops to flex their authority in an attempt to coerce a homeowner to grant them entry. This intimidation tactic weighs itself heavily on a citizens fear of arrest. Neither officer has a warrant, nor did they proclaim any reasonable suspicion that TT was inside the house.
In every warrantless entry into a person’s home there is a presumption that the entry is unreasonable. The burden to “overcome that presumption” is on the State. To do so, the State must fit the specific search into one several exceptions to the warrant requirement.
Each state can be different, so I will cover Colorado as it is the state I reside in. Be sure to look up the specific distinctions in your state.
The 3 main exceptions to the warrant requirement are consent, probable cause with exigent circumstances and emergencies that threaten the life and safety of another.
Consent is obvious, don't give it. DO NOT EVER OPEN YOUR DOOR! In fact, pretend to not be home. If they could have gotten a warrant, they would have, and if they do have one, they can slide it under the door, or elect to break it down.
As far as exigent circumstances, A warrantless entry into a person’s home to conduct a search is presumptively unreasonable unless both Probable cause and Exigent circumstances exist at the time of the search.
Some examples are a fleeing suspect, Destruction of evidence, a legitimate claim of emergency threatening the life or safety of another, or there is a threat to the life of the officer.
The officers are unable to fit this search into any of the above and instead prevent the door from being closed and then threaten the occupants with harassment by telling them that they will keep coming back at all different hours, despite the fact that the man they were looking for has never lived there and hadn’t visited for over 6 months. Remember that it is 1:30am.

But op was talking about her in this situation with the officers openly admitting to harassment and assault. Ps in most cases assault with a deadly weapon doesn't require the weapon to be used, just readily available.

    Conflict of interest or the cost may bankrupt the person. Plus cops love to retaliate. Then you have that judges often side with cops at a local level even if they are wrong. So you often have to fight multiple cases. Also if they have charges on him the lawyer needs to have those dismissed before the courts will do their job. Then you have to beat qualified immunity which is a challenge. Then if you win the county could decide not to pay out leave the victim with 4 years of legal expenses and no pay out. The courts have been paid to play for along time

    A corrupt attorney that is probably close buddies with the DA or is trying to get a job as a prosecutor. People need to remember, private Lawyers, DAs (prosecutors), Public Defenders and judges, a lot went to the same schools and frequent same events and have common acquaintances... always get many "second" opinions when it cones to criminal cases or suing the police.

    I think it’s worth noting that a police department doesn’t typically get to a certain level of corruption without the courts also being corrupt. That is the situation we are in, personally. Several lawyers told us that the county had no case, and did not follow policy, but the more we pushed… the more they retaliated. And they don’t just retaliate against us, they retaliate against the lawyer too. Ended up pleading guilty in a case where the cops had no evidence against my partner (because you can’t have evidence if someone is innocent), because the courts were so hostile. It’s all for the money. Our current lawyer suggests that as soon as my partner’s year long probation is up, that we move away from this county before we do anything else. Which, ya know… our house is here, so that blows. I’d rather fight than move, but I’ll take moving to fight over staying and not being able to fight, I guess.

    Unfortunately, the reality is there is no such thing as police harrassment. They can charge someone with a crime every day, provided it is an actual crime. When have you ever heard of police harassment? There was a man arrested 70 times for trespassing while at work. It was so bad, the owner put up cameras on behalf of the employee.

The supposed defense attorneys that are supposedly working to help defend our rights, only do it to get rich and they always tell their client to settle out of court, or drop the lawsuits so that means the cops always get away with it, the prosecutors can keep right on maliciously prosecuting and the only one who ever gets punished are the taxpayers.

    It is. You tell the cop they have been trespassed. And that if they don’t begin leaving your property you will both call other officers to arrest them. Then you call a department or precinct that ISNT them. My mother had an officer arrested for trespassing by a state trooper on our farm 😂. Said he was looking for poachers…. On private property.

    This happened to the neighbor of a buddy of mine. The guy got tired of the cop refusing to let him close the door and instead moved the baby gate into the threshold. Told the cop "if you gonna act like a baby, you get the baby gate." What a legend.

Anyone is allowed onto the curtilage of your property, which is anywhere that leads to an accessible entrance for purposes of establishing communication with those residing there. However, once a person is told to leave the property, if they refuse to do so, they are now in violation of trespassing. The problem is, who is going to enforce that when it's the cops doing the trespass?

    More likely, he knew the cops, prosecutor, and judges were all corrupt. He also knew the judges of this area would probably retaliate against him in every court case going forward where he was counsel. Lawyers put their career first over the interests of their clients.

    In my experience that is normal. Lawyers are often scared to get on the bad side of the police and it can be really hard to get a lawyer who will even take your case.

    Got stopped in Livonia, MI and I let em search cuz I was young, stupid, and didn't have anything in my car. Officer dbag proceeded to destroy my shift boot. Thank God he wasn't dumb enough to knock it outta gear cuz it'd have rolled back into his cruiser and that woulda been fun

    @Michael Smith The Colorado deal is a sham. There's a $10k cap, which means you can't get an attorney on contingency and it will cost you far more than that to get to a payable judgement. Worse yet, it still doesn't come out of the cop's pocket. It sounds good on the surface, but it's meaningless in reality. Perfect for politicians to crow about without upsetting the (major campaign donating) public employee unions.

    Once I was wronged by cops arresting me on false charges just because they "had" to bring me in after he cuffed me. I was in jail for 3 days until I went before a judge. She tossed the charges because there was no evidence. I was going through a divorce at the time and asked my attorney to start a case to press charges. He talked me out of it. Later when I was talking to his secretary she told me he was a former cop. So yeah, get a second opinion. Some attorneys don't want to go against the bad cops, because they are friends with many of them.

    We have a very heavy steel security screen door with a lockset and deadbolt that opens out, and a solid wood door that opens in. We are able to speak to anyone (and have) without providing easy access into the house, even if we open the interior wood door. The scenario in this video would never play out here.

    Right I'd know a cop try to grab my uncle outing his place like that, but my uncle is strong enough to broke loose and got his gun and shoot the cop at his leg. He okay. He got camera around his house and it automatic set to his attorney and to the police department as well.     Unless they find a "friendly judge" who will sign **anything** without cause, "If'n the boys want it they get it." No judge will issue a warrant on such evidence as 'he was there 6 months ago'. In 180+ days, "TT" could have overnighted on 180 different couches. IF the person they sought was such a danger to society? That door would be off the hinges, after flash-bangs were fired through windows front and back.

    Very good video. Been there, made them leave after they tried all their lies. Tried "exigent circumstance, fleeing felon", while I was standing right next to the officer. I offered my wrists, front or back, and pled my case, and they did the walk of shame. Thanks for the video!

More to the point, shooting an unlawful entrant in to your home is FAR from a slamdunk from the prosecution standpoint. Those cops were warned multiple times.     I am a white guy, driving home alone from a very long road trip, I pulled off the road to rest for 30 minutes or so because I was was starting to nod whilst driving, as soon as I fell asleep a cop was banging on my drivers window with a flashlight in my face. he proceeded to try to make some kind of case for intoxication because I was “foggy” after getting startled awake. I explained where I had driven from and did not feel safe driving so I stopped for a catnap. When I finally awoke all the way he gave up.. This was a long time ago and I definitely talked too much. I am smarter now

    I live in a 2nd story apartment. I've had police knock on my door before. There is a peep site in my door but it only shows someone standing directly in front of it. Twice the cops knocking on my door were standing off to the side so they could not be seen through the peephole. So I did not open my door. I loudly called out "who is it"! And they yelled back a name of who they were looking for. No one I knew or had ever heard of. Later I found out he was living next door to my apt. But I did not open my door to the officer. Couple of other times when a cop knocked on my door I ignored them. I live alone. I know there is no arrest warrants out on me. I mind my own business. I do not know any of my neighbors names. So no reason to have any cops at my door.

    I ignored some of these punks for 6 months straight in Britain. They just get more desperate. They went away eventually. I just let them knock, day and night. Psychopaths! They're just fucking crazy. It takes a lot of self control to stay cool, and not get nervous, upset, etc. Stay strong, and you'll beat these lunatics by doing nothing. Don't engage them.

    2 cops tried that on me with my wife filming and security cameras filming. As soon as he grabbed my wrist i pulled my arm back so he couldn’t yank me out of the house. I said you just assaulted me and for fear of my family safety you have 5 seconds to get off my property before I remove you! They were both fired after 6 months administrative leave.

    I've literally had to go to court against police corruption. It was 2016 in Illinois in peoria around 1am and im drunk and I have a Mexican friend with me and he's sober and is driving my car back to my house a cop pulls us over to inform us that my tags going to expire in 22days and he says he can smell alcohol so he makes my friend do the dui tests and a breathalyzer and he's comes up clean and they insist they think he's on somthing so they impound the car and take him to hospital where he was irate for being arrested sober and was saying he wanted a lawyer they ignored him and took him to the hospital for a drug test where the hospital staff told the cops you cant take peoples DNA against there will for no reason. So rather than let him go they take him to jail. We had to get a lawyer and plead not guilty as soon as we got a lawyer they dropped the case because they didn't have even have a reason to stop us in the first place they left the paper work blank. The lesson I learned as a white guy being forced into a court case with a minority friend is that cops prey on people they think are less likely to give them negative blow back so they go for young kids and minority ands poor people so that they can get them on abunch of small stuff to give the public a sense they're fighting crime while in reality they're trying to get dui arrests to get accommodations from mothers against drunk.driving to be moved up to sgt. Their are more bad cops than good just like there's more bad people than good. Fuck 12

    @@Glitch-Gremlin Most often the legal costs eat up all your life savings and after that you still gotta drop it for not being able to afford any further actions. Your only hope in such a case is a lawyer taking it pro bono or having a civil rights NGO covering your back.

    cop says they'll stay there all night and all hours. well, I call that harrassment and stalking. also, the guy simply trying to close the door and the police called it assault?!!? this needs to be investigated and the cops fired.
