Officer fired after drawing gun on Army lieutenant

Two Virginia police officers have been sued for allegedly drawing their guns on a uniformed Army officer during a traffic stop and spraying him with a substance in December. One officer was fired.

    Cops are like this. I called the cops when someone broke into my neighbors house and when the cop saw I was a kid he, the cop, threatened to kick down my front door if I ever called the cops again. I once had a cop give me a ticket for not wearing a seatbelt, even though I was wearing a seatbelt, because I, according to the cop: "shouldn't wear a jacket the same color as my seatbelt and waste [the police officers] time".

    That makes me proud to know that our troops are taught to act professional like that, even when the police didn’t show him any RESPECT when they should have. I wish the lieutenant the best I hope you get justice and compensated well. Along with a written apology read on television. Thank you lieutenant for protecting our country and people!

    Are you serious??? The lieutenant DID NOT ACT responsibly... He should have comply with authority get off the car, explain the location of the temporary tags and that would have been the end of it. The civil disobedience speech was out of line.

    @@alejandromarin4709 Army does not have higher authority over local police (except during martial law). Army Lieutenants, Captains, Colonel or even Generals MUST comply to the commands of a police Sergeant when in garrison.

    As a Veteran, former police officer, and current attorney, I am appalled at this type of behavior. Not only do our brothers and sisters in uniform deserve better treatment, but every citizen should be treated better than this.

    And the officer is scared if he stays in that he could have a weapon! In fact he should be more scared to stay in his car then to get out when the officer ask because if you are in the car they do not know what you got in there and can grab quick. He took soooo long to pull over like he was doing something then took long to put hands up and would not get out. I have seen criminals with gun on seat beside them or even in their lap that it only takes one second to grab and shoot. All he had to do was get out and comply then figure out rest later. Cops didn't always do thing the same with me or tell me I would just listen and do what they say. Figure out later he got maced for not listening you people say you want more mace and tazers to be used when people don't listen well there you go. He could have had a weapon in his vehicle he didn't know. I'm female and I have asked to get out before and I just stand beside my car and listen. I did not go to jail and I did not resist just complied. It might have set up antennas and red bells to the cop when he was driving sooooo long before stopping. But whatever the cause when a cop says to put your hands up and to get out you do it. I would feel more safe out then in the car. You know because they know anyone can have a weapons.

    4 months for a full investigation doesn't sound ridiculously long. If they fire someone too quicky, without investigating properly what happened, it is the fired cop who can start a law suit for being fired frivolously. It is a bit more complicated than just watching a 2 min. videoclip and then decide the same day. It has to stick, and it is better to take the time necessary to do just that.

    And _this_ comment I can agree with. What I can't stand is when ppl blame all officers for the few bad eggs. ONLY the bad eggs should be blamed. But no matter the case, as you pointed out, you should still handle yourself properly. It proves in the end you'll live and can seek justice against that officer later.

    You should know better...the army uniform does not put any military personnel on a position of privilege over regular citizens, when ordered to stop, you stop, when ordered to step out of the vehicle you do that.

    @Ba Doai Respectfully - whatever that is - it is not in the US. We need to deal with our own problems here, and under our own laws. This officer was a serious problem and it was not handled as far as some of us think it should have been. The officer should have been arrested for assault - under our laws. If you are asking for help in your country - be advised that contrary to what many people think - the US is not the global police force. We don't want to be pulled into every country to settle every incident. If you are looking for assistance on a national level - that is different. But you will need to ask for help through legal channels (I don't know what those are for you). I'd start by talking to the UN.

    He started recording with his phone with his calm demeanor after refusal to pull over in a timely manor. Then with a smug look, he was refusing to follow orders and resisting detainment. After he finally got sprayed out of his errogance, and joined the real world... he agreed his actions were not appropriate. Next day... "who wants to be a divisive millionaire and ruin a cops life that was doing his job?"

    @ The temp plates were not visible enough to see and run them. His tag was in the rear windshield which anyone that has an SUV knows the rear windshield has very dark tint. (In Virginia the tag must be in the license plate area with light.) Plus he traveled 1.5 miles to get to a lit up area with cops behind him, didn't turn his vehicle off, and still wouldn't comply AFTER getting to the well lit area & having pistol near his leg. He was more concerned with filming the cops and playing a victim than complying and going on with his day.

    mike ballard, how are they ruining America? I mean, I know how. They, like the Republicans, are taking corporate bribes all over the place and that’s who they serve, not their constituents. But if you think that kid should have been capped to death, cause he had a air freshener and ran on a warrant, you’re off you’re rocker. And as for that cop’s lame excuse that she “didn’t know her left from her right,” I’m sure the cops wouldn’t accept that from me if I ran over them and said “oops, I couldn’t tell the gas from the brake!” It’s time for criminal cops to be held accountable criminally and financially when they commit crimes.     A simple - Are you aware there’s no plates on your vehicle? Simple question, open discussion. Answer - WHAT?!? - no I am not! Reasonable explanation - someone stole it. It fell off. I just bought the car and my TAG IS TAPED IN THE WINDOW! Question - could you just show me proof of ownership, and your drivers licence? I did not see your tag with the tinted windows. Reasonable answer - of course Officer! I thought that might be a problem, but the insurance people told me to display it inside the window anyway, I will be getting regular plates tomorrow when the office (or whatever you do in the states) opens.     He refused to pull over in a timely manner, which auto-escalates the situation to a high risk. If you are scared of the dark, you are supposed to call 911 and inform the operator you are being pulled over and are searching for a safe stop.

    average police acadmy is 18-20 weeks. Avarage hairdresser school is 2-4 years. Cops in ALL other wastern countries have 2-4 years police acadmy giving them a college degree. I wonder how much can be fitted into 18-20 weeks compared to 2-4 years, so every time a cop is given additional traning after the fact proves they are absolute amateurs and do not understand what they are doing, begin to actually train cops, maybe look to europe and train them propperly for upto 4 YEARS before letting them loose on an unsupecting public

    As a Police Officer he should be knowledgeable that a soldier who respects his uniform would never get on the ground because he don't want his uniform to be dirtied thus degrading it. However, in the video the Police Officer is stupid in ordering a fellow man in uniform to get on the ground which is the last thing a uniformed personnel would do. So stupid that you can see on this video that the Police Officer doesn't even know the Rank and what branch of military service the soldier is serving.

    If you don't care about the hard facts, don't bother reading this. Not only was the Army Lieutenant in the wrong here, but also was Officer big mouth. Let me explain that it's always very important for law enforcement officers to keep their anger to themselves, whilst this anger is understandable whilst someone in a position of power is not complying with you whilst you are giving them reasonable commands. Whilst the Officer with the taser was in the wrong some of the time, he was also in the right most of the time, also was the Officer at the back window of the Tahoe with the firearm. Let me give you some back story; The Officer attempted a stop on the Army Lieutenant. The Army Lieutenant failed to pull over and proceeded to drive one mile to the closest gas station, in that time the Officer called the stop in as a pursuit, the Army Lieutenant stopped at this gas station, and this is when the Officers conducted what's called a Felony Stop, which is conducted after a pursuit, or on a person with warrants or a person has committed a significant crime. The Officers were within their rights to order the Lieutenant out of his vehicle, which is backed by the U.S. Supreme Court in case law Pennsylvania v. Mimms, 434 US 106 (1977) which states that a law enforcement officer ordering a person out of a vehicle following a traffic stop does not violate the 4th Amendment of the United States Constitution, meaning that the Officers were within their right to ask, order, and make the Army Lieutenant exit his vehicle. Why was the traffic stop conducted in the first place? The traffic stop was conducted due to the Lieutenant not having a correctly displayed license plate/tag. According to Virginia law, 46.2-712; "Every license plate shall display the registration number assigned to the motor vehicle, trailer, or semi-trailer and to the owner of thereof, the name of the Commonwealth, which may be abbreviated, and the year or the month and year, which may be abbreviated in the form of decals for which it is issued." The Army Lieutenant did not have a rear plate properly displayed, the plate that was displayed was not in the correct position and was also a piece of cardboard in the rear window. This gives the Officers probable cause to initiate a traffic stop on the vehicle.

    This guy should NEVER be allowed to have any other job in any way with law enforcement. He's a total disgrace and what he did to this lieutenant was racist (in every way) plus he's got some kind of power/control issue. This man does not represent law enforcement but us just a fat, out of control guy, holding a gun and threatening a man of color who is defending our country. I couldn't be happier to know that he lost his job. Serves him right !

    That's what happens if you don't train cops long enough. They are then completely overwhelmed with such simple situations and do stupid things. no German policeman would come up with the idea of pulling the gun or using pepper spray in such a triviality. Will be due to the fact that German police officers have to complete a 3 year training course before they are let loose on citizens. I've also never heard that a German police officer threatens another person i will kill you. American cops seem to be taught first that the one who pulls faster, the one who lives longer. in 2020, 1,030 people were shot dead by American police officers. 3 people were shot dead by police officers in Germany

    Congratulations on your recent retirement. I was in the Army 9 1/2 years and am a recently retired police officer after 24 years. When I was in the Army, I thought the same as you. All I got to say is Ft. Polk and you know if you've been there. LOL. This Lt. did everything right. I was disgusted by the older police officer actions.
