Noorjehan Safia Niaz on the rights of Indian Muslim Women - English IV

Noorjehan believes that a Muslim woman’s legal concerns cannot be seen in isolation: unless she is socially empowered she will not be able to address her legal concerns. She believes that Muslim women need to be organized, given an identity and a voice.
Towards this, Noorjehan founded the Bharatiya Muslim Mahila Andolan (BMMA) in 2007 as a national platform for Muslim women to present an alternative progressive voice that not only addresses their legal problems but also takes steps to ameliorate their social conditions. BMMA consolidated and built on the power of small women’s groups (Mahila Mandals, Nyaya Panchayats and SHGs) that emerged after the 2002 communal riots. The BMMA leverages such grassroots organizations and individuals to present a strong voice for Muslim women in India. Through this platform, Noorjehan constantly engages with Muslim women, enabling them to articulate their concerns, build negotiating power and assume a leadership role in their communities.
Over the last seven years, BMMA has grown to a network of around 30,000 individual members across 60 districts in 13 states. Women are organized at the village, taluk, district and state level.

    At 6:10, Ms.Niaz says that Hindu women have not demanded repeal of Hindu succession Act because it is a part of their identity. It is not true. My mother had to suffer discrimination at the hands of her brother during division of property. We Hindus don't want to be governed by Manusmriti. We want a NON RELIGIOUS family code, just like they have in Western democracies. I feel Hindus should not be made to suffer under Hindu succession act. The minorities can follow their theocratic laws, but please give us Hindus "azaadi" from the tyranny of so called Hindu laws. This is the 21st century AD, not BC. We want a secular and gender neutral family code which recognizes the rights of LGBT people also.

    The Quran says in 2/230: "And if he divorces her finally, she shall thereafter not be lawful unto him unless if she marries another man. If (by chance this marriage also breaks) and the present husband divorces her, there shall be no sin upon either of them (the first husband and the divorced wife) to remarry-provided that both of them think that they will be able to be within the bounds set by Allah: and these are the bounds of Allah which He makes clear unto people of innate knowledge." A man of even ordinary intelligence can glean from these verses a reprimand to the man, who is going to finally divorce his wife. In doing so, he is acknowledging the fact that she will henceforth be a free individual and can choose to engage herself and marry any man of his choice. The verse implies a warning that the conjugal and marital bonds will be cut asundered and the return will not be possible. At least not within foreseeable future, as she will be Halal, lawful for the first husband only if she gets married to another person, shares a conjugal relationship with him and gets divorced through the same elaborate process.
