#NOEXCUSES

I sat down with Karen Labelle to talk about the difference between separation and divorce in the eyes of the law. You’ll want to pay attention to this if you’re going through this process, especially if kids are involved. Don’t forget to comment with any legal questions you have and you may see it answered on the show!

Hello I have a question. I have been legally separated for five years. The ex wife and myself have two children aged 10 and 11. We have 50/50 custody of the children being one week with one and next week with the other. My problem is (the guy) cannot claim one of my children on my income tax. I have a court order saying I can but the government says I cannot as I pay child support. What they seem to realize is that she also pays child support to me. It is the difference in yearly salaries that there is an offset payout per month. Why can I not claim one child on my taxes? Even a court order signed by a judge makes no difference!

There is a simple solution. Give my office a call and any one of my helpful assistants will gladly arrange a free consultation. Best, P.
