    Minor Correction: When explaining "the message from Nijisanji EN" I accidently said the other Nijisanji Livers (V-Tubers) were speaking on behalf of "Selen Tatsuki" but this was a mistaken statement, they were speaking on behalf of NIJISANJI on the topic of Selen Tatsuki.

    Just a small detail here but could be important depending on the amount of either sheer jackassery or not even giving a fluck, The mental health subject when you talked about the amount of money earned. Just me personally I would of Said For mental health Charity, I know it is a small thing but people could use your statement to mean that she earned money for her mental health break down, In fact I have seen first hand that people have twisted statements to suet here needs where something small that could be looked online to go oh that is what he/she meant instead is used to weaponize against the person. Now saying that I know that most people are not going to be stupid and just not look into it but the Niji stands out there will most likely act in the way to say see we told you so, Even though they have so much proof in this video to show otherwise.

    @@Chido_Agent since most of them do not have english as their native language and most of the music videos are released in japanese or a mixture of japanese and english, they are simply simulacra for the english-speaking audience, while their main goal is also to please the japanese audience, to be “friends” there .

    ​@@Pohdian No. Niji is in a current state of chaos because they have nothing to blame but themselves and are doing everything within their power to not admit it. The moment someone (e.g. Doki) does something to "fan the fire", this state of chaos will end and they'll find a common direction to blame for their problems.

    Let's just say I have been getting like below my mandotary 7-8 hours worth of sleep staying awake the last 4-5 days to watch the lives as a fellow Dragoon glad someone who is in the lawyer area is covering this.     It seems like they just never enough thought about the matter, and this is due to hiring at the management level favoring people with no experience: to some degree they deliberately selected for people who had no idea how to do business beyond "fake it". On the one side, I can understand a Japanese sub-company trying to save money being built with this in mind: the idea is that since the legal system prioritizes the good reputation of the company the courts will work to keep crimes quiet. This keeps the investors ignorant and happy. On the other... somewhere you'd think there would have to be somebody who knew ahead of time this was a bad idea.

    This whole debacle needs to be included in legal, PR, and business studies as a case study of what NOT to do. I'm genuinely astounded that every Nijisanji opens their mouths they make it worse. I'm just hoping against hope that something won't get worse than the racism allegations.

    What Doki is doing now is what she been doing as Selen between 2021-2022 at Nijisanji(tournaments and events across KZread,Twitch,Billibill) For whatever reasons Management and Legal got their panties in a knot and started to shut down her Tournament and Events MO of her cnannel thus her fustration and stress of loosing her main content Contrary to belief she corresponds with Management in Japanese as she Speaks Chinese,French,English, Korean and some Veiatnamese which is why she can join almost any team and is pretty popular on Billibilli because of it That document was sent in Japanese so that the 3 stooges got English Translations is a intentional criminal breech of a HR complaint in Japan as well as Canada via Labor Laws corncerning privacy when reporting Bullying to HR

    I think something important left out here is that a lot of this is about essentially maintaining keyfabe. The person behind a vtuber is not just anonymous, they are often entirely separate from the character. In agencies like nijisanji, the agency exerts a lot of control over the character, some times even more than the streamer. As such, they tend to tightly control what the streamer is and isn't allowed to do. The big vtuber agencies try to use this to create images based on "idol" culture, as seen in, for example, in kpop. These companies come from japan, where that culture is a lot stronger than in the english speaking world. While a lot of english vtubers are less idol-like (they like joking about it even), management especially at niji seems to favour the ones that are more in line with idol culture and are less cooperative towards the others. Another thing important in that context is that, in Idol culture, as you mentioned, there is a whole vocabulary in line with the keyfabe, including graduation as a way to put a positive spin on idols leaving a company, and breaking that keyfabe, such as by acknowledging even the existence of past members, is quite taboo. The reason all of this matters is because this cultural conflict has been at work here. Selen was very much not Idol-like, she initiated a lot of projects of her own without manager input (paying for them out of her own pocket even) and in the music video in question, the IPs that management said she infringed were of past members. She essentially broke a lot of the unwritten rules and was stonewalled because of that. And when the public took her side in this and it made the company look bad, then the other issues described here were brought in. I just wanted to throw in all of these culturally important pieces of context since it is all very fascinating from a sociological point of view. Thank you for the video

    Let me chime in for "mention" of former members (dm if you think this is obnoxious). From what I remember, the music video was technically prepared for more than 6 months and scheduled to be released in 25th December. In the meantime there are some active members who became former members because of various reasons. In essence, the group photo included Nina Kosaka and Mysta Rias. Which became the speculated reason niji took down the MV. PS. Other people, such as FalseEyed or Khyo, already mentioned that Niji management ghosted Selen's requests of permission.

    @@Masitu0031 It came to light thanks to the original author or "Last cup of coffee" that the project had in fact been in works for over a year. Lilipichu confirmed that she has granted & forwarded permission to cover her song in August 2022. Knowing that management had been send a formal permission from Lilipichu its not unreasonable to assume that management has been aware of the project since that time. To side with Management getting informed of the said project A day before its been finalized they would had to be not involved or actively ignoring the project being in the works. Not a great look, very bad PR

    The Keyfabe definitely applies to Agency v tubers but for the indie ones they are treated one and the same in terms of persona.

    One important detail is Nijisanji changed the release time of the video on Elira's channel specifically so it would overlap with Dokibird's first gaming stream, forcing her to stop and contact her lawyer only a few minutes in. (Plus, the game was Neopets, something management had repeatedly denied Selen permission to play.)

    As I wrote in chat, I believe that they put the salary for the general management/Lawyer position that low on purpose. They most likely know that nobody with any credibility would take such a low paying job and that it would make for a nice excuse to their shareholders, because by putting it on their website they can claim "Oh look we are actually doing something" while, once again, knowing nobody will apply for it. Good that it didn't play out as they hoped. Also, if we consider that Anycolor artificially inflated their stock value by doing a short-sighted buy back, subtract that amount and add it to the -20% they already have, their value per stock would be FAR below the 3000 Yen mark

    Thats about right for Manager Trainee,honestly, and about what you can get straight out of College with no work exerience I spent about a year as a Manager Trainee at way below minimum if you divide it over hours work before I realized I perffered Customer Service and ended up doing that for 20 years often refusing promotion into Management

    I don't think it's that well thought out. I think it's just a general trend of Nijisanji refusing to spend any more money than is literally necessary for the NijisanjiEN "branch" to function. They don't want this to happen again, but still don't want to spend anything more than the absolute bare minimum to ensure it doesn't. I expect that over time they'll start pulling back support for EN before cutting the "branch" entirely. That they're going to decide that salvaging the reputational damage is going to cost too much, continue putting blame on talents and claim the region is too toxic/unprofessional for Nijisanji to continue operations.

    The stock buybacks and artificially pumping their stocks is pretty obvious. Somehow it is legal in Japan or something. AnyColor stock movement is entirely artificial for my pleb take. Like their stock is pumping and going down together with Cover Corp for some reason. Maybe there is some sort of industry package type thing in JP market? It is very weird to see the comparison graph.

    Although VTubing is in some ways a new thing, I think it can also be seen as an evolution of vlogging or streaming with a webcam. The advantage is that the streamer doesn't have to spend time working on their personal presentation, they all look visually appealing and they can maintain anonymity. I think that's a big equalizer that allows talents to shine through their personalities and for some of them, even overcome physical limitations (though that doesn't mean they're all unattractive behind the scenes - a lot of those who have done face reveals are surprisingly attractive!).

    I agree with this. There are lots of people who might want to do streaming or just videos in general, but who are camera shy for one reason or another. VTubing levels the playing field. It's like amping up the basic idea of a 'username' to 11, adding not just a visual avatar, but also the rigging to allow much more expressiveness in facial expression and general body language.

    Well most already know the types of what people would do without showing their face. I think most common people concerns would come from simps and their attitude towards it. Mainly because theyll see them as animated e-girls and the fans are very weak incels with money to spend on them. If anything that would be the takeaway which definitely hurts the reputation. Because Vtubers just like many groups are a community/fellowship.

    Yeah I personally like this view on what vtubers are better than LMs, though I understand they are basically different sides of the same medal and this explanation is in my view more accurate for indie vtubers.     Just to follow up (a week late), I do think that idol culture and the "playing a character" (with their own lore) things are important components of VTubing that don't have much to do with vlogging or webcam streaming. These things also existed previously, but I do think VTubing is something new in bringing all of them together (even if many VTubers don't pay much attention to their lore and just act as their normal selves).

    I found Niji through Selene's T🐍S🐍B🐍 collab with Altare & Axel of Holostars. I was going through Niji livers and really enjoyed Doppio & Vantacrow. For now at least I can't support them because it supports Niji.

    Although I've been following VTubers for a while, Nijisanji always felt off to me and none of their livers really streamed around the same time as my free time. The Selen thing did hit me out of the blue. Thank you for 1, your coverage of this from a legal standpoint and 2, this summary that will help both "normies" as well as people who just don't follow Nijisanji.

    The saddest thing is the fans who are defending Nijisanji, when your suppose to be supporting the talents. Like why are you letting this slide, why are you not asking them to improve. Don't you want the talents to have a better deal, less red-tape, a work life balance that is stress free and allows them to stream everyday without wondering if they going to be stuck by the invisible hand of management, better rewarded, better cuts, better pay, treated with respect, and that talent get more projects and promotions. If your doing it for your Oshi? Tell Niji to treat them a lot better, and tell your Oshi if they leave Niji you will follow them. That is the best way to support them now, remind Niji, your only there for your Oshi.

    Brother, you're crushing it with the Niji coverage. I know you've mentioned finding this unfilled niche in the Vtuber sphere for competent legal coverage and I think you're a great fit. It really is a blossoming industry and as much as there are industry standards from an East Asian perspective so much of that is still up in the air for the West, as well as certain companies (cover/hololive) have shown a willingness to adapt to a standard more palatable to the West. I've caught some of your commentary on certain small changes that can be made to drastically improve the health of the industry and it all makes too much sense. Hopefully putting your voice out there will help talents both new and old with contract (re)negotiations to help keep themselves from being burned, as well as protect companies from themselves. It really is an industry of corporate speak illiterate anime fans getting taken for a ride. A long form video catered to talents on what to look for in a contract would do so much good. What specifically to look out for, what a bad contract looks like, what kinds of things are a must have, etc.

    It is really sad that the idol industry which I, for the lack of a more negative word, loathe, preys on online content creators too. Thank you for this video, this is to date the best compilation to show to my wider friend group on fb and so who, unsurprisingly, know nothing of vtubing. Glad you mentioned them even if briefly in the video. Unfortunately in that real life space too many attempts and this is not only in Japan but also to my best knowledge in at least Korea as well, perhaps other countries too but I choose not to look it up, have succeeded.

I have been seeing your other videos and streams that have been really long on this and I got lost right away so I'm like I hope he does a recap for those of us who have no idea what this topic is. I had planned just for the algorithm to go back and watch a bit skip around the video to trigger the algorithm and like each of those videos I will definitely do so. But I do have to poke slight fun of you because you said Cananadian instead of Canadian at 19:25 ish. Although since I'm not a Canadian maybe that is a phrase up there, eh.

    What I don't understand is: Have these people never read Machiavelli's "The Prince?" I haven't, but I understand the basic message of the piece: A beloved king is harder to depose than a hated one. Even if you are an utter bastard on the inside, the philosophy of enlightened self-interest will prevent this disaster and give better results in the indefinite term.

    The thing I can never get my head around was Niji's legal team supposedly sharing legal documents to their talents, when it was only supposed to be between Doki's lawyer and Niji's legal team. Correctly me if I'm wrong here, but the only thing that could have legally been shared to the talents, would be a summary. Nothing else.

    Someone else's take: ICSID is meant to be for investor-state relationships and has specific rules that are unusual in arbitration. It would probably be a better idea to either adapt some other form of arbitration (commercial, employment?) or to create your own thing. Thinking internationally, there are at least already rules in place for international commercial arbitrations as well as arbitration for specific sectors such as sports. But as someone who is familiar with this area, I would agree with Legal Mindset that making something specific for vtubing is better, although you may (almost definitely) run into enforcement issues.

    Really great seeing it all put together like this, even for someone who has been watching the videos and streams about it all. I think you understood this in the various livestreams covering this huge and massive mess, but it should be noted usually terminations are shared with the talent first. When the termination notice is posted, it is usually a very light on the details two to three paragraph summary, not a fully detailed three page document. It is mostly there so fans know the talent is leaving the company without a graduation stream, the socials and channel will be privated, and merch will be cancelled or refunded (outside of Nijisanji of course, who wants to milk as much money as they can out of the talents). By the industry standard, Nijisanji went well outside the norm even in the case of messy terminations.

    I am aiming to become a Vtuber myself. I want to entertain people, and I am trying to afford the pc with good statistics for streaming and have good graphics for playing games to make it happen. The whole Selen Drama doesn't scare me. I won't go for an agency like Nijisanji, and be independent. Still, In my opinion, what happened to Doki-Sempai (I refer to her as that as my senior with respect) is unforgivable. Turning a blind eye to bullying and only caring for profits over the wellbeing of an employee. I am glad Andrew is doing this. It helps people understand how Vtubers are like.

    Nijisanji wanting someone to speak 4 languages and translate for them and offering minimum wage is beyond hilarious. Its quite rare for people to speak more then 2 languages. Let alone 4, fluiently. And then they want tthat unicorn to basicly work for them for free. xD yeah I wonder how the owner became the worlds youngest billionaire :v

    Haiiiii, been loving your coverage of vtubing, I like how into the matter u get while remaining focused on the legal department. If I could recommend a relevant topic that is becoming more and more popular, maybe you should take a dive in the world of indie animation projects. As u said, content from Hollywood and other western branches have been taking a hard hard punch. From traditional media channels making more and more nostalgic bait series into live-action or companies deleting catalogues of animation off of their streaming platforms to - allegedly - deduce taxes, crowd-funded animation has really been taking a huuuuge momentum in popularity. Would you like to cover this trend in matters of how to protect your IPs, how much should or shouldn’t be bargained (?), how does legalities of projects like those work, and things like that? It would be super helpful and super fun to see u dive into these truly passion projects that have even surpassed the success of big media platforms.

    Thanks for the summary! I had heard the video of the other v-tubers essentially denouncing Dokibird but I didn't get the whole sharing of personal information problem, which you explained perfectly here. It does sound like there were mistakes and miscommunications on both sides, but this agency seems to be very predatory in their contracts and treatment of employees.

    i cant help thinking about this... the reason they wont approve the ex-liver in the last coffee video was it bcuz of nina & mysta joined vshojo, pomu was not remove from another liver's music video cuz she's not joinin any corp atm, only ex-liver nina & mysta while other ex-livers remain silent & never join any corp, so does this mean that niji also mad at them bt they cant do anything about it? correct me if im wrong for randomly saying this...

    I haven't seen all of your content on this issue, there is a lot (from you and others) and I have other things to do than just watch news on one issue. But I had a question pop into my head I know you may not be the best to ask as you aren't a Canadian lawer but here it is: Would the posts they made to Twitter / X on her behalf talking about her being in the hospital violate PIPEDA in any way? (I think maybe but probably not) And more importantly would the Termination Notice or any of the contents therein violate PIPEDA. Specifically as termination is a form of disciplinary action, and they spoke of (what they beleived to be) her intentions in it.

    I guess something new I understood would be the timeframe. I thought at least one of the attempts was months prior to the release of the video that was meant to be a parting farewell to the community. As in after the attempt it was made clear she wanted to resign or 'graduate' with as little drama as possible. The video that was long since in the making being the final project before Dokibird leaves the character of Selen behind. It's a little morbid to think that the rejection of the video was the final straw for her, and the company was insensitive enough to immediately fire her after ignoring her legal teams request for her to formally resign without breach of contract thanks to the very real harassment and bullying that pushed her into that corner. Despite that though, the company kept dragging out, what should have been a private dealing, into the public and continuously slander her. The very serious accusations Nijisanji kept putting in the public view for some reason intentionally stoking the flames of drama and intrigue which only further reflected poorly on their unprofessionalism. In my opinion, this case will eventually reach the courtrooms. Whether or not as the focal point, the company's actions show a habitual disregard for the well being of their employees. If not now, someday another victim will be pushed far enough to seek legal legislation and will definitely cite this incident as well as others as clear precedent and as legal basis for a class action lawsuit seeking financial and punitive damages for corporate misbehavior and mismanagement as well as a few other very serious allegations.

    This sounds like to me Nijisanji will be found guilty but not recieve company endangering legal consiquence. But the litigation and bad PR will create devestating reputational damage which be followed by significant correction to thier business model. Maybe have several people fired.

    Selen's not the only ex-Niji employee who's complained about the company, I can think of at least 4 others who have made similar comments about how bad it is over there. As for the other companies, the only other ones that I've heard about bad working conditions are basically defunct now.

    Nice video to summarize but Ill make it a bit more clearer. Though its long. Sorry. Vtubers (virtual youtubers) are animated idols. Idols being singers and personalities like musicians and actors named throughout Asia. They have concerts but also play games and react to content, do art and chat and do all sorts of things like any content creator does on any platform. The motion capture only does so much for 2D so you seem them sway or may twitch (not trying to pun) a bit. But for the most part they're humor is what draws fans entirely and how they interact with them on several topics. The times when they go 3D is based on whether or not they perform or whether an agency does it after a year or so. It depends on what the agreements are. 3D is theyre avatar freely moving and having a setting. Used on special occasions from them. Many Vtubers are anime fans and working with Japanese companies may have seen cool to them but the laws have been very weird for their contracts. Instead of youtubers like Yellowflash and TUG having avatars made and being the faces of their channel, if they were to be selected by agencies in Japan and models were made after they sign to them and were pushed out, the corporation would not only own their avatar but their channel name as well. The Avatars to the companies are treated as mascots and the image is owned by them. Agencies like Hololive and Nijisanji (topic here) are the 2 most popular. Hololive has been what Disney used to be seen as and where Universal has taken the crown. Nijisanji however is like how Disney is now but more so Warner Bros and Viacom has been in a way. The good news is not every agency owns the avatars like VShojo for example. Silvervale was indie at first then signed with them and left. Everything was still intact and she was treated like a contract artist instead of a "puppeteer." Where Hololive usually would have concerts at cons and venues at times, Nijisanji would only use certain talents to do so. Not everyone performs. They have Units. Which are done by waves which is a group of Vtubers under one window. Released on certain dates near the same time. Selen's group never performed at a concert let alone never had their 3D debut even though the Unit before did last Spring. Selen/Doki wasn't much of a singer but tried her best anyway. But to many she was ignored and rejected for many things she tried to do. Her biggest activity was gaming. Which she was very great at. So when opportunities got rejected it was frustrating for her to really get what she wanted out there. It was as if the Corp didn't care for her and not want her to be creative. No one wants to come to any of these conclusions nor were we trying to but it didn't make sense especially since the fact that Selen was the biggest female NijisanjiEN vtuber if not biggest female Vtuber at the company entirely. She had near 800K subs before her termination. Nevertheless shes experienced some crazy situations. But its been 2-3 months since November where fans were asking about her whereabouts and the company gave no response. Which is a problem even for members who had their money instantly going to the channel. Of course they got refunds but it was important to see if she was well and she wasn't. It was a huge shock for many and even certain tweets was dome by management at the company. Selen's last stream was in Dec and many didn't realize it would be. Luckily she's back but oddly there are some people who are way more concerned about the avatar than the person. Also who side with Nijisanji or other agencies which is really ridiculous. So the nonsense continued a lot more when other Vtubers from the company wanted to speak badly of her because of the case and that they were being doxxed. When she found out about the video they made she had to end her stream swiftly and contact her lawyer

    Ive been watching vtubers since well before niji en has been a thing. I had actually wanted to join holostars and then niji en when they started that but im glad i never did. Selen easily became my new oshi when she debuted. And even when i stepped away from the vtubing community for the most part i still kept up with her. And this hapoening broke my heart. But im glad she made it through and is finally free. I really dont want to support niji after this but i still want to support some of their en livers. Especially rosemi, petra, and finana. Im torn about elira. I dont fully blame her, as i kinda feel like that video was "forced." of course i dont know but thats just my opinion. But i hate that niji doesnt support their livers and i cant supoort that. It was really interesting keeping up with this case from your live streams, false, asmongold, and everyone else. Alot of good opinions brought up. So thank you. I hope the other livers, if theyre wanting to leave can leave.

    I honestly wonder this, could Anycolor be in serious regulatory issue with how their buyback blunder wiping out 20% of their stock value. In turn could this also be seen as them blowing smoke up their investor's rear ends by promising higher returns via their inflated stock price.

    12:00 We don't know specifically what Selen's lawyer wanted from Niji, what they were arguing about. It could be that compensation wasn't even on the table, I suspect she only wanted out of her contract with a nice graduation instead of getting terminated.

    This really needs official (competent) Japanese translated subtitles so that they can get in on this as well. Many JP fans of Niji tend to ignore or are just completely ignorant of what is happening on the EN side of their companies favorite Vtubers. So they don't often know what is going on and think that the issues are overblown/overreacting. Though it is nice that lately there have been some coverage in Japan from some smaller content creators and sites, but it's still not well known it seems....
