    Not really elder abuse. She took out a loan without knowing the terms. She is at fault, and her age has nothing to do with it. If you can’t afford a house then downsize instead of taking loans for property taxes.

    Agreed, and since this lady purchased her property decades ago, her annual property tax would have only been a few hundred per year. Waiving such a small bill every year for people that have owned their home for many decades would cost the city almost nothing.

    @@obijuankenobi420 - I bought my home in 2013 in Oakland. California Prop 13 limits increase to a maximum of 2% per year regardless of inflation. This means that as the years go by, paying property tax becomes easier. That was the goal of Prop 13. (source: www.boe.ca.gov/proptaxes/pdf/pub29.pdf)

    That foreclosure auction needs to be quashed. People who prey on the elderly need to pay stiff penalties for doing so. Just disgusting people in my eyes. Not to mention that she should have had her property taxes capped at a certain age.

    Never use your primary home as collateral or take out a second mortgage. Seen this happen to many people. Those lenders, repos, attorneys, new buyers are all in it together. They goal is not lending and making interest and fees on the loan, the goal was getting your house for cheap.

    These stories happen all the time, the one I saw few months ago same scenario. Elderly woman needed a large amount of cash, the realtor prepared documents to give her the lump sum, but she thought she agreed to using house as collateral, but she was agreeing to sell him her friggin house! It was nuts..and she realized her mistake after the fact. But nothing she could do cuz she wasn't sick when she signed and she had the documents she even said she read them. It was sad....but legal. Elderly people need to wake up, and utilize their relatives and relatives need to stay involved in their daily lives! To help them, read their mail, answer their phones and doorbells. It's nuts. She crying and it was terrible to watch. I just hope when I get this age I'm not too stubborn or that I make sure my son's handle the heavy financials for me. Anything that involves the big things, use free legal service for elderly or a relative

    This is legal, she CHOSE to put her house up as collateral for a small loan...which is stupid. Her condo is worth over $1M. Had she gone to a bank, or contacted the County Assessor's office and worked out a plan other than with some stranger knocking on her door she'd not be in this situation.

    yes and no, she should've sold but at the end of the day she was fully capable of reading the fine print. Yes its sad but she's coherent, if she was unable to put words together id say she was taken advantage of other wise she made her choice of pulling a loan out. She shouldve been renting and sold the house though like you said, also she messed up by the joint owner ship agreement, clearly couldnt afford it if she needed a cosigner and that's a no no.

    As of last year in Virginia, creditors are prohibited from foreclosure if the amount of their lien is less than $25,000 and it is the owners primary residence. The lien will be paid off once the home is sold or through wage garnishment. A similar law needs to pass in California to protect vulnerable and elderly residents from these scams.

    It may be legal to put an 81 year old woman on the street by getting her to sign a loan using her house as collateral, but it's also flat evil. The person who bought the home for pennies on the dollar, then told her to get out in 3 days, has no conscience whatsoever. Hopefully this story will garner enough attention that people will reach out to help her, like her lawyer did.

    They can’t. Maybe the papers were filed 27 days earlier and she wasn’t told but maybe they didn’t file any papers and just asked her to be out. When she doesn’t leave nicely then they file the papers so it’ll probably be a month or whatever the legal timeline is

    3 days if you can prove to a judge they're doing harm to the property. 30 days is standard. For squatting scammers they like to argue that they've already paid rent and that may take up to 90 days to take them to court in that case they simply wait out until 90 days and then move and skip court so they never are evicted because they vacate.

    @@internallyinteral - she does not pay $13,000 per year in property tax. I bought my home in 2013 in an A-class neighborhood (I am a tech worker) and pay less than that on my house. If she bought her home 25 years ago then her property tax was under $1000 per year, and because of Prop 13 her tax increased 2% per year every year, or $1608 after 25 years. She can AirBnb her home for 16 days at $100 per day and make $1600. Of course she will need to find a cheap AirBnb to rent herself in Tracy or Vallejo, but still, it's only 16 days each year.

    This happens all the time to that age group. Saw one few months ago this elderly woman, house paid off, she needed cash for something, the realtor drew up documents and gave her the lump sum, she signed documents and later got notice to vacate. She literally sold realtor her home for the lump sum he gave her! Literally. The documents were all valid, she was aware of what she was doing, she said she read the documents and needed the money. She was around same age or little older. At a certain age, we become prey. No one should make big decisions Abt finances and the roof over their heads. Go to family members or most cities provide free legal service for elderly. It's insane

    She did this to herself. The condo is worth over $1M. Unless she still owed on the condo after living there 30 years she should have had it paid off and some major equity in the condo to take out a legitimate loan, reverse mortgage or HELOC. But, she chose to trust someone that was knocking on her front door.

    Yep she's screwed. Her only chance to void the contract is to prove she signed the contract under duress or that she was defrauded through misleading statements. Merely being ignorant or careless won't cut it. It's a very high bar, as it should be. How would you feel if you signed a contract with someone and they could back out of it after the fact because they changed their mind??? What if YOU bought a house and the seller came back after a few months and took it back from you?

    The new owner & lender/bank picked an easy target. An old, sick woman with a nice property. They’re probably stressing her out as much as they can so she can easily die & take over the property & avoid any court hearing/procedures. Such a greedy heartless world we are living in right now. I hope justice would still be in her favor. Our senior elders deserve to retire stress-free.

    If anyone in California knows an older person going through this, The state of california actually has a program aimed to help senior citizens . It’s called property tax postponement and it works by allowing seniors (62 and older) to defer their property taxes by placing a lien on the property with 7% interest up until the property is sold, the homeowner dies, the homeowner no longer qualifies or no longer owns the property. The state then covers everything. To qualify a person has to make $35,500 or less annually and fill out a form to apply.

It’s a huge step in the right direction for California. If her heirs or family want it so badly they can help the older person pay the property taxes until they pass away.

    I hope the court steps in. With a little time she could probably raise 13k with a Gofundme, but that company clearly deceived her and didn't make clear the consequences of her loan. They shouldn't be able to take a lien like that. I guess her mortgage was paid off so there was no other lender standing ahead of them? Anyway it is wrong. She should at minimum have time to see the property for fair market value to pay off the 13K and then if she had to move to Arizona or somewhere a lot cheaper she could use the proceeds. There are even programs for seniors who can't pay property tax and I think the state is prohibited from foreclosing for that reason after another case that was unconscionable where they took a man's condo and sold it over a few thousand dollars. They need people who can reach out to seniors in these circumstances and direct them to non-exploitative programs.

    Agreed. Virginia passed a law last year prohibiting foreclosure action on a debtors primary residence if the lien amount is < $25,000. Had she lived in VA, the court could not force the sale. The creditor would have to wait until she died and the estate would pay off the lien once the home is sold.

    Not this story again! The news conveniently omitted the fact that this lady reverse mortgaged this condo 20 years ago for more than $500K and her equity dried up. The house was put on auction but took so long to sell due to the debt and nonprofits cannot help because its not just the $12000 property tax but the hundreds of thousands of dollars worth of debt, and that she has no equity in the house left. Go read the article on this case. It is sad that it came to this but this home no longer belongs to her because she used up the value of the home for decades. she should have sold the home or found other means to support her living. Shame on the news to petal this for viewership.

    That's exactly what property taxes are for: so you never really own 'your' property. The claim that taxes are for paying for schools etc., is all nonsense. Such things can be paid for using sales taxes, state taxes, and other taxes.

    Selling a million-dollar property to someone else for only $13k is obviously unlawful, and was meant as a predatory practice to take advantage of the elderly woman. The lawful thing would simply be to put a $13k lien on her property, which would guarantee they'd get their money.

    True, but this has happened so many times across the country. I read an article years ago about a retired teacher that lived in a town of New Jersey andher home was actually paid off, but she could not afford the property taxes and she had to move. So sad.

    That's a huge problem in the USA. Property taxes. You work all your life to pay off your home and then the property taxes skyrocket. I'm retired on disability. My house taxes were $8,000 this year. That's the first four months of my retirement income just to pay the taxes. I eat a lot of soup. Toast, toasted cheese sandwiches, peanut butter sandwiches and anything cheap.

    Trust me... the City of SF does not send notices as they claim they do. I have it in writing from the Assessors Office that states, notices are a courtesy and it is the responsibility of the property owner to know due date(s). It's possible this lady did not receive prior notices and being 81, probably forgot they were due.

    Quality of school, public service has decreased dramatically but property taxes increased so there is no positive results in increased taxes the only results is poverty of homeowners and renters too because cost of property tax included in rental price

    I am curious...was she not making payments on the loan? And, before the property even gets to a foreclosure point, she would have to be at least 3 or more months in arrears. The lender would have/should have been sending her notices regarding that so what was really going on here? Were the notices being diverted? Not sent? Something just sounds weird here...I really want to know how this happened!

    In CA you can avoid paying property taxes for 5 years before they take your home. Instead of taking out a high interest loan she should have simply not paid the property taxes for 5 years... she probably would have died by then anyway.

    So we can pay millions to keep drug addicts high in the Tenderloin, but we have no real Housing protections in place for the elderly? Should 81 year olds still be paying property taxes, do they even have the ability on their social security incomes? Should she at the age of 81 be forced to relocate away from where she spent her entire life because it’s “more affordable?” What about the emotional trauma the elderly go through being kicked out of their lifelong homes just so they can afford to live out their remaining years and die, somewhere completely unknown to them, with a roof over their heads? What a sick, cannibalistic society this has become, Americans are literally one step away from sacrificing themselves entirely for their never ending greed for money.

    Well, this is a mess. She doesn’t even have to pay property taxes to the county if she lives on Social Security benefits at the age of over 65 years old. Her annual income has to be under $25,000.00 for property tax exemption and she has to apply property tax exemption every year for qualifying this program. This is the county law, not rule. Have doubt? Please go to SF CITY HALL for more details.

    Where did you hear that BS. I am 87, retired for over 20 years and still pay Property Taxes. This woman would have to save $750 dollars a month to pay a yearly $9,000.00 taxes. I bet $750.00 from SS a month Social Security would leave her if lucky around $150.00 a month to live on. In La really?     I'm a realtor. Her first course of action is with the court to find out how the deed was transferred by the loan. Then you file a lawsuit with NAR against the loan officer/buyer agent if that and see what the paperwork says. If she was not qualified or notorized to be sure that this small loan could end her ownership, then it is a predatory loan and can be fought in court. This is a story put together to make people angry about what people do to old people. This woman has a 100 percent chance of winning in court, especially after a national piece on it.

Her house is valued at more than $1,000,000 and her home got repossessed because she could not pay a $9,000 loan. Ok... So how did she pay the property tax for 2022, and 2023? And how about 2024, 2025, 2026. Why not sell the house and cash out. Go leave with the children and pay them some rent.

    "We reached out to the attorney listed as representing the new buyer" is not enough. Name him! Any publicity is good publicity, right? Well, name him. We have the right to face our accusers. Surely there's public good and a public interest in knowing who all the players are. The media has to stop shielding people who are involved in public proceedings. It's no longer okay to use your discretion, it's time to do some straight damned reporting.

    When you say "...We have the right to face our accusers..." are you talking about the accuser or the lawyer of the accuser? I only ask because Hillary Clinton defended a 41 y/o child rapist (the victim was 12 y/o Kathy Shelton). She fought against this unwanted assignment by the judge, however she was overruled and ultimately defended the child rapist brilliantly winning a plea deal and greatly reduced sentence, as was her legal duty. (source - en.wikipedia.org/wiki/Kathy_Shelton). Lawyers have a legal and ethical duty to represent people they know are guilty. That is one reason why Hillary Clinton is considered a person or high moral and ethical character, as well as having a brilliant legal mind.

    This was never going to end well. She needed 9k to pay for property tax. A tax that needs to be paid yearly. She should have sold the property and gotten something cheaper and money in the bank.

    Her house is worth at least 10x the debt so it's absurd that this is happening. Definitely needs to be fixed right away. It's so God damn sad that you need the news to get attention to this, like there should already be people in the city who spot these things and stop them but instead you fill the city with a bunch of incompetent people and ruin society that way by not getting rid of them.

    10 x 13k = 130k. Her condo is approaching a million give or take. Plus, you have a naive view of how things work. Not that I don't agree with the sentiment. No one advised her well and she didn't seek it out, apparently. Property taxes, banks, etc. You can't afford to be in a fog about this shit.

    @Jeff Gorgon I agree with this but it's also not a regular person's job to learn this. Why does being a home owner make you obligated to be informed on tax law when nobody ever taught it to you? It's malicious to say people need to be aware of laws nobody informed them about and do this sudden repossession with no easy avenue to fix the problem. This really feels like people pulling a dirty trick to say an entire home is owed because a 13k debt is overdue and people who even try this with a straight face should be disbarred from doing business and thrown in jail to teach them that this type of BS is unacceptable.

    It does. She could have deferred her payment for up to 3 years or she could have gotten assistance from the state. She did neither. She took out a stupid loan and is now paying for it.
