@@sarthakbansal7929 that's the whole point brother. He is asking that how is he accused. On what basis? To be present in the court as an accused there needs to be either an FIR or a documented statement of any witness/accuser or documented evidence (which in this case has to be the paper about the crime). If none of the document is presented to the court, then no has been accused of anything. It's just an empty petition. Based on the memorandum 27 no one be considered an accused. So, IF HE IS NOT AN ACCUSED, HE CAN WEAR HIS UNIFORM.

And go to SC against the order of HC also, but if in any court you say I will complain against the HC judges.. for passing a wrong order.. , like seriously? Lower court is not stupid. He is a judge because of a reson. You cannot behave like you know everything and judge is fool. If he would have have behaved in Delhi HC, judge would have thrown his file on his face.

He must be a Law Graduate

I belong to a military background. He is not wearing uniform but his medals. He has earned it and they are allowed to wear it. Any personal retired or not, proudly wears it whenever they feel like and it’s commonly observed. He did him homework, and defended himself well. no doubt he is well read officer no matter who is right. I also truly believe, no one is god and even a judge is human being. Truth is above all and anyone should be challenged be it judge himself if need arise.

Can a Doctor go there wearing a stethoscope and apron then? He also earned it with his hard work and dedication..he also served people, some of them serve in the Army too. Athletes should also be allowed to wear their medals in court they won medals for their country. Everyone should be treated equally! Cricketers should come wearing pads and with trophies they won for their country. It's a court..people go there for justice and that's why there is a dress code so everyone can be treated equally not with uniform to get some privileges.

And whatcif the Supreme Court kicks the file back in technical grounds saying that prayer to recuse was not made on the apprehension that justice will not be served in the lower court given the contradictory remarks of the HC regarding the 4 docs. Here the accused has correctly articulated his reason for prayer to recuse . How that amounted to contempt only the judge can say

​@@Ureakmazino1998 Notwithstanding what the merits of the officiers argument, from whatever little I understood, the judge was pointing to the fact that the officer cannot dictate the judge what to do ( which I agree ), and the fact that he was wearing his uniform was to influence the judgement ( which is debatable ). Personally, i feel that the judge provided the Officer with a lot of liberties, anyone other than him, would have been booked for contempt.

It is everything for him and he wears it proudly , with head held high no matter on duty or off duty. As per Navy rules it is a choice for every service man in India retired or non retired can wear anytime they want provided, uniform is in good condition.

That is a no brainer mate - did they discuss the case in details - but there is no doubt on the manner in which he held himself and spoke - nowhere was he overly aggressive

This Naval Officer is the epitome of Confidence... he was respectful, held his ground with PRECISE FACTS BYHEART. I could picture the scene of Mahabharata - where Abhimanyu bravely on the basis TRUTH fought single handedly inside the chakravyuh.... clearly we were not happy to see how the State's lawyer(government lawyer) and the judge were treating him. I personally found it disappointing. Officer was Rock solid.

Mood of judge is the law of court

The Navy officer deserves all encouragement and the judge needs to know the law all from the beginning.

Why this Navy officer not getting any support, he is fighting it out with facts and is disciplined without any political garbage which the other lawyer is throwing

Better than most advocates and judges too. He possesses knowledge and most importantly common sense

He can come in uniform, he can bring his credibility along with him. Judge and Lawyer both have to be aware they are dealing with an educated National Defender.

If a Common man speaks 1/10th of what he spoke, there will be a contempt of court filed against him. P.S. Cross cutting the judge in between his sentence is not a good way to win the case in long run.

He is absolutely on law points. Dismissal order is just manifestation of power/ego.

The Navy Officer put out his case very beautifully while keeping his cool throughout 👍👏👏

Being an Advocate, I can say his legal knowledge is not sufficient to argue such matters, he is over confident and presenting wrong arguments before court even making his case worse. Even matter is premature before High Court.

The judge adjudicates over this case only to hear him and decide whether the district judge has passed the wrong order. Officer's commitment could amount to a contempt. But judge didn't take any action which itself is a very great respect. Why always humiliate judiciary over the grounds which you aren't even clear of.

Last year we visited Ramappa temple. While enjoying the beautiful temple and its premises, suddenly everybody was asked to leave because a district court Judge was coming. So the Judge came and spent around 1 hour in the temple with her security. We do have to agree the judges misuse their powers and it should be stopped.

Navy officer is absolutely right.If he is not confident to get justice in this court then he have choice to move his case where he found that he got justice.

There should be proper hearing of an accused. An officer of defence force defending his case, because he doesn't believe in advocate system. His insistence on truth should be upheld is laudable. May God bless him with justice 🎉🎉🎉

No matter he is accused or not, but he indeed out the points very rightly and judge should listen all points

He never said “your honour”. Judge would like “ye to dhoti khol raha hai” 😅

Ekdum sahi hai...this reflects the current status of Indian judicial system and its judges....a common man explaining a judge what to do and he has explained the scenario so well that the judge couldn't find any other way to escape but accept and agree to whatever the common man said in his own defense. Superbbbb

If an officer of a lower rank does not perform his duty, the court punishes the officer of a higher rank. In the current situation, if the lower court does not act properly, the higher court will be punished.

These courts are hand in glove with corruption. Justice for the common man is just a dream only people with deep pockets /political clout can get what ever they want.

The officer hired the lawyer for show... he defended self. From the arguments it feels like the judge's ego was hurt as the officer came to court wearing uniform.

Absolutely. There is no issue with that.

No wonder there are thousands of cases pending in our courts where the poor and innocent citizens have to suffer.These judges must be accountable for every action

Terms such as 'Your Lordship,' 'My Lord,' 'Milord,' and similar expressions should be prohibited in India. Such terminology is discriminatory. Judges are servants of the law, not deities. This is why India desperately needs judicial reforms. We require comprehensive Indian judicial services to curb the nepotism inherent in the present collegium system, which is unconstitutional.

Every common man should know law .law should be taught in the schools also as compulsory subjects .

This is how justice served by this one lakh plus salary judges.. No common sense

Trial court has salary of 1.15 lakhs. District judge 1.8 lakhs High court:- 2.2 lakhs Chief justice HC- 2.8 lakhs CJI- 3.5 lakhs

The judge shows his patience otherwise the Navy personnel would be facing criminal contempt. Those who are a part of the higher judiciary know this.

​@Vivek99118 of course they do. Only their sword is taken away and put on the table before the Court on a direction at right angles to the accused. If he is found guilty then the tip of the sword is placed pointing at the accused. If not guilty then it is placed with the tip pointing away from him. On announcement of the not guilty verdict he is allowed to put the sword back in its sheath.
