    @@sarthakbansal7929 that's the whole point brother. He is asking that how is he accused. On what basis? To be present in the court as an accused there needs to be either an FIR or a documented statement of any witness/accuser or documented evidence (which in this case has to be the paper about the crime). If none of the document is presented to the court, then no has been accused of anything. It's just an empty petition. Based on the memorandum 27 no one be considered an accused. So, IF HE IS NOT AN ACCUSED, HE CAN WEAR HIS UNIFORM.

    @@aryanprakash2710 bro, the lower court has passed an order, and you cannot argue, you can just request the court. And go to SC against the order of HC also, but if in any court you say I will complain against the HC judges.. for passing a wrong order.. , like seriously? Lower court is not stupid. He is a judge because of a reson. You cannot behave like you know everything and judge is fool. If he would have have behaved in Delhi HC, judge would have thrown his file on his face.

    And yet become 'bheegi billi' in front of the seniors! Does he even know what is the meaning of 'this court'? He was openly telling the judge that you can't do justice with my case. Is this a disciplined manner? If he had some issue with the court, he could have proceeded to CJ or the Registry and requested for a change in bench

    I belong to a military background. He is not wearing uniform but his medals. He has earned it and they are allowed to wear it. Any personal retired or not, proudly wears it whenever they feel like and it’s commonly observed. He did him homework, and defended himself well. no doubt he is well read officer no matter who is right. I also truly believe, no one is god and even a judge is human being. Truth is above all and anyone should be challenged be it judge himself if need arise.

    It takes a lot of courage to speak to a judge In an indian court the way this naval officer has spoken. He seems thoroughly prepared to present his case and is defending himself very well.     Can a Doctor go there wearing a stethoscope and apron then? He also earned it with his hard work and dedication..he also served people, some of them serve in the Army too. Athletes should also be allowed to wear their medals in court they won medals for their country. Everyone should be treated equally! Cricketers should come wearing pads and with trophies they won for their country. It's a court..people go there for justice and that's why there is a dress code so everyone can be treated equally not with uniform to get some privileges.

    asking the judge to recuse himself is like a MBA graduate going to the border and telling the army how to fight. completely lacking decorum. He can ask fo be referred to another bench or wait for order and take to Supreme Court.

    And whatcif the Supreme Court kicks the file back in technical grounds saying that prayer to recuse was not made on the apprehension that justice will not be served in the lower court given the contradictory remarks of the HC regarding the 4 docs. Here the accused has correctly articulated his reason for prayer to recuse . How that amounted to contempt only the judge can say

    There is a reason why he is a navy officer . His points and argument is so clear . A 10th grade will have enough common sense to understand that any navy officer can wear his uniform anywhere . This judge has not only insulted navy officer but his uniform and this nation . Army navy air force and similar defense staffs should be given highest respect .     ​@@Ureakmazino1998 Notwithstanding what the merits of the officiers argument, from whatever little I understood, the judge was pointing to the fact that the officer cannot dictate the judge what to do ( which I agree ), and the fact that he was wearing his uniform was to influence the judgement ( which is debatable ). Personally, i feel that the judge provided the Officer with a lot of liberties, anyone other than him, would have been booked for contempt.

    Not possible. 3-4 times bills were passed by multiple governments. NJAC was also passed. Judges reverted that. There cannot be any solution without India state using violent power.

    @@Ajaz0307 As per Indian constitution ultimate sovereignty is of the people of India. Government is 5 years representative of people of India. Currently judge is not accountable for any crimes or misbehavior or anti constitutional behaviour. Moreover they are not in perview of any audit. If not Government who else you think is more suitable to ensure sovereignty of Indian system. Give me one name of the democratic country where where judiciary is not answerable to sovereignty of people except India.

It is everything for him and he wears it proudly , with head held high no matter on duty or off duty. As per Navy rules it is a choice for every service man in India retired or non retired can wear anytime they want provided, uniform is in good condition.

    This Naval Officer is the epitome of Confidence... he was respectful, held his ground with PRECISE FACTS BYHEART. I could picture the scene of Mahabharata - where Abhimanyu bravely on the basis TRUTH fought single handedly inside the chakravyuh.... clearly we were not happy to see how the State's lawyer(government lawyer) and the judge were treating him. I personally found it disappointing. Officer was Rock solid.

    The judge adjudicates over this case only to hear him and decide whether the district judge has passed the wrong order. Officer's commitment could amount to a contempt. But judge didn't take any action which itself is a very great respect. Why always humiliate judiciary over the grounds which you aren't even clear of.

    Last year we visited Ramappa temple. While enjoying the beautiful temple and its premises, suddenly everybody was asked to leave because a district court Judge was coming. So the Judge came and spent around 1 hour in the temple with her security. We do have to agree the judges misuse their powers and it should be stopped.

    Trial court has salary of 1.15 lakhs. District judge 1.8 lakhs High court:- 2.2 lakhs Chief justice HC- 2.8 lakhs CJI- 3.5 lakhs

    I am Supreme Court & High court advocate. This soldier is correct. There should be an evidence or document against him ,without that how he is consider as an accused.?.?

    ​​@@riscnx Cancers destroy body. Indian Judges destroy people's lives. Cancers can be treated by Chemo. There is no chemo for judges. I used "Upamaa alankar". Indian judges are not persons but deamons causing perpetual pain by delivering consistent injustice.

    ​@Vivek99118 of course they do. Only their sword is taken away and put on the table before the Court on a direction at right angles to the accused. If he is found guilty then the tip of the sword is placed pointing at the accused. If not guilty then it is placed with the tip pointing away from him. On announcement of the not guilty verdict he is allowed to put the sword back in its sheath.
