I wonder if this ever wasn't the norm? It just strikes me that creative people who face intense competition are usually more prone to being abused (actors, artists, musicians, devs). I don't really know how the issue can be solved, but I guess not supporting these awful publishers and calling it out is a good start.

Yeah, it sucks because the game is fucked now. Even after the court case, the game would have been on the market for so long with 1 star reviews, it will never sell what it could have sold which means FrogWare loses a ton of money for the years of work they put in. They basically have to start over and make something new.

That’s a crying shame. The Sinking City is the best Lovecraftian adventure game I’ve played since Eternal Darkness: Sanity’s Requiem and just doesn’t deserve this. ☹️ Review bombing the game only hurts a great game and Frogwares’ reputation as makers of good adventure games. If you’re not happy with Big Ben and Nacon, don’t buy their products. It’s not like their controllers are any good to begin with... 😝

Well. It depends if they have the legal documentation to back that up as it is A Common Thing. There are many companies and industries where standard terms of business dictate that ANY creative properties an employee/subcontractor comes up with while under contract is owned by the contract holder. It doesn't even have to be related to the IP/project the contracted worker was originally hired to work on Sometimes you can legally skirt this by the grand old grey market loophole of keeping a Good Idea to yourself until after the contract is up, but if there is a paper trail suggesting you came up with the Good Idea while being paid by your former employer it creates legal havoc that can go ugly fast.

Just got confirmation that Nacon cashed the $5 cheque I wrote them back when this video came out. The memo on the check said "For Everything." Now, to use their logic against them, as I now own Nacon.

Trying to cover up crime with more crime. Outstanding move.

And they could block me from participating in the 'partner' program due to to much No Commentary gameplay. But that's easy convertable , i am smarter then KZread I can re-upload all my video's in multiple different ways just by using the same video's. Which allows KZread to earn more cash true but honestly i don't care. I don't need to earn MILLIONS , i would be happy to earn mere thousands while giving the rest up to KZread , IF they did a better job. But what can we do about it? The alternatives are crap compared to KZread. Bitchute has a limit unless you pay [like 4 playlists and about 20 vids] i got 3.000 D-Tube took away all my MILLIONS of ENERGY so that's a byebye. There's a reason why devs are starting to take the indie route or making more barebones deals with publishers, so shit like this doesn't happen to them. Though, in Frogwares' case, they did all of the right things except for signing to the right publishers.

Honestly - as bad as the situation is, it's still nice to see a development studio with teeth to them. They got robbed, they took the publisher to court and seemingly won. That ought to carry some weight.

Everything Nacon did and said in response to Frogware makes them seem incredibly petty. Almost as though they're trying everything in their power to try to spite Frogware.

I purchased my physical Xbox One version of the game from Gamestop for a measly $10 brand new about a year ago. Unfortunately, they only had one copy of the game and it was gutted. Mildly annoyed but, hey! Still good for $10.

The only reason why the biggest controversy is with the PC version on Steam is because the PC platform is the only one which would allow an easy way to modify a game to such a degree as to remove any mention of Frogware ever having anything to do with The Sinking City.

I'm picturing the end court scene of Boondock Saints... happy daydream of a nice resolution to this BS.

If I remember the previous lawsuits leveled at frogware and thrown out by the courts, the courts ruled that frogware owns the IP, and the other companies only licenced it for a share of the profits, in exchange for financial help. Also frogware and their legal team made public the financial statements provided to them, which I read over last year, and yes they are nonsense and incomplete. Hiding what the publisher took in, in sales and cash.

Frogware already sounds like a term for games held hostage by a publisher to screw over the developers.

I really like how Frogwares was using REAL evidence, stuff that makes sense even to a normal person who don't understand how it all works. Them being THIS open AND straightforward makes me wanna side them even more and not just seeing Nacon's shady practices

It's a janky game with some really high highs and extremely low lows. More memorable than most AAA games that come out nowadays for sure.

The fact this level of actual legit crime happens in broad daylight is proof on how screwed this industry is.

I made sure to report the page. I don't know if others joined and alerted Valve to this, or if Valve just took down the page while Nacon were front and centre with attention.

The box thing reminds me of how the game box for one Piece pirate warriors 3 doesnt list the developer, koei teemo, anywhere except in small print on the back buried along with other info which I always found odd

Thank u for covering this! I’ve been watching this unfold for years since I bought TSC at launch and am devastated for them. They didn’t deserve all this and it wasn’t gettin enough coverage for how boldly bb/nacon was doin all this

* sighs * And I was actually interested in buying the Sinking City in the coming days. Still am. Now I have to wait for it a lot longer. This has to be an open and shut case. There's no way it'd take months for the court to reach a conclusion in this case even with the pandemic going on. Also... the punishment should be harsher. 750k€? Try 2M and 10 years of jailtime considering just what sort of crimes Nacon has committed here. Frogwares deserves justice here and a way for them to survive this.

i think Nacon is playing the long game wich is letting the court delay as long as possible and with that frogware is going to bankruptcy as long the court is delay

The Switch version is self published I believe.

It isn't enough that these smaller AA Games are disappearing due to current game development budgets but then you have Publishers of such titles like Big Ben/Nacon pulling shit like this 😒

I believe the version on the Switch is self-published by Frogwares.

Think I'll give this game a try once Frogware regains control, just to support them.

Support the PlayStation 5 version since its self published by Frogwares themselves

Nacon play the victim with little to no proff Frogware PROVES that they're the victims.

Once Frogwares can prove the contract was violated, Nacon will probably face bankruptcy levels of charges.

Frogwares really deserves more recognition. Their games might not be the best, but they are always very unique, and do things with their source material that other games haven't done before. They are extremely respectful towards their source material, and also open and friendly with their fans, but get very little credit for the things they do.

Welcome to the game industry where every few weeks bad news and accidents happen.

The only publisher i can think of that doesnt treat their devs like cattle to be slaughtered is Devolver Digital. ...oh, and New Blood Interractive. .....that's it.

Man... I’ve heard some disgusting things in gaming news. This is up there with some of the worst.

For the racing genre fans, Nacon were responsible distributing WRC 4-9, and are currently holding onto the next Test Drive Unlimited sequel.

I mean, sales for this thing can't be high enough to warrant THIS much effort to steal it. It's a fair title, but not THAT good, certainly not good enough to risk the kind of payment losing this lawsuit would entail. And, I mean, the theft is fairly blatant. Nacon gonna lose.

Probably trying to set a precedent, to scare the other dev studios (with works under them) to comply to whatever they do. They have a ton of niche titles, the most popular being Warhammer Chaosbane and the most recent being Werewolf: The Apocalypse: Earthblood. And not all of the studios have emergency funds for expensive lawyers.

Looks like all this publishers agree to destroy Frogware.

I've been following this story for a while. It's upsetting that BBI/Nacon have been able to get away with this behavior. I hope Frogwares is able to resolve all of this and receive what is rightly owed to them.

The fact that a publishing company said "it's easy to play the victim" in their OFFICIAL STATEMENT is both extremely unprofessional and ironic. I hope they lose all their business over this and pay the studio even more money in court :)

So it seems Frogwares DMCA'd The Sinking City on Steam, and it has disappeared from Humble as well. Since most sites use Steam keys, even the sites that got missed will be unable to issue valid keys if the game isn't delisted by the sites themselves.

Support frogwares boys and girls. Let's get the sinking city once this is fixed 🙂

I miss the days when hearing about new video games made me excited. Talking with my friends about which one we’re going to buy so we can co-op together now it’s always just “New game... yeah ok I guess.”

Well that settles it, once this game is available from Frogware again, I'm buying it.

I've seen a lot of cases like this that ended up being the other way around. I'll take their word on it but I'm withholding judgment until after the trial ends and the evidence is made public.

@@user-tq8en6nv1k No denying about that. My point is both party needs each other. Brain=Developer & Body=Publisher. Without a brain a body is just a dead body and vice versa. I am supporting the developer is because without their creativity there would be no patches or DLC. IMHO

@@nekotranslates not always depends on how the contract is worded. Take halo for example bungie created it but how the contract was made Microsoft got to keep it when bungie left. However since this is in France maybe a bit different laws.

I hope Nacon and Big Ben publishings get sued into the ground successfully.

Honestly I'll be suprised the day some publishers DON'T try to screw over smaller developers.

Honestly how is it possible for this unknown publisher to get away with stuff like this? What can we as consumers and gamers do to punish them? Where are the responsible people for this company? When do we get their names and faces and journalists calling their phones asking for comments?? This needs more spotlight!
