Monk Solves the Mysterious Housekeeper Murder Case | Monk

Monk helps an old friend solve the case when her home is broken into and her housekeeper is murdered.
Episode recap from S4, Ep8 “Mr. Monk and Little Monk”: When the wealthy and attractive Sherry Judd comes to him for help, Monk has a flashback to when they were both in eighth grade and Sherry was framed by a bullying classmate. This time Sherry's house has been broken into, a painting of her great-grandmother defaced, and her housekeeper murdered.

Monk Synopsis: Adrian Monk (Emmy®-winner Tony Shalhoub) was once a rising star with the San Francisco Police Department, legendary for using unconventional means to solve the department's most baffling cases. But after the tragic and still-unsolved murder of his wife, Trudy, the devastated Monk becomes obsessive-compulsive. His psychological disorder has caused him to develop an abnormal fear of virtually everything: germs, heights, crowds... even milk. Monk's condition costs him his job, but he's back as a police consultant despite the unique challenges he encounters in his everyday life. These challenges lead Monk to hire a personal nurse, Sharona Fleming (Bitty Schram), who is always there to offer her assistance, even with the simplest of tasks (like organizing his sock drawer). Her less-than-subtle prodding keeps the "defective detective" on track in his investigations, as well as in his efforts to convince Captain Stottlemeyer (Ted Levine) to allow him to return to the force.
The Official Channel devoted to the brilliance of DI Adrian Monk; the defective San Franciscan detective, whose OCD is both a blessing and a curse. We'll be posting the very best moments from the show so, like Monk, you'll never miss a beat.

I think he could still be done for manslaughter. But regardless, it's still a life changing conviction. He'd probably lose his job and would be rejected from any future jobs where he was given any trust or authority. Not to mention the social ramifications, how many of his friends and family would stick by him after what he did? Also, aren't there other legal and bureaucratic consequences? Aren't convicts prevented from voting or owning a gun? He might not care about either of those, but still. And wouldn't he be locked out of a load of things because of the conviction? It would probably affect things like insurance and loans and other stuff.

Ok since most people in the comments don't know how the law works here is why her ex-husband was also charged with murder: felony murder doctrine n. a rule of criminal statutes that any death which occurs during the commission of a felony is first degree murder, and all participants in that felony or attempted felony can be charged with and found guilty of murder.

Here's where I'm hung up: In CA, for breaking and entering to be a felony there has to be an intent to steal or destroy property of a certain value. They weren't there to steal anything, they were there to damage a painting. If the painting isn't that valuable, then its destruction/damage could just be a misdemeanor level charge. CA would of course charge him anyway, but a good lawyer could probably negotiate something in his favor.

Why not help her to be part of work force again , or start a new business. Husband should be made responsible for paying alimony till she is back on her feet and take care of herself, and that should include tuition as well if she wants to go back to school specially if she has been a house wife all her life. but no, they just enjoy rest of their lives in vacation with their ex-husband money.

Felt kinda bad for the husband. He clearly only wanted to get out of paying his wife (in a way that would actually have made her happyas well ) but I think according to American law, he can be charged with murder as well? He deserves some punishment, but that seems overblown in my opinion.

I don't think he can be charged with murder at all. He hired two guys to break into a house and deface a painting. There's maybe vandalism, and involvement in a breaking and entering. He can also be fined for the property damage. But the murder is not on him. If I dig a well in my garden and somebody falls in and drowns, it's not murder.

I just had an epiphany… Sherry *DID* steal the Bake Sale money; here’s what happened Sherry was hard up for cash so she could keep her flower hair clip collection growing and knew that that bad boy kid was an easy mark… She put on the magic during the bake sale to get him to buy something with the money that he had surely obtained from various nerds… nerds like Monk, who she KNEW was low-key stalking her and she’d noticed him looking at her dial lock on several occasions… As I mentioned, getting that bully to buy something was the easy part and she knew that all she needed was for him to have a $5 bill at worst or a $10 bill at best… more likely he had a $5 given the early 70’s economy The bully gets charmed in to buying something and give her the $5, which she sleight-of-hand put under the “Good Luck” $5 that the principal gave as a nice encouraging gesture Slipping the marked $5 into his change was the easy part, but so was setting him up when he helped her carry the money box to her locker Sherry KNEW that he was going to try to steal the money, that’s obvious by the sleeveless denim vest… a vest he wears to mask the fact that his home life, it ain’t so good you see, but that’s not important here… just know that it ain’t so grand over at that boys home what with the screaming and the stuff being thrown all the time and the lack of a positive or supporting parental environment; he really could’ve used a friend, but instead he crossed paths with Sherry… 😔 Anyway, after he “stole” the money (she let him) she stole it back immediately after he rounded the corner. Sherry knew that he wasn’t so good with the remembering things what with the distress of his home life causing stunted learning patterns which affected his grades creating a downward spiral of low self esteem and crippled confidence, hence the sleeveless denim vest… and that he always left his lock on the last number of the combination so he didn’t have to worry about forgetting the first 2 numbers… she saw him “phantom spinning” the dial on several occasions as well as many others where he walked right up to his locker and pulled the padlock down right away to gain access… With the money box back in her possession, it was just a matter of tricking the affable Monk, who she KNEW had eyes for her and would absolutely give her the benefit of the doubt. All she had to do set her padlock to ~any~ number other than zero, which she did… though it took a little to resist the temptation to set it to zero as she usually did, she was still able to refrain She correctly assessed that the bully would never admit to initially stealing the money box because if he did then it wouldn’t matter what he said after since he would have already painted himself as being involved at all What the bully didn’t count on was having had the marked $5 bill slipped in with his change after making a legitimate purchase with his ill-gotten lunch money from the various nerds He’s still not innocent overall since he still torments nerds and *DID* in fact steal the money box, but these factors only served to make him the perfect patsy Remember that he’s not so good with the numbers, so he didn’t think to double-count his change… if he had then he MIGHT have had a chance to present a reason why he had that marked $5 bill. But he assumed that his change was correct, though even if he’d seen the $5 bill, odds are minimal that he tells Sherry that she gave him too much back on accident Poor kid didn’t have a chance against Sherry’s brilliance, and Monks bias’ were played against him like a fiddle 🙁 ------ Edit: oh, and to those wondering why she’d give Monk one of her precious flower clips as a thank you back in the day; it was an extremely inexpensive one that she had a spare of which is why she wore that particular one that day; she’d never miss it and it even if she wanted to get another backup of it, it was very cheap; like 15¢…

There was a case a few years ago where three teenage boys broke into someone’s house and the owner of the house shot and killed one in the boys. The other two boys were charged with felony murder even though they didn’t shoot anyone.

From a legal point of view, the 2 men murdering the housekeeper wasn't on the man who hired them. Sure, planning a breaking in and destruction of private property is still a crime, but he planned it on a day that no one should have been there. So he's only guilty of conspiracy, but the housekeepers death is on the 2 that broke in, not on him. A good lawyer could argue that he had every intent that the 2 who broke in was to flee if someone was home to prevent this outcome.

@@Ratharian They would look at the situation. In this case the man tasked two others to break into a house and created a situation that is known to escalate to violence. It would probably be some manslaughter charge. If the maid had killed one or both the men, he'd still be on the hook for their deaths. In your burger world scenario, it's unlikely someone would kill another human being over it. It's possible but it's far less likely. So if that person proceeds to escalate, at best it's really a civil suit that has a chance at success. The scenario would be more in line if you were told to take a bat and smash up the place but don't physically attack. In that situation the likelihood of a violent engagement shoots up.
