One of the foremost scholars of India’s constitution and its democracy says the first Modi government (2014-2019) is guilty of “killing the constitution by a thousand cuts” whilst the second Modi government has taken the process insidiously further in significant ways. Prof. Tarunabh Khaitan adds that many of India’s political parties and institutions have “sleep walked into (Modi’s) authoritarianism” whilst others “are complicit” in Modi’s undermining of democracy. He says many people “didn’t realize it was happening” whilst “huge swathes of constitutional machinery” were aware but let it happen.

    If you go through the economic conditions under Manmohan faced Sonia Govt and multi-billion dollars scams of that Government, you will certainly feel extremely comfortable of the Modi Government esp. Inhis 2nd term. You got to recollect the days India was shit scared of India, the weakened Indian military deprived of high tech hardware, the hazy foreign policy, the appeasement policy of the then Government when a particular was said to have first right on resources, missing terrorist blasts etc. etc.

    The Supreme Court should take the hard line against the BJP RSS executive. When the government is blatantly opposing the judiciary, the courts should come down heavily on the government in order to not let the executive repeat its arrogance

    This is a good interview. It has touched upon almost all areas afflicting the country. At present, there is a near threat to India's democracy. The dictatorial style of functioning of the government by misusing the investigating agencies, massive corruption vis a vis cronyism, undermining judiciary etc are only a few examples. The economy hasn't performed well, resulting in massive unemployment and poverty. Winning elections somehow has become the major agenda of this government. But, majority of the people are not bothered about all this. Religious polarisation is the main handiwork of the government to remain in power. But, the opposition has failed to stand up to the ruling regime. That is very unfortunate. India's image as a liberal democracy stands shattered. It is all despair.

    Khaitan ilks are just examples of democractic freedom to choose where he wants to live and thrive, and whatever subjective analyses they are capable of. Citizen laws are a must for any nation and proper governance. India is not a perfect democracy because we are not perfect people, educated, mature, to understand spiritually how to live, share and care. Again, Modi sarkar may not be the great example, but his intention to do good to all is well taken. People like Wire guys are always aggrieved because of change in game rules.

    When ratio of educated Indians were less in numbers or about 12 % nearing 1940s people opted for democracy, secularism, constitution and practiced it . But in 2014 education about 80% to present times democracy is being 1000 cuts and indian voters are sleeping and unlike French , Israel voters. Very unfortunate. We are untrained practitioners of democracy and moved everything for Supreme Court.

    Education is vastly different from ‘awareness’ and the eagerness to remain informed and to believe that one’s judgement of matters are relevant enough. I came across many highly educated who simply shrug their shoulders and proclaim ‘in which way my own individual opinion matters or makes a difference’. This is dangerous for democracy.

    Strongly agreed with all the observations made by Professor Khaitan except that Congress was responsible for Modi's rise and only regional parties are fighting Modi. Regional parties fight for their existence and don't want to lose their control. In fact, regional parties weakened the Congress in the fight against BJP by directly or indirectly supporting BJP. Congress is the only party fighting for the people much more than for themselves. Congress needs people's support and is the only party that can lead India to progress in a democratic and peaceful manner.

    It has taken ten years for Congress to wake up and realise they are fighting an existential battle for survival. In 2019, the same Congress party's counter to the BJP juggernaut was an utterly juvenile slogan "chowkidar chor hai" which needless to say failed to make a dent on the Teflon-coated Hindu Samrat. If Congress had been serious back then, they would have stopped bickering among themselves and instead put together their minds to come up with a counter strategy. Whether one agrees or not with RSS political philosophy, one has to give them credit for deep and long term strategic thinking - over the last few decades they have built what seems an impregnable & unassailable political fortress. This year, in my state of Karnataka, Congress proved they can fight BJP and its dog-whistle politics if they get down to the basics but the big question is, has Congress learnt its lessons or are they still going about like an ostrich with its head in the sands?

    @@anupsharma9442 To me Congress has been more a political movement that mobilised Indians than a political party as such. True, it carried everyone (barring a few) under the banner of freedom movement but it lacked a singular political ideology to hold it together; 'swarajya' as the rallying cry was good enough to suffice. Both to the right and left however we have had parties like RSS-Jan Sangh-BJP and the Communists who had a more sharply defined ideology and therefore a more committed cadre. Fortuitously, Congress had some stalwart leaders who were able to impart a forward-looking direction to the nascent nation after independence. In the ensuing ideological vacuum, in the late 60s and 70s, the party sadly became a reflection of one family, and after Nehru that family hadn't been blessed with a far looking visionary or even an ideologue. The party had been plodding along on its own momentum but lacked the spirit to drive it forward; it became a fractious coalition of various vested groups. Gandhi family was the glue that held the party together rather than leading it. Congress, no doubt, has a critical role to play but it needs to reenergize itself first with a clear-cut purpose. It did show a glimmer of hope in the recent elections in my state, Karnataka, by coalescing the disenfranchised people cutting across communal sectarianism. It did catch the aspiration of a rising middle-class between 2004 and 2009 but then its inner contradiction came to the fore and got swamped by a well-designed campaign by the BJP in 2014. It has no answer to a demagogue.

Since I was born closer to the time of Independence than you perhaps, I cherish the India I was brought up in. I will certainly mourn the demise of the democratic and secular India with its composite culture that shaped me. If that happens, I will blame the Congress for not fighting hard enough for the ideals the founding fathers had bequeathed the nation.

    * India was divided in 1947 to accede to the demand of Muslims of homeland (on the principle - they cannot exist with other religions and need 'land of the pure' - no other religion) and two Muslim countries were born - Pakistan and Bangladesh. Hindus thought they will have peace after giving 30% of the land to muslims who were only 16% at that time. Muslims had a better deal in partition. Many Muslims stayed back. But now they want all. They want to convert India into an Islamic state. Hindus feel cheated now. * 3 million lives (mostly Hindus & Sikhs) were lost because of partition of India. Jinnah and Muslims said they did not want to co-exist with others and wanted Pakistan (land of the pure). Just to remind look for Direct Action Day, Noakhali etc. * There are 57 muslim countries that follow Islamic laws, there is 1 country for Jews, there are 117 countries that lean Christian. Hindus have NONE. Why???? Even the President of USA takes oath on Bible and most Americans say it is built on Judeo-Christian values. Have you ever thought about or questioned it? Are YOU, Hindus INFERIOR to other religions????

    Democracy is more than just about the right to vote, which is how most Indians view it. It is about an attitude, an act of the spirit, a mindset, and a recognition of the state of being equal in status, opportunity, and rights. In that sense, India has NEVER been a democracy in its most essential sense - it's been a feudal state that masquerades as a democracy. The "raja and praja" attitude of pre-independence Indians has now become the "mai baap sarkar" attitude of Indians. In both cases, there is a recognition of a superior entity "ruling over" the inferior entity (which is why you always hear the phrase "the RULING party" in India). In a true democracy nobody "rules" over anybody - they administer and govern, and most importantly they SERVE. Try telling an Indian bureaucrat, official or politician that they are "public SERVANTS" and their angry/arrogant reaction will tell you how they view democracy. Anyways, even by these low and weak standards of government in India, where all governments have failed miserably in respecting and serving the citizenry, the BJPee has failed more miserably and spectacularly because they don't even "pretend" to be democratic like other governments. They are brazen about their autocracy and arrogance, and India may never recover from this wounding. As far as the Congress party is concerned, one can't expect it to succeed in opposing the tyranny of this government or gving India true democracy because in its own workings and functioning it is not democratic and revolves around one person, and its members accept this absurd reality, which is yet another display of the servile mentality that afflicts most Indians. Around the world we see and have seen examples of governments being toppled through sheer people power and protest, whereas in India we see a propensity among Indians to remain indifferent and not extend themselves. This is absolutely possible in a country or society where large numbers of people are illiterate, semi-literate, badly educated, ignorant, and shackled by centuries of religious dogma, superstition and a self-serving ethos. That other tyrant-posing-as-a-democrat Donald Trump used to loudly say "I love the poorly educated". That's exactly what the BJPee knows and thinks and exploits, even if they don't say it.

    Indians have not evolved for democracy. Still, more than fourty percent of the Gau patta is illiterate, which means they have zero political awareness. However, we progressed quite a bit in 65 years up to 2014 even though the Gau patta lags behind the south. With this government in power, there is so much crookedness exploiting the loopholes inside the constitution. For example, because of their IT cell and massive dissemination of misinformation, the other parties are forced to do the same in their capacity. These are all non-entity in mature democracies. This will put a thwart on the progress of India and I don't see India catching up with China in another hundred years, let alone the West. However, the more important thing is replacing the constitution with a Brahminical one scripted from Nagpur.

    You're quite right. And if you look deeper you will see that their authoritarian acts and measures eerily resemble the Nazi party's methods during their rise to power, using intimidation by the Brownshirts and whipping up anger and resentment among the marginalized and the poor Germans by using demagoguery and nationalism. Someone in their party is reading Nazi history and methodology and taking cues.

    Very well explained, and very alarming. Just on the point of why Indra Gandhi ended the emergency and declared elections, Ramachandra Guha has explained it well - after the 1971 war and creation of Bangladesh, she was a national hero. India was Indra in the eyes of the masses. The emergency made her into a hated villain, and she yearned for the popularity and support the she once enjoyed. Hence the rollback Seems to be a credible theory; happy to learn if there are other explanations.

    In spite of all that has happened during the last 10 years, I don't think common people attach too much of importance to the concept of India becoming a Hindu Rastra. I do not think that the theocratic states - currently prevailing worldwide - are doing better notwithstanding the example of Israel. We need to do an objective and scientific survey of the peoples' mind to come to know what they are actually thinking - are they economically well-off? do they enjoy more freedom now? are there more opportunities now than ever for improving the living standard? what are the new prospects opening up in front of common people? In-depth data collection across the length and breadth of India and analyses of the data would quite possibly throw the Hundutva agenda and the rhetoric of the ruling party out of the window. India is a confluence of many ideas, many communities, many different cultures. This diversity is the soul of India. This is the very essence of India. And India will prevail. But the opposition - especially Congress (as rightly pointed out by Prof. Khaitan) - needs to try for preserving the pluralism of India very very hard.

    @@jitkr1489 He does absolutely NOTHING for the poor. India still has the world's largest population of abjectly poor people (almost 300 million) and among the world's 10 lowest rankings in terms of GDP when measured in per capita terms, instead of the meaningless GDP in purchasing power parity terms they keep claiming as an achievement, and which incidentally would have happened even if another party was in power.
