The plaintiffs say they hired the defendant to do a house inspection for a home they were buying and he said it looked fine. Turns out the home’s roof was shot and the oil tank was rotted. They’re suing for what it will cost them to fix the problems. The defendant says he listed all the items, and they’re grasping at straws.

    My home inspector took pictures of everything...literally everything. He took more pictures than my wedding photographer. How does he not take pictures?

    mine took 4 photos. it's not uncommon. anything that means anything is in the actual report, even if it were contested in court photos aren't as important as the report itself.

    That’s why a lot of times purchasers will forgo the inspection process because they’ll end up paying anyway, I’m not saying that’s the best thing to do but because of this type of situation they feel that they could do better without

    My home inspection provided pictures of everything. These are major things he should inspect thoroughly. That’s what he is paid to do.

    I had one recently too (in UK) where they did take pictures of everything and went into great detail. It cost in dollars around $700 or so. There were options for a less detailed report for around the $350 amount that these plaintiffs paid, looks to me they went cheap on the report and it bit them in the arse.

    This inspector is worthless. Can't get his head around some lattice when the oil company has zero issues filling the tank? Doesn't even get on the roof to inspect it? Doesn't turn on the HVAC system to check it? He didn't say if he poked his head into the attic to check for any existing leaks but we can probably assume he didn't since he couldn't bother to push a button or two on a thermostat. No photo's included in the report? What did they pay for, him to come out, stand in the driveway and say "Yup, that's a house". That'll be $350.- thank you very much.

    they don't all do that, it's not unusual for an inspector to observe issues, not to climb under or crouch into something. These two morons don't want to take responsibility for a house they bought, something goes wrong & it's immediately someone else's screw up. they have some growing up to do.

    If they have oil they likely didn't have HVAC. Oil is for running the furnace that heats the house via duct work or radiators. If there was no oil in the tank, for whatever reason, no heat. Either way he stated the heat was not working on the day of his inspection. So they knew the heat was not working. They should have asked the seller to explain it.

    @@Anglynn74 isn't that what an inspector is for to observe the whole house and report any issues where ever they may be. Honestly, contractors should be the only inspectors people who actually build homes.

    @@nightshade1621 For just $350 they'd paid for just a very basic report. Nobody is climbing roofs and getting under tanks for $350. They obviously decided not to pay for a more in depth report, that cost them a few thousand in the end. The man earned his money.

    Apparently the lattice around the oil tank had some special star trek force field that repels inspectors but allows the oil company workers to view the tank. He was just going through the motions and with a contract that doesn't hold him accountable for anything he's thinking why bother.

    the oil company sometimes has keys to get into a locked shed or into a basement to access the pipe or the tank, they never mentioned this. also I've never heard of a no delivery list, personally I think she's full of shit.

    For $350 it has to be just a basic report that would only pick out major things. I bet there was an option for a more detailed report where he would have inspected the roof and properly inspected the tank. They saved a few hundred on the report and that cost them thousands.

    An inspector worth his fee will always take picture of the issues they fine. Of the oil people can get to the oil tank, this lazy inspector could get to it. This guy is a lazy bum.

    what is the purpose of an inspector that does not look under things or gets on top of things? any idiot can see where things are visible. Our inspector got dirty to make sure our house was in good shape.

    @@SilverSergeant mine did a thorough job. He got on the roof. Using binoculars is the most careless method I’ve ever heard of. I didn’t have one surprise. My report was pages long including pictures and didn’t include any excuses.

    because they don't have x ray vision. they can't all see what's under shingles or even if an O ring on a toilet is failing (which happened to me after an inspection). It's not rocket science, they can't see through things, especially the roof, that type of leak would need to be observed on a rainy day, period. Part of being an adult is understanding this AND realizing that things can & will go wrong and you can't blame everyone around you & shirk your responsibilities as a homeowner. those two wanted to blame someone else, they're in for a world of hurt, if they last in this house 5 yrs I'll be fucking shocked.

    @@Anglynn74 When I was looking at homes to retire in I had an inspector look at any house I was interested in before buying it. I turned down 2 homes with problems until I found one without major problems. $350 will save you thousands. He didn't need a rainy day to inspect the roof, he didn't go into the attic where he would've seen the water stains on the ceiling of the roof. He should've removed the lattice to inspect the oil tank. Turned the furnace on and checked the vents for heating and cooling temperatures. The water is checked for flow and pressure at every sink, toilet and spigot and show for proper water draining in the sinks, baths and kitchens. A good inspector will bring a moisture meter to check walls and floors for moisture that lead to mold. They check every outlet and electrical appliance in the house. That's what my inspector did and he took pictures of everything on his list that was a problem. With digital cameras you can take 100's of pictures and then put them in a computer file to keep. There's no excuse not to take pictures now days. Then you bring in a separate pest inspection for mice, termites or ants. This guy is probably a friend of the realtor and was just a lazy home inspector.

    I agree with the judge. Just the same as home inspectors don't tear down drywall to see if there's mold and rot on the inside of the walls. Plus from the picture of the house they bought it looks really old and in need of repair anyway. But to find out every little thing that's wrong with an old broken down house you'd have to strip the home down to the studs.

    I bought an old house last year. An inspector is worthless if they don't say "don't buy this house" If it is a money pit. My inspector didn't protect me. Pffffft

    OMG, I totally understand her pain. My first home was a "lemon" too. It was so stressful and depressing having to fix so much. Even with the inspection, there are still so much that cannot be detected. Because of our inexperience, we didn't have the knowledge to look out for signs of problems. My advise for first time home buyers- before closing, spend some time in the house- during raining days, during sunny days, during windy days; run the waters in the sinks and in the bathrooms for some time and flush all the toilets many times, then go downstairs and look for leaks; look for fleshing deterioration on the roof; checks for cracks around foundations and windows; check if all appliances are working; if the house is balanced on the ground, etc. If there is a problem, you can ask the seller to fix it, or cancel buying the house. You'll probably have to pay a fee for cancelling but that is better than having to pay thousands of dollars later. And ALWAYS listen to your intuition- before closing, I would come look at the house every other day, and would have this extremely strong feeling that something is not right, but I didn't listen to my inner voice, and I paid the prices. ***And BUY a home warranty plan (not the ones from your electric/gas company), it covers your appliances +. Ours is only 60 dollars per month; we had already had our fridge and outside air conditioner unit replaced free of charge, and had many of our appliances fixed. Good luck!❤

    No one is going to let you just hang around in the house so you can look for problems to get the price lower. It’s unrealistic. When you buy a home it’s a risk that you assume and should factor in repairs that will need to be done at some point. There is no way around it unless the house is new construction.

    @@mohammedkhaliq1475, if the house is still in the market or even if seller accepted your offer, you can still ask your agent to come open for you. You gotta be smart, don’t give seller or agent information on what you are doing. Yes, sometimes they just can’t open the house for you, but just in case, you should check what you can throughly when you look at a home for the first time, and they will let you take your time. And when your inspector do the inspection, you need to be present too, so you can follow along and do your own assessment as well. Of course you’re not going to just hang there for the whole day.

    I literally hated my inspector because of how detailed/specific he was. I would never use a different company after his work. He was very honest example- 1 house he came up to us saying are you sure you want me to keep inspecting this place there is so many issues. My advice- ask them what to expect from their inspection before you agree (photos, will they go into attic/crawl spaces, will they go on the roof, potential local ordinance issues)... never use the inspector your realtor or banker advises... make sure you are there so you can ask any questions and see the type of inspection they complete (checking electrical, plumbing, age of materials etc)

    Two things I had to learn the hard way when buying my home: 1. Do *not* trust the inspector recommended by your realtor. I honestly think that my realtor, and my home inspector, were very likely friends, and there were certain things that he didn’t mention in the final report, but I’m sure they were both aware of. 2. ALWAYS make sure you’re present when they’re doing the inspection. I was still military, stationed in another state, and I made the very stupid mistake of trusting my realtor to be there during the inspection. 🤦🏽‍♀️ As a result, I didn’t find out until I finally moved into the house a good while later, that one of the two HVACs wasn’t working properly. Lessons learned…

    Sooo he said he didn’t go onto the roof because of how bad the condition was . Yet he didn’t put that in the report , he instead said that he just observed it from his binoculars. What I see, is that he works with the realtor . He scratches the realtors back and vice versa . They keep each other in business . He tells the clients that the home is good when it’s not and the realtor then gets a sale . Yep totally crooked .

    So you think a home inspector that you pay $350 to, should warranty your house. LOL if that was the case, there would be no home inspectors, because you can 100% the time find stuff that an inspector missed, and they would all go out of business from being sued. A home inspector is just a service to find some obvious stuff, not foundation problems, AC issues, major plumbing, roofs etc, those are specialized inspections that a home inspector can’t do in depth.

    @@benmartinez1267 And what he wrote was 100% accurate. Unless there's anything glaring, you can't tell if there's a roof issue. I had a roof leak last year when it rained, just hearing dripping and the roofers that came to fix it said that if there wasn't visible damage, you couldn't notice it and visiable damage only happens with rain. This inspector straight up told them "There could be damage that will only happen if it rains".

    Were you listening to the case? The inspector clearly noted what he could inspect and what he couldn’t. They don’t inspect every shingle, and it can take heavy rainfall to show any roof damage which is why he said that.

    I was a home inspector for over a decade. From the picture of the house, the roof could have easily been inspected by getting on the roof from the deck, or at least get a closer look from a ladder.

    We hired a home inspector when we bought our home. 2 days after we moved in we smelled gas leaking in the garage. The leak came from the gas pipe under the foundation. This was an expensive fix. I don't recommend hiring an inspector. If we were to buy a home again we would hire an electrician and a plumber to come look at the house instead as they are more knowledgeable. Just my 2 cents

    it's not uncommon, they're all different plus he would have never seen what's UNDER the shingles even if he did climb onto the roof. they bought an old home & are experiencing old home issues & want to cry "we're millennial kids & we were scammed, it's someone else's fault!". If they make it 10 years in that house before running back to mommy & daddy I'll be fucking shocked.

    @@Anglynn74 So why didn't the inspector gain access to the door to the attic and pop his head up their, shine a million candle watt light in the area and take a 👀 at the roof from the underneath of it? And where's the pictures that most inspectors take while doing their job, even JM found it odd he didn't have any. The guy has 1 job, to inspect every inch of that home and report any and all findings to the home owners. This inspector seems to only do the bare minimum to collect his inspection fees and move on to the next victim, oh I mean homeowner. You also made the comment about the kids running back home in a few years, that may happen or may not happen but you have to give the 2 of them props for having their shit together at such a young age. Even if they had some financial help from their folks, its great that their able to help them do that. Most kids I see today are acting stupid, not working or going to school and still live at home with no ambition. The plaintiffs in this case seem to have goals and are working towards them.

    @@cynthiacler9284 First off, I'm not reading that long novel. Again, all inspectors are different. They don't all do the same thing, many will state this right on the paperwork that the prospective homeowner signs. Some will state in order to do in depth inspections it's more money. For most of them what might seem simple to us isn't for them. They can't see through roofing shingles, they can't see how an oil tank will perform, etc. Most of the things that will go wrong in an old home WILL go wrong after an inspection, it's no wonder they aren't sued 24/7/365. This is not a new home, most of the things these two sheltered kids complained about would have eventually happened anyway & most of it is tame. What inspectors DO look at are the more important things such as ungrounded outlets, electrical, etc. Those kind of things are more important than a water leak or what some stranger on their computer feels should have been done. If these two last 10 yrs in this home I'll be in awe.

    When purchasing a house, there are certain inspections beyond the basic home inspection that buyers should consider, one being a video pipe inspection, an hvac inspection, and a roof inspection.

    They could look into suing the previous owner, if they have proof from the oil company that they were on the No delivery list, and if the previous owner lied about damage on the disclosure list, they’ve got a pretty good case

    Good shout. That would be an interesting case, I wonder how tight the contracts are when buying and if there is any leeway to sue the former owner. With a car, if you can prove they knowingly lied about an issue they knew about you'd get your money back. If it's the same for a house they could sue. Would be great to see on People's Court too.

    I looked into suing after buying my house and finding problems that were not listed on the seller disclosure form and would be obvious to someone already living there. A lawyer advised me I would have to put down a $5,000 retainer fee just to start the process. Not something you can afford to do just after laying out all the costs in purchasing & moving into a new home.

    I'm confused by this inspection system, if he's too afraid to get up on the roof, why? And shouldn't his report reflect his fear and indicate not to buy because he's afraid? Unless he's just afraid of heights, of course!

    And this is exactly why I told my daughter to purchase her home via FHA; where you only have to put 3% down. And even if it's 10% that's still better than going conventional. Going through FHA means they have someone to do thorough investigations(of all prior history/paperwork), not just inspections. FHA is going to pay someone to get on top of that roof. For example, FHA pays someone to assess the plumbing and note any lines on the walls that looks like water damage in the basement (or note the area where there's some discoloration on the walls). FHA notes assessment fees charged to the old owners(for future comminity-projects aka incurred finances b4 buyer-FHA makes the seller finish paying for the project). They inspect for lead paint and get this, FHA makes the sellers pay to have it removed. Why is it such a thorough inspection? FHA doesn't want to have to foreclose on your house. The Federal government understands that you the homeowner have the right to file bankruptcy and get out of a flop deal. Again, FHA knows that you have a way out in other words. So they do all that inspection/investigation for you. So, you'll live in a house that doesn't have all those issues. So if they find lead-painted walls they make the last owner get rid of all of that before the sale! They make them spend all that money to make the house "new homeowner ready." When you go conventional you don't know much of anything. However, you (buyer) pay and it's up to you to understand that you will need someone to check everything individually. And at the end of the day after putting down all that additional money (conventional) the savings is only $7 (your mortgage payment)for everyo $1000 that you put down. I never had money like that and I used to listen to people's stories about going conventional and I went FHA during a time the market was great for consumers, and you know what? I don't have horror stories to tell about my home. I have girlfriends who are pissed to this day that bought their houses conventional and they found all kinds of (hidden) problems once they got in there. I didn't🙄.

    I don't understand how the plaintiffs think that the defendant took advantage of them because they were young new homeowners? How about you read exactly what you sign.... every word before you sign it! not only that but like the judge said he put in detail in his inspection that there were multiple things that he couldn't vouch for, why wouldn't you read that and then tell him before buying the house I'm not comfortable with this part of your inspection, that's not him taking advantage he was completely honest in his inspection, do I think that a home inspector should be able to inspect that stuff before they can sign off an inspection? Of course! but like the judge said that's not how it works, that's how 99% of home inspectors do their jobs.

    No photos?? My home inspections have all had PAGES of photos attached. Plus during the interview at the end he stated that he usually goes up on roofs, but he didn't for this one because the condition was so bad that he thought it could be dangerous or cause further damage. WHERE was that in the report? When JM read the roof part, it was just a bunch of stock language about roofs. NOTHING about how the reason he didn't go up there was because he could see the poor condition from the ground. This guy is horrible, and I would never hire him to do an inspection. He obviously doesn't give one crap about the best interests of his clients. I hope their realtor learned a lesson and never recommends him again.

    In the uk our inspectors cost way more but look at foundations etc. so it’s far more in-depth.

    The biggest purchase most people make, you need to read things you sign. That said this inspector is a dud. Doesn't seem to know about a magic device called an inspection mirror. Was there no ceiling hatch to look into the roof? I can't believe the roof failed in one go there must have been signs.

    Sad outcome. A roof tarp, when secured properly, can protect your roof from new rain, snow or wind. It can prevent holes or missing shingles from turning into leaks and can keep existing leaks from getting worse.

    There is something to be said for the value of the rapport the inspector wrote in general. You hire an inspector to inspect the house for defaults. You then SHOULD be able to use this inspection as proof of the state of the house. When the rapport says that they don’t vouch for one thing after the other, then what is the use of ANY part of that whole rapport? It makes the rapport invalid by default. So, imho, the plaintiff should get their $350 back. However, you can’t do that either, because that would jeopardize the whole BUYING of the property, since that decision was made based (partly) on this rapport… Difficult stuff….

    Home inspections are not directly for the benefit of the person buying the house, they’re mandated by the mortgage company for their benefit. They want to make sure they’re not financing a house that’s going to collapse. If the structure is in decent shape they will make the loan and any subsequent repairs are the homeowners responsibility.

    I would think they *mayyyy* have a claim against the seller. If a seller knows of a pre existing issue they must disclose. How wouldn't the seller know?? They may not have but it seems more likely that a leak didn't start only after the sale if the plaintiff's roofer found the necessary tar layer missing...idk, just thinking out loud

    if it was in the shape it was in with a rusted oil tank on a no delivery list it was probably a foreclosure or short sale & they were unable to sue the former owner so they went down the chain.

    Typically, as the home buyer, you have options when it comes to home inspections. Most all inspections I’ve seen have come with pictures however, it seems like this young couple chose to go to cheap route and get an inspection that didn’t include pictures. There are different levels of home inspections that include greater details, even still, the home inspector cannot catch everything. I always advise people to get home inspections at a higher price point so you have the most information. The small cost on the front end could potentially save a lot on the back end.

    The only thing the inspector did not do was take pictures. There than that, he provided an honest inspection report. It has taken me 17 years to get my house up to par because every day you find something to fix. That's what happens when you buy an old house.

    This case reaffirms my stance that renting is a better option for most people. Alot of us dont make enough to buy a house much less the constant upkeep. Home ownership USED to be a solid decision. But its only for the very rich nowadays. *and no, the house in Model City your mommy gave you doesnt count because you didint pay for it

    I had a home inspection and also had a plumber and roofer come out. The plumber found things and I ended up with a new garage roof. The inspector found nothing.

    You hire an inspector to find the problems before buying a house. This inspector did not bother to actually do his job. Inspectors should definitely take the time to inspect and photograph, especially a roof and foundation.

    A home inspector looks for damage and/or signs that damage was repaired or hidden. He does NOT do a building inspection, that was supposed to be done by the county when the place was built or when major repairs which required permits were complete. That is why it is often referred to as a TERMITE inspection never a building inspection. . As for a roof inspection, those are usually FREE and done by roofing companies. This is why I do NOT like realtors at all.. Their realtor SHOULD have informed them of the proper procedures but the greedy realtors just want the deal to close so they can get their commission .. Realtors are typically the LEAST knowledgeable and most dishonest people

    First error inspection report looks slim. My inspection report was way thicker than that mine was in a binder, and it had pictures of everything inspected and it passed.

    My inspector missed that the whole house had copper wiring, which needed replaced, and the basement had flooded at some point. There are a LOT of lazy inspectors out there. 😒

    Never hire an inspector who was referred by the realtor. Youre basically paying them to let things slide so the realtor can make a sale. We made that mistake and we deeply regret it.

    P.S.- This is another hard lesson they have to learn quickly, every time you sign a contract whether you read it or not, binds you legally to the terms of that agreement!! But plain common sense (which I get that not everybody has), should have told them that the man’s small fee of $150 should be a hint that for that kind of $ of course he’s not going to go over that property with a fine tooth comb!! (150.00 really is unheard of in this day & age in the world of Real Estate closing costs). I wonder how big (or small) the place they bought is -to be charged so little. Wish our “Home Insp. Report would have only been 150!

    Here's the thing- at the end in the hallway, the Plaintiff says, "I feel like we were taken advantage of." This is not true. The Plaintiff signed the report without going over it. Simple fact. If I was the Plaintiff, I would have said, "Can you get a ladder and get up on the roof?" or "What needs to be done for the gas tank on the side of the house so you can thoroughly inspect it?" To claim, "I didn't know- I thought I was signing the termite report"... that's total BS. If he's standing there with his inspection you should know who he is.

    They are 22 and 24, not kids. At what age are we as parents going to require our children to be adults and stand on their own two feet? I think they were great dads being there for moral support, but these "kids" are grown and need to learn their own lessons instead of being coddled well into adulthood.

    @@spacecase8791 they've obviously been coddled by suing an inspector for things he wasn't able to see and for things that old houses do commonly, but according to them he should have had x ray vision and been a psychic. what are they going to do a year from now if the basement floods or the old floor joists give way? who will they blame then? that whole generation was raised with mommy behind them constantly blaming others for their child's problems & cleaning up their mess, there's been tons of articles written about this. they were never allowed to grow up ever, they were raised this way & they'll continue to live this way, nothing is ever by chance nothing is ever their fault.

    The defendant won the case. She signed the contract accepting his word. If she didn’t accept his word, she wouldn’t of signed it. She thought she could win on a technicality because her wasn’t carbon copied signature. However, under oath she said she did sign it.

    A home inspector who's been in the business for 40 years and we're supposed to find him credible, yet who takes no pictures, especially of major stuff? My inspector took photos of everything. Giant red flag with this guy that he's sloppy and doesn't document his findings. If anything, mine overindexed on being critical about every small detail in the name of caution to protect himself.
