Legally speaking the ex has the defense the lawyer talked about. That being if he really did not do anything for 10 years, only coming out of the woodwork at the pressure of MIL. He probably won't do anything by his own volition again.

It is not hard to cut off family members. Either this story is fake or the lawyer is an idiot. Internet search on Elder abuse "elder abuse can be both criminal and civil. Civil law defines elder abuse as physical abuse, neglect, financial abuse, abandonment, isolation, abduction, or other treatment resulting in harm, pain or mental suffering to an elder." The MIL would have to prove neglect, abandonment, and isolation. Since both the husband/son and OP (wife/daughter-in-law) were not living with the MIL for years before cutting contact there is no grounds for a case. The lawyer is either really bad at their job, or the story is fake. No court in the US would hear this case, as you have to submit proof of some sort to back up a civil court claim, or the judge will just toss the case. Not talking to MIL does not fall under abandonment, or neglect. MIL could try under isolation, but that legal wording is isolation from contact with everyone, not from a specific person.

You only know a one sided story. The MIL could have handled the situation better but the man is her only child and her husband is dead. The ex of OP could have manipulated The MIL . There are two sides to a story. Also, The OP looks she gets what she wants if you know what I mean.She has kept her husband away from his mother with minimal contact for atleast 2 years. If that is isn't manipulation I don't know what is.

She looked into OP's past to find some imaginary dirt and doesn't actually care about her son being independent. I have seen documentaries and movies from those of parents (mostly mothers/MiLs) that have an unhealthy attachment to their offspring to the point where they don't want them to live their own life. MiL is very dangerous and her actions speak for themselves.

Now her bogus reasoning is what was going to get her case thrown out if she couldn't get more solid evidence. But once again, it wasn't "my son won't talk to me", which is what you boiled it down to. Which to be fair it was her entire reason for throwing the temper tantrum. That doesn't mean that you're being reductive for no reason when both lawyers were admitting she at least had enough evidence to get in front of a judge by their language. Instead of getting thrown out prima facie.

Narcissistic mother and then some. I had one. Fortunately, she was just a bully. Big talk until you gave it back, then she retreated. After I got married, she tried something similar. She didn't like my wife and I didn't care. She was my wife. She said the wrong thing to me one day, and I went NC until she learned how to talk to me as an adult with a life and responsibilities that had nothing to do with her. It took three years. I constantly reminded her I have a home to go to if she starts acting up again. She's been gone a little over 22 years. Loved her. Didn't like her. Appreciated her. Don't miss her.

I’m so pissed at this. At this point, your husband should admit her into a nursing home, if she really is a) as old to be considered elder and b) if she wants to shout emotional distress. At that point, she can yell and scream if she wants, but if the court sees her as requiring assistance, she can no longer use it against you. Or give her a liscensed elderly nanny, that also works

And hang up on her. Sidenote: They really should have just broken up at the first sign of discord. Shit like this only ever really escalates so unless they worked through their issues they should have just called it quits when they could. Never marry into a family that doesn't like you. Imagine five-ten years down the line they decide to have kids and all the added stress they'll be under. This is how you get those stories about relatives who do wildly inappropriate things years down the line and act entitled and abuse people. Because they let them get away with it in the past and established a pattern of this stuff being acceptable.

My gosh, listening to this whole story. While I am glad OP got a keeper of a husband, it is kind of astounding that he is the offspring of such a malignant narcissist like the MIL. Yes, I do consider her to be of he malignant type, cause who in the right mind brings a tormentor to the victim knowingly? The added sadism to make OP terrified makes her worse than a lot of narcissists, and even worse, based on her actions, it's clear she knows how to exploit "rules lawyer" to manipulate the husband back into her fold. OP, my advice is to not take the bait. Manipulators like her love to set traps like these, cause all she wants is a chance to sink her claws into your husband and poison his mind against you, and one chance is really all it takes. MIL can only file B.S. Elder Abuse claim one time. (Personally, I am not sure any reputable lawyer would even take such a case.) Unfortunately, narcissists are very good at convincing other people that they are the victim. (This is how they inspire their flying monkeys.) A good lawyer would have told you the best way to defeat a narcissist in Court is to quietly collect evidence as they brazenly try to bully you. (Keep a journal, save text messages and take photos of the stalking behavior.) After about 2 or 3 months you will have enough evidence to persuade any Judge or Jury that the supposed victim is the real psycho. This is a complete pain, but it helps you establish the truth if a need ever arises. Then you your can go into "Rock Mode" where you have no feelings toward them anymore.

It's Crazy that a man would choose a woman who came into his life for 2-3months over his mother. He should atleast think about his mother's choices . Or try and explain her his choices. And the points his mother put were purely out of love for him as he is her only child and she wants the best for him.
