Maybe not. They said NY is a one party state, so as long as Cohen knew it was being recorded, it was lawful. It might have been unethical, but not necessarily unlawful. Even so, I didn’t hear anything on that tape that was unlawful. Paying for a non disclosure agreement is not illegal. Trump wanted to pay cash, but Cohen said he wanted to set up a shell company and pay through that shell company. Trump says pay in cash, Cohen says no, no, no. I got this. If anything, the tape exonerates Trump and implicates Cohen.
