Rate of interest can definitely be more than 6% as nothing is specifically defined by the SC . After complete analysis only it is decided. Yes in General every time when its not possible and the plantif is not aware of the onus that lie upon him to prove the loss , 6 to 9 % is granted. One has to convince the judge that means profit interest rate should be more .

can you please explain. In joint family properties. Involving son and daughters. Son has constructed a building since there a registered partition btw him and his father in 2001. The son have constructed building and earning rents since post 2001. son have invested money into construction and earning rents. Now court has ordered equal share this year in property to daughters rejecting the partition done btw father and sons ( wrong judgment due to XXXBE though the case is barred under proviso of HUF Act 2005, nothing contained in this section will apply to partitions taken place before dec 2004) and ordered for mense profits along with equal share. FDP notice is received now. Since here the son has invested and earning rent. And also the case was put after 9 years of constructing budiling. Suit was filled by daughter in 2010 .. Should son has to give mense profits ? please explain. Is it not barred under section 2(12) ..... In beginning you said, no need to pay if you have invested and earning rents. Son has been paying taxes from 20 years till date and still they are paying even after suit is lost has FDP is not yet settled
