Sir, kindly rectify me if i understood anything wrongly. 1 Basic Definition Means -> Exhaustive definition (Mostly used), Includes ->Inclusive definition. 2 Notwithstanding anything contained Giving overriding effect --> Non-obstante clauses ² In the Act (Overriding particular Act) ² In the Section (Overriding particular Section of Act) ² Any other law for the time being in force (Overriding all other Acts also) 3 Subject to Opposite of NWA clause -> Giving the other law an overriding effect 4 Save as otherwise provided "Except for" -> follow this section (or) if anything written in other place specifically follow that. 5 Without prejudice "Without hampering" on overriding other provisions, That means follow this section without hampering other section, while they both are applicable simultaneously. 6 Shall Mandatory 7 May Directory 8 Proviso To create an "Exceptions for general provisions" (or) Explain new concept. Þ Provided that….. (1st Proviso). Þ Further provided that…..(2nd Proviso). 9 Explanation ¯ To remove Ambiguity. ¯ To bring more clarity. ¯ To Increase the scope of section. Examples:: 139 (5) Notwithstanding anything contained in 139(1) 197 (3) Notwithstanding anything contained in subsections 1&2 , but subject to provisions of SCH.V 199 Without prejudice to any liability incurred under provision of this act or any other law for time being in force. 217 (5) Notwithstanding anything contained in any other law for time being in force, inspector making investigation shall have powers of civil court.
