Manslaughter Case Against Accused Wife Killer David Swift Moves Forward

Despite being found not guilty of murdering his wife, a manslaughter case against David Swift is moving forward. After his trial, prosecutors indicted Swift on voluntary manslaughter for the death of Karen Swift. Karen was found dead in a Tennessee cemetery in 2011, but her husband, David, wasn’t arrested for the alleged crime until 2022. David Swift appeared in court Tuesday. A judge set another appearance date for July 30.

    For those that are confused: In June, a jury found David Swift not guilty of first-degree premeditated murder, attempted first-degree premeditated murder, second-degree murder and attempted second-degree murder, but was unable to reach a verdict on the charge of voluntary manslaughter. This is about the retrial of only the manslaughter charge.

    Prosecutor cutting off the judge and speaking over the judge was not helpful to the prosecutor.

    We know he's guilty. He knows he's guilty, but the state dropped the ball YEARS ago, and they dropped it again NOW. The dude needs to walk. He got one heck of an attorney, and they whupped up on the state at every turn. The prosecutor acts like a toddler who didn't get his way! Quit embarrassing your county and dismiss these charges.

    I don't think he's guilty. I don't think he left the house that night. I believe she went back out after her daughter fell asleep. It was said that she had a habit of going out at night & staying out late. I'd like to hear more about the man she told her friend she was "messing around with", a married man.

    This case is ridiculous. The prosecutors failed to prove the case and now they are angry. They want to waste taxpayer money to try the case again.

    Actually, the judge hasn't made his ruling on the defense motions yet. That is supposed to happen on July 30th. The defense is contending that the statute of limitations has run out for the manslaughter charge. It's a 4 year limitation I think. This is a slippery slope if they allow anyone to be charged after the limitation. Think what the prosecution could do to anyone.

    Jury was hung on involuntary manslaughter so the prosecution is going to retry on that charge.

    This is so rediculous. The judge should have dismissed the charges. The man was already found not guilty of murder in the 1st and second and jury deadlocked on voluntary manslaughter. Your just waisting taxpayer dollars continuing at this point.

    He is coming up for another trial for stalking his 2nd wife while out on bail for Karen's murder. David was reportedly "parking outside of her home at all hours of the night in western Jefferson County." after their divorce was finalised.

    Exactly! He shouldn't be! He is because technically, while he was found not guilty of every degree of murder as well of as battery, etc. the jury was hung on the manslaughter charge. People charged with manslaughter are out on bond all the time...this is total bs Now, did he do it? I do believe so but a jury found him not guilty and he should have been allowed to walk out of the courthouse and go home that day

    So basically, the jury found him not guilty. And the DA is bringing new charges against him. So what if the judge let this happen and the jury finds him not guilty again. This DA may try again.

    He was found not guilty of murder. But it was a hung jury on manslaughter. That's why they're trying the manslaughter again. New murder charges would be double jeopardy because a jury found him not guilty.

    But what you need to understand is voluntary manslaughter is a lesser includedincluded offense of murder, which he was acquitted of… Whether you think he’s guilty or not, the man was found not guilty. He should be free!

    @@littleangel4780 the defense is arguing that since there was no tolling language for the statute of limitations for manslaughter in the original indictment, that it wasn’t actually a hung jury, that everything is over since the statute of limitations ran out 9 years ago. To my surprise, the prosecutor actually conceded to the defense on that! The prosecutor is arguing that he may bring new charges of manslaughter, tolling the statute of limitations this time, after a not guilty verdict of murder because he claims manslaughter has factual elements that murder does not. The defense conceded that had the prosecutor wrote the original indictment with tolling language, there would be no issue with a new trial. It’s actually an interesting double jeopardy case that may go to a higher court upon appeal.

    This judges love for this defendant is UNREAL!! 😤 From his comments to the jury after the trial, exclusion of vital evidence, asking the jury about their deliberations (how they were voting… absolutely UNHEARD OF!!), etc etc - We need a NEW judge on this case immediately!! And all that is just from the last trial… not counting the BS from this hearing! 😤😠😡🤬

    I disagree, during the murder trial the judge allowed plenty of speculative testimony and confusing evidence that benefitted the prosecution. Just wondering in case I missed something during the trial, in your opinion what vital evidence was excluded?

    He’s still there on other charges related to his most recent wife. Also, defense is saying the jurors should not have been given the option of a lesser charger because of statute of limitations of involuntary manslaughter. It’s complicated! And I’m still listening lol

    20:24 Excuse me but the jury didn’t come back with "not guilty" verdicts on anything… they came back saying they were hung!! You, judge, pressed them on divulging information on their deliberations!! 😡 What if a juror(s) wasn’t comfortable speaking up in OPEN COURT - in front of all the parties, families, being live streamed, etc - that they disagree with what the foreperson was saying?!?! I have averaged 10-12hrs a day for the past 4-5 years streaming trials & I’ve NEVER seen a judge do that! EVER!! This is where the law regarding the states ability to a judges ruling (remember he ACQUITTED Swift on those charges) needs to change!! 💛⚖️💛

    @@lesspam6601 According to the JUDGE. He took it *upon himself* to automatically acquit Swift of those charges so they were no longer on the table (which is what HE wanted all along). They passed the note stating they were unable to reach a decision. Period. *Should’ve been declared a mistrial at THAT point.* But the judge questioned them in open court & goes through the charges, incl lessers… exact words were (I wrote it all down) "Has the jury considered the second level of offenses - attempted 1st degree premeditated murder?" - Yes, we considered that. (end of statement but the judge kept pushing…) - "Is there an agreement that the defendant IS NOT guilty of that offense?"… and he goes through them until he reaches manslaughter. Not what was your decision but HE inserted the Not Guilty part on every single one… basically hinting that’s what HE wanted. Either way, what they discuss or even the split is NO ONES BUSINESS except the jurors - no one including the judge! - & they don’t have to reveal ANY of that info EVER but the judge put the foreperson on the spot & made them answer in open court in front of all. That’s not right & shouldn’t have been allowed!!
