Man convicted of attempted rape fights for new trial as victims speak

"Rape is a felony punishable by three, six or eight years in state prison and a fine of up to $10,000. Thus, an attempted rape conviction could carry a sentence between one-and-a-half to four years in state prison and a maximum fine of $5,000. Oct 2, 2018" Even if he was guilty, his rights were violated. Excessive fines and Cruel and Unusual punishment clause, 8th Amendment. 44 years for "attempted" rape. But I thought we were supposed to “believe all women“. In fact I do believe these women are not purposely lying. They were 13 years old, so maybe they were convinced by the police and authorities that he is the man that tried to hurt them and after 40 years they believe it just like it actually happened. If you know anything about how memory works you know that false memories can easily be created, especially in somebody so young. And also, if they were purposely lying then why not just stay hidden and not come out and invite all the scrutiny against them? Why not just keep their mouth closed? The media has a rule not to release the names of sexual assault victims, so they could just stay in the shadows. A lot of real victims do that too, so I couldn’t they do the same thing? Not everything is black and white, most things are shades of gray.

Yeah, but I see a big difference here. All these twin women have to do is keep their mouth shut and refused to talk to the media if they were lying. Especially because the news media doesn’t release the names of people who are classified as sexual assault victims. So why not just keep their mouth closed and have a lawyer of their say either nothing or say that because he’s spent 40 years in prison they do believe in possible rehabilitation so they are open to that but they never want to see him or speak to him for the rest of their lives. Why not do that? Instead they get on the news and invite all this criticism against them. Why do that if they’re lying? Why not just stay hidden if they’re lying? I think it’s way too easy nowadays to believe that everybody’s in a conspiracy and they are racist. Sometimes the issue is more gray than someone outright lying.

I would support this 100%. This happened to my son when he was 14 years old. This girl he was hanging out with got mad at him for not wanting to have a sex**l relationship. He was so young and was still a virgin and wasn’t ready to do any of that. So she dumped him. And then one day he was hanging out with a kid that had previously dated this girl and when her and her friend found out that the 2 boys were hanging out, she got mad so her and her friend made a plan to call the police and say my son se**lly assaulted her. I get a phone call from a detective and they tell me this and I was in utter disbelief. Like I thought someone was prank calling me at first. Until they had me meet up with them in the boys because they had them detained And were interrogating them in my poor son was scared out of his mind and so confused what was going on. So then a little later down the road I get a phone call from this girl‘s dad and he’s apologizing to me and saying how sorry he is and that the girls admitted they made the entire thing up just because they were mad that her two ex-boyfriend‘s were hanging out together so they wanted to retaliate against him for that and could have ruined my sons life if the dad had not come forward. It makes me so angry that people actually do this kind of stuff and ruin peoples lives! And then people that are actually Real victims of this kind of brutality aren’t taken serious because of idiots that make up stories for their own selfish benefit.

As a man that has been falsely accused myself albeit I won at my criminal trial, I am against this vehemently. Databases like the "Times Up" I believe it was called are rife for abuse. Keep in mind, if a woman is falsely accused of falsely accusing a man, she becomes one of us. Falsely accused does not have a side. Either someone has or has not falsely accused. Having been through it, I don't want anyone to be falsely accused and I certainly don't want anyone to be on a list without a trial wherein they can not defend themselves. I looked very guilty in the media until I was able to force a trial and I risked years in state prison if convicted in order to get the trial to prove I wasn't guilty. Had I taken any of the deals which were no plea necessary and no jail time and no record and so on, I would have never been able to prove I was innocent. No lists, no assumptions of guilt, none of this will bring justice and will bring injustice. Even with a trial, I am hesitate to advocate for the idea of putting first-time accusers on trial even when the evidence that they lied is overwhelming. My mathematical calculation which is best guess of how this will help vs. hurt future men that are falsely accused, is that prosecuting false accusers will likely cause more convictions, not less, of falsely accused men. The Law of Unintended Consequences is always at work and I take false accusations Extremely seriously knowing how it feels hence saving the most men from conviction must be the primary goal as well as ensuring that any innocent person gets a trial.

Plus if this all happened in the car they should of gotten some evidence from the car especially if claim was she bled alot. Something smells to high heaven and it must be the 2 women wallowing in their lies to this day. I think they knew Simmons and were mad at him about something and this was their very sick way of getting back at him. They must live by the the rule " it ain't a lie if I believe it". Despicable!!!

No, the twins cannot be charged with perjury. First of all they were 13 years old so they would never be charged with perjury no matter what. But even more importantly, the statute limitations is way over. So if they are purposely lying then they could just keep their mouth shut and never speak to the media. Especially because the media has a rule not to release any sexual assault victims name. So I feel like the only reason they’re coming out is because they do believe it at this point in time. Whether it’s true or not is more complicated, and I think there’s a lot of reasons to believe that this man did not do it. But I feel like these women do believe he is the one that did it now. When you live with something for 40 years you start to believe it.

My accuser in as much as possible must know. I think her rationalization is "I called the police, I told them what I thought I saw, maybe I was wrong, but the police, not me, did this to him." In addition, I think she probably thinks, "why should I get involved and ruin my reputation, it's not my fault even if he is innocent." ...and there is a grain of truth to what she probably thinks. Although she called the cops on me (a stranger at a jogging track) explaining she thought she saw a man 'himself exposed'" the cops when they arrived wouldn't listen to her when she tried five different ways to admit she was probably mistaken. Then the cops built it into a made up felony case, and to a limited degree she would go along with them, and then kind of not go along with them and on and on. Nevertheless, after I was exonerated I was able to acquire hidden tapes of her interview, which she did not know existed and either had I, and her statements and trial testimony and deposition testimony at the case I brought against the cops, doesn't jive so she has to know but I am as sure as I can be that she thinks none of this is her fault, that she did what she had to day because she felt pressured. She is right about feeling pressured, but she should have continued to not go along with the cops as they started to build a case that she had to know made no sense. One thing one learns after a false accusation case, is a lot of people can live with themselves after knowingly doing this to an innocent man. I did not understand people or life I know realize before this happened to me because I thought it rare that people could either falsely accuse or do nothing when they know the person accused is innocent. Everyone stood by, except oddly enough, I believe the prosecutor did not want to convict me, the judge all but told the jury the state's witnesses contradicted themselves, and behind the scenes I later found out, a deputy police chief was stopping much of what the police chief and other police involved in arresting me were doing to make me look guilty. I had never heard of the woman or the cops, I had no criminal record and was just out doing my jogging and life as I knew it, was stolen from me. Thankfully, unlike most of the accused, I pushed for and received a fair trial and cleared my name which rarely happens.

The women should be held accountable for the false rape charges. They cost a man 45 years of his life. This man can't work enough years to save for retirement at this point. He'll likely live in poverty as a senior, which is yet more suffering for him.

A lot of real victims do that too, so why couldn’t they do the same thing? Not everything is black and white, most things are shades of gray. _Edit 2/20/22: updated a voice dictation typo from the word “I” to the corrected word of “why”. My voice dictation sucks Way too often. Because I meant to say “why couldn’t they do the same thing” and not “I couldn’t do the same thing”.

@@deanpierre12 - When you lie you’re saying something untrue with the intent to deceive. If they believe it, it’s not a lie, it’s still on true but it’s not actually a lie. But I did watch all the video, in fact I watched other videos before I even wrote my comment because often one news video doesn’t have enough context. My problem live is I am maybe too concerned about having all the information I need to make an informed opinion. I read the second paragraph of my comment again to see what part may not make sense. But I don’t really see what you could be talking about. If you wanna clarify I’m happy to respond.

2:10 something about both these women feels completely off, I'm getting trashy racist vibes from both of them, not knocking anyone who lives in their area but yeesh..."all black people look alike?" Really? Yet they're able to pick out the one black man in handcuffs (who according to their story wasn't wearing those handcuffs when they picked him) but that would mean that for some reason AFTER they pick him in the lineup they handcuff him and then line everyone up again for a photo? How does that make sense? And they admit to their cousin violating them when they were 10 so is it really a stretch to think he wouldn't do it again when they're 14? What??

I don't think the black people all look alike is necessarily racist in that context. I think there is no evidence to have convicted this man and that their opinion that all black people look alike destroys the eye-witness claim, which I personally think are unreliable at any time. As for using the "N word," I lived in NJ at the time and almost never heard it. I am told that white people used it routinely in the south in those days and it wasn't even necessarily hateful, just as today if one uses the word black. I don't know but think things should always be viewed in the time that they happened, although that does not change the fact that there is no evidence.

Let's not rely on eyes or appearance please. Out of respect for the falsely accused, such methods are what often cause wrongful arrests. Liars can appear quite innocent and the innocent can appear quite guilty. Studies indicate time and time again, our ability to gaze truthfulness in others on average is not much better than a coin toss. Some of us are slightly better than others at telling when someone is lying, but all of us are not good at it.
