I’m sure the Republicans of today would’ve, but then ones back then wouldn’t. If they did, this question would’ve gone to the courts then.

But the supreme Court basically said "let's not open that can". Now that Trump has been prosecuted, this opens up what was previously a tradition of not prosecuting, could turn into a repeated process of locking up the previous president for any number of things once they leave office. This needed to be stopped before it started. The liberals are just mad because now they can't claim Republicans are destroying democracy when Rs get back into power, even though they were the ones that pushed the rock downhill.

Not anymore! If said actions constitute a crime but it can be argued that the President performed them as an "official act" thanks to this ruling he (or she) is now immune from legal consequences.

The issue isn't immunity for official acts. That's always been understood. However the idea that you can't use official acts as evidence is interesting development. Roberts questioned about a bribe for an ambassador appointment. Essentially, a prosecutor could charge for bribery, but not provide evidence for what the bribe was for. Interesting as Roberts seemed skeptical of that argument, then signed off on it.

I hate how the extent of some of this argumentation is "well, the opposing party did the immoral or illegal thing first," like that somehow makes it okay for them, instead of simply meaning that both need to be held accountable.

Sane person: The president shouldn't be allowed to commit crimes, whether in "official" or unofficial acts. Will Chamberlain: Well then what about Obama and Bush!?! Sane Person: Them too Will Chamberlain: Well then what about the Russia Investigation? Sane Person: Mueller found insufficient evidence to prosecute Trump of a crime, so that has no bearing on this question. Will Chamberlain: Well then how am I supposed to defend everything Trump says and does if we don't let him commit crimes?

Do you understand that qualified immunity is a poor conduit to good policing, and that judicial immunity is a poor conduit to a good judiciary? Can you explain how giving the keys to the henhouse to the fox is a good idea?

Say something about people not being above the law this is just so untrue. They’re always have been and always will be people above the law. You’re not fooling anyone by repeating that over and over.

It's like a kid watching parents that just scream at each other all day and throw things. But then once they get you with them alone they say something like, "you see how terrible they behave, it's obvious they are the one with the problem." No, from the outside looking in it appears as if both of you are messed up.

It's not complete immunity. The congress still has the ability to strip an individual president of immunity for specific acts.

If you can look at this ruling as anything other than a terrible step away from democracy, then you need help. Under this ruling, if a president for example took bribes to issue a pardon, all communications and evidence related to the discussion and issuance of the pardon is protected. You will somehow have to prove that he was bribed without providing any of the evidence. Tell me how that is a win for democracy

I mean the executive has had immunity for the longest time - NSA, CIA, FBI, the president himself. It doesn't go to jail, it doesn't find itself guilty of criminal activity. The ruling was just establishing the rule that's always existed but giving a clearer definition for when it doesn't work anymore.

Saager does a great job drawing out answers his guests were hesitant or unready to share, all while preserving their dignity. Fantastic solo work, looking forward to more!

they can get away with more stuff than the regular citizens. and legally. same with the legislature. same with the judges. if you remember, Sen. Warren was able to "slander" Nick Sandman and used congressional immunity as a defense. A normal citizen can't do that. So is she above the law?

The Federalists have always been Monarchists. For all of these arguments about Democrats being big government, the Republican party has always been for a stronger executive and therefore a stronger Federal government: IE Federalists.
