    Will’s response of “that’s how it’s always been because Obama didn’t get prosecuted” seems pretty weak. Obama didn’t get prosecuted because no one decided to try. I’m sure the Republicans of today would’ve, but then ones back then wouldn’t. If they did, this question would’ve gone to the courts then.

    But the supreme Court basically said "let's not open that can". Now that Trump has been prosecuted, this opens up what was previously a tradition of not prosecuting, could turn into a repeated process of locking up the previous president for any number of things once they leave office. This needed to be stopped before it started. The liberals are just mad because now they can't claim Republicans are destroying democracy when Rs get back into power, even though they were the ones that pushed the rock downhill.

    Because you don't want the guy responsible for the entire military being scared of getting sued or arrested if he is a tad too aggressive in a response to a crisis. You want the President to be free to carry out his duties with zero concern as to his own selfish wellbeing. The last thing you want is a President refusing to make a hard decision that could harm millions of Americans simply out of self-preservation against legal threats after the dust clears.

    The issue isn't immunity for official acts. That's always been understood. However the idea that you can't use official acts as evidence is interesting development. Roberts questioned about a bribe for an ambassador appointment. Essentially, a prosecutor could charge for bribery, but not provide evidence for what the bribe was for. Interesting as Roberts seemed skeptical of that argument, then signed off on it.

    If you can look at this ruling as anything other than a terrible step away from democracy, then you need help. Under this ruling, if a president for example took bribes to issue a pardon, all communications and evidence related to the discussion and issuance of the pardon is protected. You will somehow have to prove that he was bribed without providing any of the evidence. Tell me how that is a win for democracy

    I mean the executive has had immunity for the longest time - NSA, CIA, FBI, the president himself. It doesn't go to jail, it doesn't find itself guilty of criminal activity. The ruling was just establishing the rule that's always existed but giving a clearer definition for when it doesn't work anymore.
