    Thanks for being with me while I clean out my 86-year-old mother's garage. I made it through and shredded an entire box of banking from '77 to '84. Ugh... They kept EVERYTHING!!! Tomorrow is banking from the 60's and late 80's taxes. Yippee! But, it'll be easy with EDB in my ear.

    I gotta say, this is the first trial where I’m decently impressed by both sides from the opening statements (defense had some slips but otherwise still a decent outline). Pretty excited for the rest of this trial!

    Defense seems to forget one of the people in the chain of custody they mention that ensures there's no violation of safety procedures and suppose to help address them is a producer on the film... Alec is a producer on the film and the star , even if you could somehow not fault him for the pulling of the trigger (which I believe he's gulity/at fault of due to the evidence we've seen and the footage of the day in question but leave it in the hands of the jury), you have to look at Alec as the producer and ask "what happened regarding safety on this set that several crew walked off?"

    @@Ike_of_pykein the pretrial motion hearings the judge decided not to allow that he was a producer in at trial since he was a producer in name only as a courtesy which happens often with well known actors. The set had a producer who was actually in charge of everything including safety. Many attorneys have agreed this was the correct choice especially with the specific charges against him.

    I love the judge in this case. She’s so no-nonsense. I here for it. So excited for your coverage on this case. I don’t hate Baldwin like a lot of people on here. I’m really interested to just evaluate the evidence without the bias.

    I was a swimmer in high school and college and I once got DQed for something I absolutely did not do and I may or may not have told the stroke judge that if he had one more eye he’d be a cyclops. I feel you EDB.

    Spent most of my life as a professional actress. The defense's opening was very effective. They showed an everyday moment on set. The director says, "Whip it out," and Alec responds, "Whip it out? Okay.' Whipping a gun out is always dangerous... unless you have safety guards in place. The big hole in the defense's argument is that there had already been misfires that day. How can I, as the actor, "Whip it out" safely? I can't. The only thing making that action "safe" is a bullet-free set, and the misfires make that impossible. That leads me right back to Alec's being responsible. He knew there was a danger and did it anyway. How he held it doesn't matter that much to me. He knew live rounds had found their way onto the set. If you continue to "whip" a gun around at that point, you're being reckless. Period.

    Thanks for sharing your experience, I'm always looking for input from actors. My understanding was it was blanks fired when maybe it was supposed to be dummies or it was supposed to be blanks but the warnings weren't given and eat protection etc wasn't handed out. Horses startled etc. still dangerous and should have been something to make everyone go wait a minute, things need to be better or new armorer or something. I'm wondering what and where is the responsibility if the armorer and first AD are negligent in their responsibilities? Where is the check for that or do we just figure it out when someone is injured or killed??

    Honestly hearing how many there were and how they replaced all over the place just randomly, I almost feel like she did it on purpose so somebody would get hurt and somebody would take a fall and I don't know. It sounds like tin foil hat kind of thing but that's just not plausible that they could accidentally be in the truck, and Jensen's belt, and the gun, in the cart

    I can't stand listening to Morrissey. I didn't like her in Hannah's case, still hate her condescending tone, like everyone is stupid but her. So unprofessional for an attorney in my opinion. The other prosecutor.. Love her. So likable.

    The state has a huge burden to convince me that AB is responsible. He’s not a great person, but I do not see him being criminally responsible based on the testimony of the armorer in HGR’s trial - the buck stops at the armorer. The actor is not required to perform safety checks, and it’s the armorer’s and AD’s responsibility to ensure that the actor can focus on their job and be able to do so confident in the safety of the prop they are handling. Per the state’s expert armorer, it’s the armorer’s responsibility to make sure the actors are following safe handling practices and paying attention during safety/handling lessons, regardless of the environment and attitudes of the actors and crew. It wasn’t until the end of HGR’s trial that I could see the responsibility HGR had. I was very much on the fence throughout, and felt that others interfering with her being able to do her job was a problem for proving she was criminally responsible. But after the presentation of all the evidence and her multitude of careless actions, I agreed with the jury’s verdict. I’m keeping an open mind in this trial, but if he’s being charged for what he did as an actor and not a producer, the state has to move the needle on the fact that as an actor, he should have been able to rely on the safety protocols to be able to do his own job safely. Unless there are industry standards for how actors should and shouldn’t handle guns, I am not convinced yet that during rehearsal/filming actors should be following the same general gun safety guidelines we expect. I want to hear the experts on this again in relation to the actors’ responsibilities.

    There are industry standards for how actors handle guns as I understand it. I'm really hoping that is brought in. I can't say I agree that anyone can be free of responsibility in high risk situations. HGR is definitely responsible and so was Dave Halls, but that doesn't absolve AB imo. To me he is only innocent in that I require the prosecution to prove the elements of the charges to the Jury. It *should* be easy for them. But we'll see.

    I agree, I’m no Baldwin fan but I think the buck fundamentally stops with the safety crew. Regardless of whether AB was being flippant with the gun or not, it was HGR and Halls job to make sure that wasn’t happening and that AB was never in a position to hurt anyone, and they failed at that job

    This is the first time I struggle to be neutral before the evidence. How can an actor be blamed for this - whatever kind of prick they may be. This is the head of safety and armourers and suppliers problem. Its not foreseeable that a live round would be in there I just don't get it. Doesn't matter if he points it and pulls a trigger - it should not have a live round in it.

    Whatever the outcome, how awful must Mr Baldwin feel, regardless of fault, to be the person holding gun, he will always be haunted by this.

    If the argument is that Alec was in character and wasn't responsible for safety, then it's a great argument for actors never being able to serve as a producer. Conflict of interest, obviously. Can't have it both ways.

    Man, lawyers like Alan Jackson, Yanetti, Creighton Waters, Camille Vasquez, even Rottenborn have ruined me for trials! I was so looking forward to seeing these lawyers shut Morrisey down with her stuff but they aren't! Hopefully they are being smarter and playing to the jury who may also be annoyed, but it is very disruptive. Judge A and Newman also ruined us, i put a lot of blame on Judge Sommers. She has these super strict rules but doesn't them, which is why Kari does this stuff cuz she gets away with it. Judge is gonna take away their coffee. She needs a little more Judge Bev's jumping in.

    Not a fan of that defense opening. If I were on the jury I’d really have the impression he thought I was stupid-from all the “bang bang pew pew” sounds he made to simulate the firing of a prop gun. Erlinda, so far, is such a breath of fresh air.

    His opening gave me the impression that he did not bother to do any research on guns and gun safety for this trial, and he's contemptuous of gun people in general and quite possibly the jury in particular. I am not a gun person (I have shot a gun on one single occasion in my life) and I was offended and disturbed. I hope they didn't let any gun owners on this jury or they're probably already having some feelings about the defense's case.

    I didn’t get that vibe. I have been around guns and handled them pretty frequently growing up, my dad was a hunter. I got the feeling it more so infantilized the role of the actor, as it was probably intended to do. It demonstrated that the actor was playing make believe, just like he would if he was wearing a cape and pretending to fly. Just my thoughts. The state has a big burden given their own armorer expert in the HGR trial stated the actors are not required to do safety checks and the buck stops with the armorer, period. Imo, her conviction relied heavily on his expert opinion on her responsibility despite all of the rushing and distractions, and what she should have done and not done with the situations she was given. And that includes the rushing, not being on set and present during use of prop guns, actors mishandling the props and Baldwin not paying attention during training. Wouldn’t be surprised if the defense calls that expert (I don’t look at expert/witness lists in filings unless I see EDB go over it).

    @@shkrjam84 I'm surprised the prosecution is harping on Baldwin not being part of the safety check, because that was also what I got from that expert last time. To me, the problem is that he pointed the gun at people and had shit trigger discipline so he accidentally pulled the trigger. There's a video from that morning where Baldwin is handling the gun and you can hear the hammer clicking down on a dummy round. That video, in my opinion, is the whole case. Don't point a gun at someone you're not willing to shoot, and don't put your finger on the trigger of a gun (or even inside the trigger guard) unless you're ready to shoot.

    If you’re here but didn’t watch the Hannah Gutierrez trial- see if you can muster up like 3-4 hours to watch the opening statements, closing arguments, verdict and sentencing. It’s worth it!! You’ll get fully “caught up” and have a full picture of what happened after the Baldwin trial AND sentencing was so sweet 😂 (Hannah’s jail calls doomed her!)

    Yes, I would recommend that as well because almost all of the questions asked were already answered at the Hannah G. Trial and people who did not watch that trial are getting distracted rather than focusing on Alec’s culpability.

    Okay, but……. If the defense brings up the civil lawsuits, doesn’t that open the door for Alec being a producer??? They are not suing because he’s just an actor, but because he was a producer. Curious to see those witnesses come in.

    seeing the “hear ye hear yes bring the jury” bring EDB so much joy is such a treat to see. i had to replay those moments from day 1 they were so enjoyable lol. what a fucking STARK contrast from Read trial eh? From this new prosecutor Irlinda(?) - she is good. Morrissey just needs to sit down the rest of the trial. to the PD and investigators- SO professional and good at their jobs. a judge that manages a court room properly.

    Pretty sure Baldwin wrote a portion of his Defense’s opening statement…. When he starts referencing other movies, westerns ect; that were filmed at that ranch. It all feels so unauthentic 🤢

    Personally I believe it is mostly Hannah’s fault. However, it may be my background with guns, but the fact that he pointed it at people, cocked it, AND pulled the trigger just churns my guts. I want more info from people in the industry on how normal pointing a firearm at crew is. I understand it MAY need to happen actor to actor to get a shot, but crew?? It feels icky, but I’m unsure on the legalness. I guess that’s what this trial is for!

    If there weren’t live bullets on the set, this wouldn’t be an issue. There are movies where a real gun has been used to be cocked and pointed at the camera with people directly behind it and none of them are dead. Because bullets are never on the set of a movie… except the movie Hannah worked on… so… who is truly at fault?

    He didn’t point it at HER, he pointed it right at the CAMERA. She was the cinematographer. That’s a photographer but for FILM. He the gun was at the camera and she was next to the camera and was sh0t as a result of being near the cam. That’s why. The BIGGEST issue for me is that the crew walked out bc g u n s we’re going off on set willy nilly and instead doing a hard reset, they continued to be sloppy. EVERYONE. That and how he pulled the trigger and the sh0t didn’t call for that. Then he lied about it and changed his story.

    @@kateashby3066 They can't bring this up but he also didn't, as a producer, buy a replica of the gun that looks exactly the same as the one he was using, or buy a modified one that is literally a real gun but has been modified so if a bullet is set off the bullet physically can not fire out of the barrel. Those are the two guns you should have if you're needing to point it at ANYONE.

    I live in northern New Mexico, taking goes on EVERYTHING. There’s a restaurant here that makes a plate that has shrimp, cucumber, purple onions, tomato, avocados in Clamato and covered in tajin. It’s sooooo goood and perfect for lunch on a hot day.

    I need to hear from people in the industry about if it is normal for actors to point guns directly at the camera (and thus the cameraperson) and other actors. In my eyes, if the head of safety AND the armorer said the gun was safe, it’s reasonable to think the situation wasn’t dangerous. From the limited research I have done, I believe that actors do occasionally point firearms at others because THERE AREN’T SUPPOSED TO BE REAL BULLETS ON A MOVIE SET. There are different rules on a movie set.

    Same. I don't understand why he is on trial at all. If he had just picked up a weapon from a table or something and started messing with it and shot someone, sure, I can see how that would be accidental. But he was handed the gun after not one but two people supposedly checked and announced to a room full of people that the gun was safe, he did not load that gun or anything so how could it be his fault?

    Man, would i love to see Alan Jackson vs Kari Morrisey. I feel like he would shut down her nonsense. I was really hoping these "big city" lawyers would shut down her tactics.     I'm glad they brought in another prosecutor to temper Kerri's snark and tone, a little goes a long way. I do have my issues with Kerri, but all in all, dear god I do love her. Especially after weeks of Lally’s never ending drone. And if it is true that she is poking the bear, and I suspect it is, I am looking forward to her cross examination of him. I do hope the prosecution focuses their case. In my opinion this entire tragedy comes down to the fact that every safety measure utterly failed, and the ‘magic making’ actor not pointing the gun and not pulling the trigger at the camera during blocking was the final safety measure to fail. Other than the integrity of the fire arm, everything else is just noise and a waste of time. Unfortunately there are no set in stone regulations, every set has its' own rules. Hopefully this trial will lead to actual regulation on gun safety and how an armorer is to be qualified. There's a decent, albeit brief article on the subject by the BBC. An interesting note that the first two suggested rules are: 1) Blanks can k i l l. Treat all firearms as though they are loaded 2) Refrain from pointing a firearm at yourself or anyone else"

    Hannah’s case also had Carrie and one other prosecutor. That was a man, so I guess he switched with this woman. Carrie didn’t do opening arguments for that case either if memory serves me correctly.

    I am going into this trial looking at the situation like this: it's kind of like being sold a car that has been marketed as the safest car to ever exist. It very well might be. But it is still on you to ensure that it is a safe journey every single time. You are the one in control of it.

    I wonder if the evidence was collected in red plastic solo cups? It’s amazing how much more competent these law enforcement than the Canton ones. I would argue that they would have even less resources in Santa Fe and they actually followed rules of collecting evidence and found ways to preserve the crime scene.

However, I can see a liability as it was shown he was negligent with fire arms training. Should he be charged with the death Helena Hutchins, no. However some accountability should be charged.

    4:00 - absolutely not! I’ve worked in multiple factories and, even if I am friends with my co-worker, I will always inspect my tools before I start/change positions with someone. It’s my responsibility to make sure that I (and everyone around me) is safe. I cannot rely on anyone but myself.

    Yep, going to assume you also don't just randomly start playing with the dangerous tools while you're bored setting up for stuff. He should have NEVER touched that trigger or hammer for a blocking shot. And it's a gun that requires a two step process to fire, they don't just "accidentally" go off. He pulled the hammer, then the trigger, and was expecting it to not fire because "it wasn't loaded". That's literally negligence that caused a death. They literally have people disassemble guns brought into court they know are unloaded before it even gets into the court room to prove to everyone it's not loaded. The stuff Hollywood actors get away with, or try too, because "they're just actors" is rediculous.
