Come join me and Andrea Burkhart as I watch the interviews given by Brian Kohberger's former lawyer and share my reactions to them--I've been avoiding the content of these interviews so I could share my thoughts unvarnished.
Andrea's already seen them, and we may or may not agree on this one, but looking forward to finding out, and the discussion.

I absolutely love how Ian & Andrea humanized this topic. My father in law was a public defender and always said my job is to make sure the judicial process is done correctly and fairly as possible. My father was a probation officer and they both always tried to humanize clients and acknowledge that our social system is very broken; but they also had low tolerance for adults who make choices not to better their situation when given multiple chances. I’d love to see y’all with Rob discuss life in being lawyers.

I'm disgusted with the media over this case and their push to convict him in the court of public opinion before trial. This young man is up for the death penalty or life in prison and everyone is hopping on the media train without understanding the evidence at all. If he is the right guy then ok but if he is not then that is a huge problem and we shouldn't just want a conviction for a conviction. Justice is getting the correct person responsible and proving it with evidence. 😔
I understand they can't prove his DNA got on the knife sheath because he killed them BUT my question is; How did HIS sheath get into that bedroom?
Fabulous discussion Ian and Andrea, on such a contentious issue. I'm still not convinced Mr LaBar has acted ethically, but I can appreciate Andrea's points of view.

This defense attorney is from a “small town” and just wants his TV time. He’s not doing any of this out of the goodness of his heart.

My last job (in NJ), forced their employee's to do duties on-site off the clock. They would also trap you into work related conversations the second you clock out. This happened to me multiple times. The first time I did it, they stole 8 minutes from my very needed hour lunch break (preschool AT). So, I came back 8 minutes passed my eloted time and they gave me a verbal warning which I laughed at as I walked away. It's a chain preschool ran by 2 elderly sisters who lack the care of their employees. It was infuriating working for a company that would follow laws in certain situations but wouldn't follow laws in other situations.

Get the proof you can to substantiate, make notes, contact Division of Labor. Violating Fair Labor Standards Act is a big deal.
I had to join the replay crew for what I missed watching live. Ian I really enjoyed your interaction with Andrea. Her analytical, logical mind is amazing……. You two need to podcast together more often!!

Feel like the biggest vulnerability of this PR play is the prosecution asking the lawyer "so your client asked you to get on the news and tell people he was smart? And that he was calm? And that the evidence was shaky? Not that he was innocent, or a good guy?" "He didn't tell you he was innocent" is easy to dodge, but I see a path to showing him as an egotistical weirdo whose first reaction to arrest was "make sure everyone knows I'm a smart guy and that this was the perfect crime". How common is it for the defendant's PR people to get questioned in court?

First, what does a PR play get for you? Isn't jury selection designed to negate any and all PR? Second, I'd think a "I'm too dumb to have done that well" pitch would be an easier sell than "I'm to smart to have done that poorly".

Here we go again, last time I see this was on Scott Peterson case, he was dead before trial. I still think it was only a strong circumstantial case. He was convicted for cheating. BK is being convinced for studying criminal justice and being smart, maybe not that smart, but smart enough to had degrees and going for PhD. If we can’t discuss the evidence, why there will be a trial, why not hang it him in the tree already?
I went into this video thinking LaBar's media tour was completely bat$hit...but you two changed my perspective. This was insightful. Thank you, @ABurkhartlaw

This defense attorney did not have to make a statement and I don't think he should have. I don't think he should have said anything about the conversation he had with Brian. There wasn't just 1 interview. This lawyer was to help with extradition, he's not his defense attorney for trial so I'm thinking he should've kept his mouth shut!! After watching these interviews it felt like this lawyer was wanting his 15 minutes of fame. Definitely not that he had Brian's best interest at heart.
What a stimulating conversation! Two great minds educating the clueless in law… Like me. Thank you for your time and dedication to fairness.

I get what his lawyer said about the car. They had 2011-2013 model the whole time until they locked in on him they 2015 which it was his year. Does anyone know how similar or different the shape? He’s right. Cell phone ping is what 20 mile range. Especially in a small town. He could literally be at his apartment 10 miles away and ping there. Mine did that in my small town I grew up in. I was in my house 20 min away from a tower it pinged off once. It was strange. It’s stuff the defense will be looking into.

When I saw the servo pic of the car, I definitely thought it was an earlier model than the 2015. The headlights and rear seat window areas are different.

I agree. It looks really bad that an FBI expert stated a 2011-2013 car the whole time until they discovered Bryan's 2015 and then he decides to change his expert opinion to well it could be 2011-2016!! That is a huge red flag! 😳

Well It appears 2011-2016 was a “generation” model and very little changes made on the outside of the vehicle..

As long as there was no misconduct leading to a "fruit of the poison tree" situation, how they find the perpetrator should be irrelevant at trial if they can independently prove guilt. In this case, the DNA alone would be hard to refute assuming it's presentation is factually correct and it was done properly. All the car did was reduce the set of people to look at enough to make DNA evidence something that could be acted on. I wonder how it would work if the DA's case never said anything about how the accused was identified as a suspect and just started with "this is how we know they committed the crime"? They jury might find that odd, but I'd think the defense would be reluctant to be the one to bring up even shaky circumstantial evidence linking their client to the crime.
The only way I can see he has a chance at a life if acquitted is if DNA and other major evidence clears him and shows it’s someone else, even then until a person is caught still probably not. It’s sad IF someone is acquitted they should be left alone.

I think they have a lot more evidence than they put in the affadavit. The judge is giving gag orders left right and centre, the prosecution seems to get nervous about what the connection might be(i.e.: mad greek connection, following the victims on istagram, etc). In the SW they listed a whole lot of stuff they seized. If one of those are evidentiary, like he cyberstalked them, one of the hair strands are a match to any victims they will have an iron clad case. We didn't hear about the search warrant for the car (I guess it's in Pennsylvania, bc the car is there) there could be blood evidence. We just don't know what they have, we only have what they presented for a PC.

I thought the gag order was asked for by the defense? I agree with Andrea that from the beginning this seemed like it was done with BKs permission… but then it seems like a grimy underhanded way to gag the prosecution but put out statements from the side that wanted the gag in the first place - and I wonder if it was done without the knowledge of his current representation.

Many times gag order is to help it the defender, but in this case, after all they allowed out, and the presumption of his guilt, I don’t think it will help it him, not at all. Not many channels are working with the innocent until proven guilty, it is a horror of the times we are living.

I enjoyed you two together and I learned a lot as usual lol I am a bit confused at him being named his attorney, but was he not his attorney, but just a public defense lawyer who was watching out for him as he was transferred to his attorney in Ohio? And for someone who does not believe in the "social network" he sure has made a presence there. At any rate this was a very interesting "live" ;) Also your pouch is really nice and love the color.

I made the mistake of looking up Lindy Chamberlain and now I’m going to go have a nightmare. worst story ever.
It doesn't help if Kohberger doesn't talk to police if his Lawyer immediately Does! And says everything that Kohberger said to him, such as "it was a little out of character for me" to get arrested for four murders.
I watched the live podcast and the only thing I got out of it is that she admires the PA public defender because he puts on such a good game face; And that you both believe there are holes in the PCA. From a juror's perspective, I myself would need more DNA than just one little fingerprint on a sheath in order to convict. So it all depends if the LEOs found the victims' DNA in BK's car & apartment. I am guessing they will. If not then this murderer will walk free.
Andrea, I'm a big fan, but you have completely flipped your position. I heard you on someone else's show saying you were contrarian on this issue and thought he did absolutely nothing improper in these interviews, and you were even a bit mocking that anyone was saying otherwise. Now you're agreeing with Ian that if he doesnt have permission his career is over. What gives? I hate to doubt your sincerity but I'm struggling to reconcile this. You'll never read this, but I'm troubled

For me the biggest red flag is the language that the lawyer made it very clear were Bryan's own words. If Bryan wanted that message to be reiterated, "I'm eager to be exonerated" not "I'm innocent" that is very telling to me. If it were me the message I would want pushed to the media would be that I was innocent but also I would want to express concern that the police may have stopped looking for the actual killer. I would want to urge people to keep looking for evidence bc the killer was still at large. Everything the lawyer said came directly from Bryan had an arrogance that made it seem like he felt he was untouchable and showed no willingness to put forward an alternative narrative where he was not the perpetrator. Innocent people are desperate to prove their innocence.

Exoneration is a very strong legal term for being cleared from blame or proving one's innocence. Due to his major I'm not surprised he used this word as it's a much stronger way to say he is looking to be acquitted but not by a mere technicality but by being cleared from blame.

@@heathermosher7384 I see what you are saying, I just feel like that wording left room for interpretation which isn't great. And in one of these interviews even the lawyer had to go on to say that he believed that Bryan meant that statement to mean that he was innocent, which I think sounded really bad!! As a layperson, I took his statement to mean he believes he will be acquitted, that he might think there isn't enough evidence to convict him, not necessarily that he is innocent.

At least there`s some evidence against this one . The Delphi case makes me worried if they picked a random guy. They talked to him 5 years ago nothing has changed all of the sudden someone new looks at the same evidence and says oh hey that one.

@@jencendiary but we watch this for analysis. We assume he'll get a vigorous defense in trial. People have been sensationalizing crimes forever, and people still get fair trials.

Runkle is married & very happily married may I add! But they are 2 very logical & great minds, so I understand seeing chemistry.
I do not think Dylan, she has ever told the truth and he is not the guilty person. That is my personal opinion!
Maybe, he dropped off spmeone and rode around till he had pick up the person? That the one who did the crime is not him but a driver
Chandler Haldersons defense was absolute nonsense. I suspect because the evidence was insurmountable. Sometimes that is the case
I understand innocent until proven guilty but Andrea’s giddy and excited demeanor here rubbed me the wrong way personally. It might be that she’s just able to separate empathy for the victims easily and that’s a good quality to have as a defense lawyer but to a layperson it’s off putting. Giggling and being excited about defense strategy for a man who possibly murdered 4 people is hard to swallow. There’s a way to be analytical without being void of empathy. I get that defense lawyers are valuable and defendants do deserve rights to prevent wrongful conviction, it’s just people also died.

I agree with you. Inappropriate laughter can be very disturbing. I paid someone to fix my truck by replacing clutch parts with $160 parts. I paid him $200 for labor. He told me one of the parts was defective & called the parts place about replacing the part. The person said it could be replaced. The mechanic did the work in my yard. My vehicle was down so I let him drive into town to replace the part. After that (unknown to me) he pretended to fix my truck. Then he took that part back & got another part because he said it was also defective. Then he went back & took all of the parts & got a refund on my purchase. I called later & talked to a man who reviewed my records & said no exchanges were made. Later I talked to the manager who reviewed my records and told me everything the mechanic did. She gleefully told me the mechanic did a ROPE A DOPE on me. She said the mechanic ripped off the parts place. (In reality, he ripped me off.) She admitted the transaction should have been stopped. She did nothing to talk about refunding my money. The sheriff blew off the theft because it was a small claims court thing under $1400. He said I hired the mechanic & therefore I gave the mechanic permission to work on my vehicle & get my refund. He as good as laughed it off too. I called the complaint dept. for the parts place. I was told to take it to small claims court. The mechanic also disconnected the speedometer & left out bolts & disconnected the oxygen sensor & left off some other parts. He sabotaged my vehicle. I have to save enough to pay parts again + paying to tow my truck 20 miles to a Ford garage + paying $200 to get it fixed again. If I take the mechanic to court I have to pay the sheriff fee to serve him + small claims court to handle the case + subpoena fee to get records from the parts place. My truck has been down for 6 months because of this. There is nothing funny about this. I thoroughly agree with you about inappropriate laughter.
seems like a very strange case. there are a LOT of coincidences on one hand, but a lot of them are very weak/unclean. kohberger should be handled like every criminal ever. > innocent until PROVEN guilty

This is why your in my top 3 Ian. Instead of they have this and they have that for evidence you are one of two who said wait what does this actually mean and show that just because it’s there doesn’t mean it’s evidence of his involvement. Always remain objective till all the evidence is shown.
First time to see this channel. The perfect crime doesn't sound right - stalker sounds more likely. With all the periphery coming out - drugs seems to be written all over it. Is that too easy of a motive...
Runkle, you should read the actual case for the lawyer dog thing. The opinion is more about the equivocating the detainee did ("maybe I should get a lawyer") than it is about him appending dawg to the end of his statement. He was never definitive about asking for a lawyer. (The idea of lawyer dog was only brought up in passing in a concurring opinion). I feel like the lawyer dog myth is almost to the "shouting fire in a crowded theater" legal misconceptions.

@@RunkleOfTheBailey I also looked it up myself again, and what I said was an incomplete picture. It was a concurrence, but there wasn't a written court opinion. And what he said wasn't "maybe" but was conditional/equivocal.

After watching this and hearing your views, it made me wonder if this lawyer knows the family and is trying to do something to help get an acquittal? More egregious things have happened 🤷♀
An interesting episode…as always, but wsy too much giggling from your guest… that was annoying. And… The wounds evidently were from a K-Ba=r type of knife..,nitva kitchen knife.
