Karen Read Trial Recaps - Day 29

So, today we have Lucky, we have defence experts, we have Lally's first chance to cross-examine witnesses. This is the first time the defence actually gets to call evidence in their favour. Let's talk about how they did.

    One of my daughters has been a vet tech for over ten years. I was watching Runkle’s recaps one day and they put up the picture of John O’Keefe’s arm. My daughter was walking through the room, saw the picture, stopped and said, “That’s a dog bite! A large dog.” I paused it and she started pointing out all the different aspects. Then she added, “I think it’s a failed K9,” and after explaining why, she asked if that was right. I was floored. I figure if my 32 year old kid knows, then why can’t these people figure it out?

    I work in vet med and was bitten by 13 pound chihuahua that was owner aggressive. I ended up with 1 top and 1 bottom puncture wound on my hand between my thumb and index finger. Despite immediately going to urgent care, them cleaning it, starting antibiotics, and doing exactly what I should've done it got infected and I spent 8 weeks in treatment and my hand sustained soft tissue damage and muscle damage. My hand may never be the same. The dog had her full mouth on my hand but only ended up puncturing with 2 teeth. Dogs bites aren't typical. Because of the nature of dogs they can vary widely. Lally trying to trip Dr. Russell up was super disingenuous to me and he knows it. After he put up Proctor and Paul for him to try and discredit Dr. Russell by misrepresenting facts felt purposeful and he should be sanctioned. Dr. Russell stood her ground and was very believable and likeable. At this point I can't help but wonder if Lally is trying to torch his reputation and the Commonwealth on purpose. Attacking likeable credible, educated witnesses in front of the jury never goes well. His attempt wreaks of desperation.

    Attacking likeable, credible witnesses is going to disgust the jury, if they aren't already, & turn them against him. If he didn't already have a problem with the jury, he will but he does, as I understand it. From what I've heard, the jury has been trained to go to sleep with Lally's drone begins & not perk up again until a defense atty gets back up.

    Sorry to hear that crystal. Dogs mouths are a problem. I got bitten on a finger and had to go on antis too.( under 24 hrs) They have to get a special authority from the capital of OZ to use them . She held her own. If the jury don’t believe her they are stupid

    Oh my, that had to be incredibly painful; there are a lot of nerves, muscles, and tendons traversing that web of area. I'm sorry that happened to you. I hope no further damage progresses and perhaps finer motor skills will improve.

    I have very little respect for Mr Lally. But this was amomg The worst. You want to make Lucky look bad, confront him with a time card. Not a freaking police report! You have to know that this is overtime for all these people.

    He and Binger seem to be fighting for first place. They both tried to get the defendants' smart decisions to get lawyers against them. Binger won that battle because he actually did it in front of the Jury, which was worse than making the motion outside of the jury's presence. Though Lalli gained some coward points for forcing his assistant to argue a motion he knows is reversible error. They claimed the search happened before she was interviewed by Police and intentionally left out that the lead investigator called her from his private phone minutes before she searched for a lawyer. Binger also won another battle because he continued to keep a charge against the defendant while knowing that there was zero chance of the charge standing. The physical measurement of the evidence proved it did not fall under that law, & should have never been charged. Lalli still has a way to go, so we will see who wins the war!

    The prosecuter is good. He's not into the TV theatrics like the defense using smoke and mirrors and hyperbole. It's not a soap opera, it's court.

    Dr. Russell may be retired, but I bet she still holds her license to practice which requires being up to date in education. And on the off chance she does not, which I doubt, does anyone actually believe after hearing her history that this woman is not still reading the literature just to relax? And she still actively consults.

    I believe she does still consult in LA. She tried to say that on the stand to Lally the other day but he repeated it as being many years ago. But, she did mention that she still gets called in by the coroner from time to time. At least, that was what I thought she said, but I might need to rewatch that part.

    Using Ms Little was a GREAT choice for the medical examiner. She wasn’t going to sound like she was bullying her. Judge Bev is more neutral on her since she barely did any Crosses (I believe she’s got a ton more experience with investigation, research, and writing motions) in this case, so she hasn’t pushed Bev any. It worked out. The ME was more comfortable with her

    The Lucky thing just shows Lally is zero judge of character. Of course Lucky would know these details, he's exactly the kind of person who notices these things.

    ⁠​⁠@@RenataKleinRKthe original comment I think overstates how much we really know about Lucky, and then this one does the exact same thing. There are plenty of intelligent or knowledgeable people who aren’t doctors, lawyers, politicians, or whatever. There are plenty of construction workers, blue collar workers, service industry, etc. who are just trying to make a living and are more than competent individuals. There’s so many factors that lead to a persons life path, and to conclude what you did is simply hubristic. He also did not come across dumb at all, I think that may be your bias based on socioeconomic status and not anything that actually happened on the stand. He was articulate, answered lally’s questions promptly, and even surprised him with the tail light question. I’m sorry, if you watched this trial and are concluding that Lucky is one of the dumber witnesses, that’s absurd. Some of the Commonwealth’s witnesses have seemed less than competent and have not been nearly as articulate and consistent as lucky was.

    ​@RenataKleinRK the best truck drivers I've ever met have done that their whole life.....he didn't kill anyone driving a pizza car and didn't kill anyone yet with a plow. I'm guessing he at least knows how to observe a roadway. I'm a tradesman and hunter, at work and in the bush my eyes are very different than a lawyers eyes in industry or in the bush.

    ​@Songbirdstress I agree about Lucky likely being neurodivergent, and that probably is why he has a good memory for things that are outside the routine. He comes across as someone who was pushed around, used, or manipulated by peers and has learned to stand for himself and trust his memory or perception. He recognizes that people will try to use him and refuses to get drawn in or take the bait. (I'm acknowledge that I am totally speculating and reading way into what I observed. I am biased, being neurodivergent myself so this may be revealing more about me than Lucky.)

    Lucky probably could not tell anything but the truth. I recognize his behaviour, demeanour and speech patterns. My daughter is on the spectrum, diagnosed with nonverbal learning disorder at age 11, and Lucky’s presentation is very similar. People wth NVLD do not “see” all the nonverbal cues so don’t understand if people are sceptical, bored or irritated etc and basically have no filter. They can also hyper focus on one topic and know it inside and out hence he can easily explain the difference in the two vehicles when prompted. Also rules are hard and fast so if he was to be at work at 2:15am he’d be there right at 2:15am

    I also think this is why proctor discounted him as an "unreliable and inconsistent witness": the ableism that denies that neurospicy adults are, in fact, adults, and that neurospicy folks can give you good info. I bet they just never gave him the time to answer their questions (he tends to pause and then speak slowly)

    I really liked Dr. Russell, so I was sad to see so many people saying she was not a good expert witness and basically trying to tear her down. For me, she and Lucky were the best two witnesses in the entire trial. They were both very respectable and polite and they stood up very well against Lally's attempts to discredit or impeach them.

    2:20:55 lmbo, that's not why Lucky's the scariest witness, it's why Lally's the dumbest prosecutor. Rule Number 1 of being an attorney: Don't ask questions you don't already know the answer to. It's only a "gotcha question" if he _knew_ that Lucky couldn't answer it - now it's a shot in the foot question. If you don't know for sure 100% that the witness can't answer, don't ask. Lally walked himself into a minefield and misstepped.

It's like Runkle was saying, you don't get hostile with the witness until they deserve it, because then you lose points with the jury. He did everything short of just outright calling the man stupid, and Lucky knocked him on his ass.

    That Boston Herald article about Lucky is hilarious and worth reading! And I cut & paste: "Hos refreshing after all the prosecution’s witnesses - sweaty, dissembling, mealy-mouthed cops, shady “experts” and full-blown drunkards, or all of the above." The article also confirms that Christ Albert has a LIGHT colored Ford Edge, and that Chris Albert killed a foreign exchange student in a hit-and-run accident. uTube doesn't seem to want to let me include the link, but if you google Boston Herald and "Howie Carr: Plow driver only honest man in Karen Read case" you'll find it.

    During Lawyer You Know's recap, Peter started giving some points to the CW when Lally tries to impeach Lucky with the report with all the different times and conflicting details. Then the chat started to flood with comments that Proctor wrote the report. He took it back immediately 😅 ahhh this case.

    This part confused me as Proctor (“apparently” to quote Jackson) interviewed him on 10 August 2023 (according to a defence filing), the defence investigator interviewed him on 15 February 2022 and the FBI at some point in between, so not sure if it was the FBI or someone else, given Lally not stating who the interview was with

    Not to mention Lally just lies to try to “catch” people. Lucky has never changed his story I read the report and it was everything he said. Lally also lied to Dr Russel saying she had Boston Globe for 12-18 months when she clearly said in Voir Dire 6-12.. not that it even matters but he’s playing dirty!

    Proctor interviewed lucky in may of 2023 and the fbi interviewed him in august of 2023. Before proctor interviewed him the defences private investigator interviewed him.

    I haven’t heard any law nerds tying together the snowplow operator’s testimony that he saw a ford edge at 2:30 am parked along curb in front of area o’keefe was later found with the timing of jen’s 2:27 am “hos long” search. The likelihood of the search time is bolstered by the sudden appearance of the truck and both events appear sinisterly connected. 2:27 “hos long” by 2:30 truck obscuring area where OK is later found. IMO the defense should link these two events in closing.

    Wow Lally really pissed me off going after the dog bite expert. Because of my line of work, I have been bitten several times by animals, and it was always just one part of my body. Being full out mauled by a family pet is extremely rare. Lally go talk to veterinary staff to answer that question.

    I really strongly, dislike the way Lally tried to mess with Lucky, it was tricky and dishonest. He also misstated what witnesses actually said many times. So far his cross has just made me hope he finds himself a part in the investigation done by the FBI because he borders on unethical at times. Bev though is a master of walking the bias line, just makes me think she has been at it longer and is better at it .

    I would have asked “Hypothetically doctor, if I was the lead investigator on this case and came to you and said we have three possible theories we’re pursuing & could use your expertise to assist us in which more closely aligns with his injuries so we know which investigation to follow. One: Officer O’Keefe was hit by a rapidly reversing car - whether accidentally or intentionally - and left in the path of the approaching storm. Two: Officer O’Keefe was assaulted by one or more individuals & one or more animals, then left or placed in the storm. Three: Officer O’Keefe slipped & fell on icy ground - possibly multiple times - resulting in his being unconscious in the storm where an animal happened upon his body. Using your decades of experience determining manner of death & seeing similar injuries on others, which investigation path would you recommend us to pursue?” If I was a juror, and Lally suddenly found he could speak clearly, loudly and at speed, after spending almost a month stumbling, adding unnecessary words, and having to be reminded at least every 30mins to speak up, I’d be so freakin’ furious. It was clearly an intentional choice.

    As someone who has been bitten by an overprotective dog. I got one bite to the meat of my hand, and it didn't break the skin. Then he realized I wasn't trying to do anything wagged his tail and ran back to lick the little kid who ran out of the house when they were not supposed to. So yes to one side of my body.

    I was bitten by a German Shepard when I was a pre-teen. He was known to be a bit dangerous but he was generally well handled. I was playing a video game with the god-daughter of the dog's owner after playing with the dog all day. I said the dogs name and turned to look at him. He heard his name and jumped up just as I turned my head. My hair whipped against his face and he snapped on reflex. He stopped as soon as he realized his mistake. One single top fang penetrated my cheek, lucky a safe distance below my eye. I still have the scar 35years later. It's small, the injury was small, even though it bled a lot at the time. That dog was capable of inflicting serious damage. The fact that I had such a small injury doesn't make it any less of a dog bite.

    My dog broke free from our yard and gave "warning bites" to a woman walking by - several bites, all in the same area on right leg. She was an attorney too, but she was extremely gracious about it, very kind.

    I was bitten in the face by a dachshund when I was three. It was really a nip, the dog tried to correct some behaviour of mine and it wasn't deep. Still I had the marks for years and when it's really cold you can still see where they were fourty years later.

    I worked at vet clinics for years. Most of the dog bites I saw were to one area of the body for dog to dog and dog on human bites. Usually dogs would stay in one area and try to clamp down, only repositioning when they lost grip. That’s just in my experience. I thought Lally sounded like an idiot when he tried to suggest that John O’Keefe would’ve had bites all across his body. That’s way less likely to happen imo

    The leading was absolutely insane with all of the prosecution's expert witnesses. Lally would literally state the answer he wanted knowing that there was going to be an objection and that it would be sustained. Then he'd just ask the generic version of the question and the witness would just regurgitate the answer he provided to them in the leading version of the question. After two or three of those in rapid succession honest judges will reprimand the attorney and let them know that it's clear they're doing it intentionally and that if they do it again they will not be given the opportunity to restate the question in a proper form.

    First time commenting from Chicago and I am 78! I enjoy you and Emily so much and watched every hour of this trial. I feel KR was framed, and no one pays for my opinion. I must comment on the drinking and driving. I grew up with that and know the trauma of the alcohol rants and domestic violence. I am concerned for ALL their children. Choices & consequences. Adult Children support groups help with healing and forgiveness. ❤❤❤❤

    I got a totally colorblind friend who's a video game artist. He does really cool artworks and he did something for me. He only sometimes has difficulty with shades of different colors that would look the same "grayscale". Like a light purple can be the same as a light yellow, he'll ask someone that can see colors then but otherwise has no problems at all. (it's also really great if you want to add accessability options for your video game to know someone who can't see colors.)

    Runkle you are just a truly kind soul. When you teared up over Captain Cory I lost it!! I loved what JD did for him and I watched every video of his. Cory is a true hero always looking out for his family before his own. JD bought him a gaming console with all the fixins but Cory asked for his mom to get a new one and ended up getting both. On a different note! I wanted to say what I think happened. I think O’Keefe got attacked by the Alberts dog in the basement and because O’Keefe was drinking a lot he may have lost his footing and fell back hitting his head. That’s why the Alberts fought so hard to make sure no one came in the house to check it. They redid the floor and moved! These are my thoughts what do you think?

    I've been bitten by a large German shepherd. I was 6 at the time, and the dog went for my throat. Thankfully, it only managed to bite my ear, but it did tear it, and i required stitches. The reason it only bit my ear and was unable to grab hold of my throat was because i saw it coming and i moved just in time.

    That's a big aspect of this. John was no doubt trying to stop the dog from biting. And it's entirely possible someone even stepped in and tried to stop the dog. I think there was an altercation that the dog got involved in, but I don't think any of them set out to kill him at that point.

    "Spontaneous deletion" is not a real term used. It's just some bs that Lally made up to sound fancy. But what that is referring to is that as you make phone calls, those calls are saved in a log. That log goes back something like 2 years. If you were to look at the call history on your phone, you could scroll through it until you finally get to the end. But eventually, the log list gets full. So, that's when your phone begins deleting the oldest call first to make room for the newest call you make. If your list is full, and you make a phone call. That new call will be stored by deleting the oldest possible call you made however long ago.

    Actually Dr BA Grandma has been consulting off autopsy photos for 35 years, so we could say she's an expert in that.... All Lally proved with the dog dentistry stuff is she probably knew about the bad science stuff BEFORE the article. would be hilarious if her work were quoted in the study lol. I bet she would have said it looked just like what K9s are trained to do, now where do we have cops and police dogs....? Lally is talking about "a report". How would she know if she read it or not? Which report? Can you show me, because it's not clear to me.

    I think she would’ve said it doesn’t look like a trained dog. Trained dogs are taught to bite and hold, this is something that does much more damage generally. Incidentally it’s what dogs often fail training for. The majority of canines prefer to bite release and rebite, this is what the arm pattern shows more, shallow bites that don’t gain as much purchase (especially through clothes) it’s why there are few actual puncture marks and more scraping type marks. Only the pointy, thinner elbow shows a pattern that points to more too a 2 jaw hold at all. The rest all look like top teeth scraping down the arm. It looks more like a domestic or maybe part trained dog. Wild dogs more likely to rip and tare because they might mistake us for food, domestic dogs want to scare us rather than eat us. Trained dogs are trained to bite and hold a suspect on limb if possible till their partner can get there. Sorry I’m a nerd about dog bites and training cause my dog is large and reactive so it’s taken ages to get him to be a good canine citizen.

    @@Inaconstantlychangingworld24 I’m not sure if they proved that in trial, I think the story that came out was she was a rescue, but yes either way it fits what we are seeing here. Other than that I totally agree about the pointlessness of the odontology article. I’m trying hard to stick to what the jury would hear generally and I guess it’s Lally style plus my own interest in bites that makes this all so frustrating. The jury won’t get to hear anything but what they hear and his dishonesty feels like he is skewing the trial rather than honestly trying to catch the real culprits here. (I’m watching from Australia so it’s easier to be unaware of other sources of information too.)

    3:00:00 - In Lally's questioning of Grandma, I think the concept that Lally's desperately trying to avoid regarding the kinds and types of dog bites that Grandma would have seen in the ER is a form of survivorship bias/reverse survivorship bias. In this case, the bias is towards those dog bites that require the skills of an ER to treat and cannot be treated by the average person at home. Those would be the worst-of-the-worst, and would trend towards untrained dog attacks versus trained/professional dog attacks (i.e. Police dogs).

    @@mostlysky55there is a 2020 LA Times article about Dr Russell that confirms this, though it doesn’t say how it came about. She has a lot in common with JO - cop and responsible aunt. As an educated, professional woman (unmarried), she has a lot in common with Karen. Interesting confluence of personal facts. What a case.

    Sorry to hear about your troubles with a vexatious litigant. I'm also currently being sued in Ontario. The plaintiff in my case was declared a vexatious litigant at the HRT and has had their licence to practice law suspended. I don't want to provide more details but I can understand the frustrations of defending a case that shouldn't exist at all.

    Only caught a bit live, so I'm here watching on replay. I vividly remember being bitten by a neighbor's rottweiler when I was like 13 (note this was absolutely my fault. My mom had pat it's butt not knowing it had a butt tumor. The dog yipped in pain and kinda huddled in a corner. Young and dumb me wanted to pet the dog and comfort it, but let's be real, I was basically cornering a dog that was scared and in pain. Everyone agreed, absolutely my fault and I was fine in a couple weeks anyway) So, yeah, the dog bit me exactly once. Bit hard enough into my hand to break skin, let go pretty quick, and I backed off. Now, this dog was obviously faster than me and definitely could've gone for bite number two. It did not. So, yes, I absolutely believe it's normal for dog bites and claw marks to be in only one area.

    😂😅 I used to date a military guy who lived w/roomates who were also all military. We walked in one day and my guy was like, "C! What're u doin ma?!" I was behind my guy & didn't see C right away. I heard him say, "Sarg said I have to fix my hat." My guy started laughing and C said a choice swear word. I peaked around my guy and C had a hat in one hand (standard green camo) and an orange highlighter in the other. My guy was like, " dude, your marker is orange." Apparently, they liked to refresh their hat colors with sharpees if they were otherwise in good condition to put off replacing them. As we walked away, my guy told me that C is colorblind, only sees in shades of gray, and his job in the military was to sit in front of a giant console, monitor it, & keep a record of flashing lights. None of the roommates were sure if he had like been punked. But, C taped letters and numbers to the console and created a system for recording the things he needed to, so, it was fine. I don't think I'll ever forget Cs face when my guy told him the marker was orange tho. And they sure teased him a lot (bc why didn't he notice it was a highlighter lol).

    On replay crew here! I was mauled in the face by a wolf-malamute mix when I was a child (I was 5 years old). I had significant injuries. Some of those included scratches and punctures that resembled what was on JO’s arm. I had been knocked down and yes I had scratches and they were on my neck, chest, and arms. I VERY MUCH remember seeing the puncture and tear marks, and there were also photos. I personally do believe this is a case with an aggressive animal involved but I could be wrong. I wouldn’t be able to vote guilty aside from this one issue, there are so many questions still.

    1:14:56 her facial expressions say it all too - with Lally, her brow is furrowed and she looks serious or annoyed. On cross, her face totally relaxed and she smiled. I agree she has a theory on manner of death but because the investigation notes exclude the house and any possibility of a dog or fight, she had to go with undetermined.

    The thing is, even the public has heard rumblings about matching specific teeth marks to someones teeth is iffy, but being able to tell dog teeth *in general* from humans or cats or car crash scrapes, etc is viable and that makes sense 🤷🏾‍♀️ i dont expect everyone to know or think the same thing but Lally's insinuation is sketch especially if you've even been bitten by any animal

    Considering that they planned from the beginning for this to be a long trial, it is very likely that many of the jurors are retired. In general, retired people have the ability to take 2 months out of their lives to serve on such a long case. I have a feeling Lally's ageist comments to the dog bite expert will be hitting those older jurors wrong.

    I really want to believe we’re definitely at reasonable doubt, BUT also when I worked at a hockey rink I got asked all the time if it was cold where the ice is. We overestimate the general public’s logical/critical thinking skills. I hope defense spells it out as easily to understand as possible during closing arguments!

BUT when asked “even if you *had* been what would’ve been your response to that?” the ME said “My response *WAS* that I am responsible for what goes on the death certificate…” 20:35 Lally asked a hypothetical “even if you *were*, what *would’ve* been your response” and the ME answered “My response *WAS*…” May be nothing, but i found it curious/interesting.

    My brother got bit by a dog. Dog was sleeping on his side, my brother (he was a child then) pulled him by his paws, wanting to wake him up. Dog woke up, and as my brother was bend over the dog, the first available thing was his face. Dog grabbed him by his face, both chicks (top teeth on one cheek, bottom on the other), he sustained very similar patterns as in the picture of John's arm, just not as many. Dog had ability to grab his arms, legs, shoulders, neck, but didn't bite anywhere else just the face. So the representation by lally that you would expect more parts of the body get bitten is blatantly false for most domestic dog bites.

    I've come to the point where I think there was an altercation, the dog got worked up from said altercation, lunged at John, he lost his footing and hit his head. They all panicked, because they're drunk and cops at a cop's house, Karen and John were already fighting, and now we're here.

    this is also my theory but I can't get past a bunch of normal people taking a guy who is alive but injured and agreeing to let him die in the snow. Cos he died of hypothermia, so he was alive when he was put there. And then everyone agreeing to say he never came in the house and agreeing to the whole cover up. It seems like a lot. But there's no way he was hit by a car, those injuries just don't fit

And if he was already unconscious and they weren’t 100% sure he was dead, that would be a way to finish the job without further suspicion for them.

    Yeah, Turtleboy's colorful. It takes a certain personality to want to hear all that & I don't. I'm glad he's dug all this up & brought everyone's attention to it. At the same time, I'm sorry he's been attacked for witness intimidation cause that's gross! They went after many people just for being friends with Aiden, seriously harassing people who did nothing wrong. I believe they'll drop all this after this trial because they don't have a case. Witness intimidation of Brian Albert? He's scared of Turtleboy? That's seriously stupid and I can still hear Jen McCabe at her TRO hearing begging, "can't you make him stop blogging about me?"     Jesus. Hearing "um" so many times from some of these witnesses just kills me. Us Brits (not trying to say we're better in any way!) tend to not add these conversational markers in after almost every word we speak, so its very off-putting to hear it said so many times. It sounds so juvenile!

    We do. I spent a good deal of time public speaking and training myself to eliminate “um.” It kills me when one slips out. 😂

    @@jborrego2406 No we use it too, but nowhere near as frequently. We tend to just go silent until the next thought/word comes to us. If it was a ridiculoulsly long pause then we'd of course address that, but it's not usually an issue.

    If you look at the arm the right way up (the photo is upside down), you can see she grabbed his arm with her teeth and scrabbled, right left with her claws twice in the main attack Being friends with my local bus drivers, Lallys question was not that good. They changed a school gate near me on their school run, and two hit it because the bus was new and the turn too tight. So

    Which one do you think is upside down? His torso is above the arm with shoulder to the left in the one they displayed during Dr. Russell's testimony.

    @LaCasaAcademy The marks are upside down as to where they commenced and finished The autopsy rules and viewer commodity don't coincide It's easier to turn the photo round to make sense of the bites.
