Alec Baldwin ‘Rust’ Movie Shooting Trial Dismissed After Prosecutors Withheld Evidence

On day three of the Alec Baldwin trial, things stayed heated as Baldwin’s defense attorney hammered numerous witnesses on alleged hidden evidence. Defense attorney Alex Spiro got irritated and even threw his hands up when questioning a detective. Later, a hearing took place where Spiro claimed he had “never seen so many issues during a trial.” This led up to state prosecutor Kari Morrissy taking the stand herself where she was hammered about withholding evidence and calling Baldwin derogatory name. Judge Sommer ultimately dismissed all charges against Baldwin due to the state withholding evidence.

Baldwin’s armorer, Hannah Gutierrez-Reed, was convicted of involuntary manslaughter and sentenced to 18 months in prison. A judge will rule on these issues after hearing motions from the prosecution and Baldwin’s defense. Baldwin was indicted on one count of involuntary manslaughter in January for the death of 42-year-old cinematographer Halyna Hutchins.

I would suspect everything would or SHOULD be turned over so the defense could do their own investigation. I would also hazard a guess that the prosecution does not get to decide what is evidence and what is not. I guess what I’m saying is, they can’t decide what is NOT evidence.

That saying generally has a negative connotation, but figuratively speaking - yes. I was a little worried about his performance at the start but he quickly warmed up and worked the witnesses quite impressively. To add, I wouldn’t be surprised if the heavy media presence threw everyone off a bit anyways, I’m sure it’s a little anxiety provoking knowing that thousands are watching your every move live online and on TV. Lol

8:03:15 "and you all agreed to put it on a separate file" this is where this case unravelled. The lead investigator admitted that she and the prosecution actively took a crucial proof from sight. After this the judge had to throw the case away.

Kari Morrissey is arrogant, full of herself. She wanted that 15-min of fame. The other prosecutor resigned cause she didn’t want the trial to be public. But Kari Morrissey wanted so desperately to be household name, instead now she is prime example for law school.

MY point was that she was NO more arrogant (and I actually think she was less) than the rude, cocky, smug defense attorney. You cannot love one while hating on the other ... unless you're biased, of course.

The state/prosecutor, on the other hand, has an obligation to be fair, impartial, and provide justice for the tax payers and citizens who are paying for this trial. You need to watch more court cases if you think Baldwin defense is out of the norm here

Kari Morrissey was a piece of work! Her demanding demeanour and verbal attitude frustrated me to bits! She truly acted as though she was controlling the court! Hiding evidence in this case is absolutely atrocious! I'm glad the Judge saw this as well, you could clearly see she was fed up, the lack of responsibility and accountability from the analysis team and forensic team, is a true reflection of law enforcement!

I would just like to make a comment about all the people that were in live chat during this trial. Constantly saying the defense is desperate, the defense is struggling, that defense had a plan, and just got this case dismissed. He was Worth every penny. I’ve never seen anything like this in a trial. Shows once again, the prosecutors and SOME cops just want to win, they don’t care about the full truth and act shady

I could tell the whole time that the prosecution was not doing well. I came in to the trial ready to see Alec go away, but the defence swayed me the other way. I went to work not long after the jury was dismissed and came back to see the title changed to "CASE DISMISSED" I have some catching up to do.

Morrissey was back on her heels the entire hearing. Given the evidence that was obviously buried and her ongoing condescending attitude throughout this entire trial, it was satisfying to witness.

Hannah is guilty but she has grounds for a mistrial. Her team was denied evidence that they could have used to defend her because of prosecutor misconduct. The prosecution said she brought the live ammo to the set and then hid the evidence that she didn't. That's a mistrial.

You do realise that he didn't prove his innocence, yes? The case was dismissed because the Prosecutor hid information that didn't matter to the case (even though the information wouldn't have changed anything, the State not disclosing it caused the dismissal). Alec still broke safety rules and pulled the trigger of a gun he was not supposed to, resulting in a mother's death. He won't be going to jail for it, but his career and reputation is forever affected, he has lost nearly all of his fans after that infamous interview he did. So yes, happy for his family to be done with this mess, but Alec is still going to pay for his mistakes on that set every day here on out.

@@demi8890 The problem with your theory/viewpoint is - no actor is required to check firearms. An armorer who was a state witness in HGR’s trial testified to that back in February. The armorer is there to absorb that responsibility as is the 2nd AD to be the second set of eyes. Requiring actors to become gun owners in order to act is ridiculous. He wasn’t looking to be a gun owner, he isn’t a gun owner, and he was told the gun was “cold”. The only people who don’t understand how things work on a movie set by now are the people biased by right-wing media as they have chosen to replace facts with emotions.
Judge Sommer was critical to this dismissal..she could see the evidence withheld was so very important and this jerk of DA , Morrissey needed to be brought down. This is absolutely fantastic

It's terrifying to think how many times Prosecutors have done this with people that couldn't afford Baldwin type lawyers.
A lot of people bad at their jobs and the defense pointed it out. How much does this happen with bad attorneys and they don’t fight for their client?
Hannah now has a strong case for appeal and the whole of the prosecution team should resign and be charged.

The moment the prosecutor insisted she wanted to take the stand, I knew it was over. I knew Alex Spiro was going to tear her apart. This dismissal is for sure going to play a big part in Hannah Gutierrez’s appeal.

It was over at 8:02:24 when the judge asked who decided to list the ammo evidence under a diff case number and Hancock said it was her, Poppel and the Prosecutor. After that the prosecutor knew the case was over and was just trying to save herself.

I don't see how. This evidence was offered to Hannah's defense team before the end of her trial. They didn't want it because it was unfavorable to her case. These rounds originated with her father. It makes it appear more likely she brought them onto the set thus increasing her negligence.

. Most of the individuals in attendance at this show supported the prosecution. It has always been apparent that this case needed more substance. The individual who has been implicated is the correct one. Alec is innocent and should not have been involved in the first place

Literally from the early moments of watching this prosecutor I knew it was going to go ABs way. She acted as though she runs the courtroom, disrespectful and arrogant, didn't follow proper procedure even with her objections during this case. All this did was finally expose her and now potentially any case she's prosecuted will have to be looked at again. What an embarassment.

There's many articles on her previous to this. She was WORSE in the Hannah trial, this was chefs kiss beautiful watching her career nose dive live on tv.
Wheres all the "hes definitely doing jail" gone. Was clear from day one he shouldnt even be in court.

It seems like they withheld pertinent information and evidence. This woman is so haughty and arrogant she comes across as having been party to a cover up. She believes he's guilty so her testimony is slanted towards that end. Glad they were forced to drop all charges.
I think the judge concluded that a dismissal was granted, when she learned that the lead investigator and prosecutor placed this evidence in a separate file. I think she allowed the motion hearing to continue to determine whether this evidence was concealed as a deliberate act, or accidental. After the testimony of the investigator and Morrissey herself, It became crystal clear that is was a deliberate act to conceal evidence. Hence the ruling 'dismissal with prejudice' was granted.
Knowing the end of it before you start makes it a comedy of errors
From real rounds being planted on the set to the hiding of evidence by the prosecutors, I feel this was a high level setup and the judge saw right through it.

The prosecutor should be punished for misconduct. If I was Hannah I would be applying for a mistrial. She was partially convicted on the grounds that she brought the bullets onto the set and the evidence to the contrary was denied to her team.

This evidence should have been turned over to her lawyer as well. That trial was still active in court when this was delivered. They hid this evidence on purpose more so from it getting in her trial somehow in my opinion. Regardless if we feel he guilty or innocent. Regardless what we all feel about KR. In my opinion both these cases from investigations to the prosecutions were absolutely disgusting as far as execution. It doesn’t matter who the defendants were in my opinion there is no way either would get a guilty verdict. If they have to retry Hannah’s case this prosecutor should have to cover the cost not the taxpayers. Who is she to say how evidence could help or not when it comes to the defense. It’s bad enough when judges don’t allow questionable evidence now this prosecutor wants to make that decision on her own. Just my opinion.

From the multiplpe bodycam videos I've seen, your state has a very "soft on crime" DA that REFUSES to prosecute repeat offenders. And now Baldwin is allowed to walk because they messed up again. Sounds like your state has a competence issue.
