They tore down that poor womans house and then never developed the property like they promised. When I heard the case in my business law couse, I could not believe the government would rule against a citizen like that.

Rey I head an interview where she said the fact that they never developed the land was her "only moral victory."

I remember this decision when it came out while I was still in law school. I considered it a travesty of justice then, and 13 years of representing businesses and turning conservative hasn't changed that view.

@@michaeloleary8616 It was the conservative justices that defended her property rights. Ginsburg even argued that it was normal for govt to use eminent domain for economic development.

Actually, they did NOT tear down that house! I encourage you to read & research more if you haven't over the last two years. The Little Pink House was NOT torn down. In fact, while the property went undeveloped the Little Pink House was moved to 36 Franklin Street, New London, CT.
EVERYONE NEEDS TO SEE THIS MOVIE!
This happened to my grandparents first house in Detroit. I don't know about working class white communities but I do know that tons of black communities were destroyed to build highways, etc. They had absolutely no power to fight back and were very unjustly compensated.
I'm really excited for this to come out. My mother was one of the actresses for this movie, and I even got to be in the same room as one of the scenes as it was being filmed. The scene was when around 8-12 people are in the house sitting around a rectangular table discussing things.
This is what happens when we get away from the bill of rights and our constitution. The government thinks they can do whatever they want. Eminent domain was never intended for things like this. It was only for projects that would serve the public, not the government or private companies.

Exactly right...a horribly flawed decision. The Constitutional prohibition on "taking" was supposedly upheld...but the run-around that five justices created through their determination of a "public purpose" created an out and in fact expanded/terribly distorted the justification for taking, leaving us with one more very bad USSC precedent. *There was no public purpose.* This was as clear-cut a case of private interests run amok as it gets.

This is what happens when corporate money influences government to work for it… not the other way around.
You don't own your property. Government always has the last say. They always know better. They just have to invoke - "for the greater good!" 😡😠😢
It was the excavator operator on this movie Catherine Keener is such a Nice woman and person it was really moving to watch her act out a few of the scenes
I want to see this movie. Eminent Domain can be unfair.

It is the corporations that are abusing eminent domain is the main issue here.

Umm no this actually happened here in CT. The case is pretty heavily studied in many law courses as well.

What's The Castle? Either way, this is not an adaptation of any other film. It's about an actual US Supreme Court case.
Seems like they took the idea from A. Zvyagintsev movie "Leviathan" which won Golden Globe. Not sure it was a good decision.......

Every American should watch this movie, and see how an out of control and unaccountable guvment can happily take your property and destroy your dreams and your constitutional rights. The 'justices' who allowed this to happen are/were despicably stupid and should be remembered as such.
too bad it doesn't work this way in real life.

They violated her Third Amendment!
I'm not an expert. I only have my observations and opinions. But from my perspective there is a backside to this coin. And it is the sky-high rent and underdevelopment in California. Single family houses next to train stops and major bus routes. Let us all just take a moment to see that development is merely a tool. All this anger isn't helping anyone; but those that seek to divide us into little herds and corralled us into your separate corners.

There is no downside. The problem you are stating is again one produced by government. There are rules and regulations that prohibit building anything other than single family houses. If it were not so private businesses would offer enough money and most people would sell their properties with a few exceptions, but these exceptions wouldn't cause a housing shortage.

Unless you work for the guvment and only see that perspective, the people who divided and separated in this story were the politicians who believed tax revenues over people's rights decide what the best use for your property is, and justified the guvment taking it from you. If you were on the receiving end, you might sing a different tune.

Yeah, no. You're either new here or very young. Or both. The government HAS taken houses before. They'll offer you wtf they think you deserve (nowhere near its value) and off you go. Period.
How would the media have covered this story if the person that had owned that house had been black?
