The plaintiff says the defendant, her son's father, refused to return their son to her after summer vacation. The plaintiff drove hours to get her son. She's suing for all the money she wasted going back and forth from Alabama to Michigan. The defendant insists their son didn't want to return to his mother.

    The mother is not wrong she allowed him to get his son on breaks without a court order all these years and now the father trying to put on a show. He needed to return the child to the mother and went to court after for joint custody and visitation. Of course he would be the fun parent he doesn’t see him often unlike his mother who is hands on with him.

    Sounds like the issue isn’t that he’s the fun parent. If what the dad says is true, it sounds like the son doesn’t like to be home by his self a lot and with his dad he has his step brothers and the wife. Seems like mom is a single parent so she probably does work a lot . I’ve been that child . It gets rather boring and mundane

    Kyrie1551 you said that so right, mom is properly the more strick parent because of school, bedtimes, and homework. So dad seems to be fun one during summer vacation. I am going through this with my grandson whom I am raising and his dad. He's the fun dad, gets him on weekends and every other week in summer.

    If I understood it right, there was no custody order in place and she went and got one when things went the wayt they did. Both parents were in the wrong if that was the case.

His actions were not valid nor were his intentions pure and for that he will surely reap what he sows!!!

    And, I'm steady paying child support (for which he should pay) anyway. When 12 yr. Old states "I don't want to return to Alabama" The father should have immediately contacted mom. Adults/Parents do what is best for the child. This trauma will last a lifetime

This mom was being the responsible one while he was in and out of the boy's life at will but soon as she put him on child support then he tried to pull the okey doke.     I've been in the mom's shoe's with my son's father and he spread lie's about me to his Mom and when we ended up going to Court he refused to acknowledge my child even though I had to prove it. Then he kept it up and signed away his Rights to my son. He even tried to have a grand jury dig up my son because he got caught in his lie's. I made every attempt to be liberal with him about seeing my son and sharing custody but he refused and I got that put in the custody order. And he never tried to remove my son again

    IT WAS ABSOLUTELY RIGHT...NEITHER ONE OF THEM HAD CUSTODY OF THE CHILD. SHE DIDN'T ESTABLISHED CUSTODY UNTIL DEC. & THAT'S WHEN HE TURNED THE CHILD OVER. LIKE THE JUDGE SAID HE HAS JUST AS MUCH RIGHT TO HIS CHILD AS SHE DOES. THAT'S WHY THE POLICE, PRINCIPAL AND LAWYER TOLD HER THAT SHE COULDN'T TAKE THE CHILD WHEN SHE CAME UP TO MICHIGAN TO BRING HIM BACK TO ALABAMA.

I think if the Dad had communicated properly then this could have been avoided. I would have believed him more had he turned up at court but he couldn't be bothered

    Im confused. .. she had a child support order. On that order since the young man lived with his mother... it automatically made her the custodial parent. By this definition he did kidnap the child he did not have legal custody of.

    ​@@Vanessa_Martinezwell unfortunately you are wrong because I am a single father here in Michigan and when I let my daughter's mother take her out for the day while she was visiting from out of state and hadn't seen her daughter long time and sparingly when she did and the mother took off with my daughter out of state and kept her I had to take her to court and so forth and of course they said I couldn't charge her with kidnapping so I asked them what if I was the one that did this to her what would happen to me and they told me to my face that I could be charged with kidnapping even though I had full custody and still do and by the way I raised my daughter primarily by myself ever since and I've had a practically all her life and she's doing great I'm so blessed but the law here in Michigan is kind of messed up however I will admit that was almost 20 years ago

    @@Vanessa_Martinez Take it from me... My brother tried this with his daughter, he took her from New Orleans to Atlanta where he leaves and tried pulling this same card that this guy did. All in an effort to absolve himself of paying child support, he coerced my niece. Long story short the mother could have pressed charges against my brother for kidnap once he took her to another state without her mother's consent which is illegal where I'm from.

    For everyone who doesn't get it... the father just didn't want to pay child support, so came up with a way to not have to pay. It's that simple. Everything else is a lie and him manipulating the situation. It's why he brought it up when he came up with an excuse for why he didn't go to court. He would have fought for his child, if he really wanted him (simply just show up to the court alone)... but I can tell exactly why he wanted the child... and it was bc of child support. And JM is wrong for going after that lady when she said she could have pressed charges for kidnapping. SHE SHOULD HAVE! He decided to take the child against court orders, and then when all she wanted to do was see him for a few seconds, he refused. So she had every right to go to court and complain. He did in fact do everything wrong.

    For years I've read comments about her talking down to black women.. and there have been times where I was thinking. Maybe something more happened they didn't show. But here. I do not care...     ​@ehizogieimasuen9565 Thank you she is very nasty and goes to far to me she power trips alot thts why I could not watch her whn she was on TV and am from NYC the mother had no problems wth the dad she sent him for the summer to me he wnted out of tht child support order Periodt ppl think it's not about tht but for sure it was he remarried and the wife had her two children one being a 19 yr old so make it make since his child's mother is in another state working and being a single mom this was not about the child being his or hers it was solely to cut cost not paying child support so his new household will have more money it's easier to take care of a child without having a order in place he didn't like being told wht he had to pay this case was cut and dry the judge should have gave tht woman the lawsuit she asked for judge Milian has always displayed prejudice to me periodt and I said wht I said it's my opinion thts wht this comment section is for she also give me she wnted to be like judge Judy 😂😂😂😂 it never worked for her it comes off just wht it is she is nasty, phony and prejudice on almost all her cases and she never rules fairly again !!!!!

    This just pissed me off. Why is the judge SO mad at the mom when she’s been the SOLE PARENTS FOR YEARS. And just because he’s the dad, he should just take full custody. Why didn’t the dad try harder to be an active father?! And now the judge is mad at the mom for going through the same order of commands the dad did?! It’s so disgraceful to me how the court allows a dead beat parent (mom or dad) to have so much flexibility. Of course the son is angry! HE MISSES HIS PARENT! This is so sad for the child.

    SHOTS FIRED AND ALL BETS ARE OFF. The father was wrong and Judge M was out her mind yelling at mom. The boy was going there every summer. She’s not keeping him from his child and they were able to come To an agreement without court for 11 years??? He was tired of paying child support and someone gave him that dumb idea. If it was genuine he would have had a real conversation with mom and she may have worked out something. That was low down to do that.

    The father was wrong. You absolutely need to talk to the other parent before you just decide you won’t return a child you share. It’s wrong to leave someone worried sick. Have an adult discussion about custody or he should have tried to get full custody.

    I felt like the judge didn't hear the mother at all. They agreed on a visitation time. When it was time for the child to come back to the mother, the father refused to send him back. The mother went to court and got an order. She THEN drove to MICHIGAN from ALABAMA to get the child. Once there the school, police, lawyer, and father ignored a court order and she left without the child. The father 100% should have reimbursed her for wasted time, gas, amd any hotel room(s). I could agree wtih the judgment if she had just went without the court order but she didnt do that. There are a lot of questions that are unanswered as well for example, How long has the child been in the mothers sole custody? How long have the parents been split up? Who moved away from who? If the father wanted to be there, he 100% would not have missed that court date.

    It seems the child always lived with his mother, the mother said the relationship between the father and she was long distance from the beginning. She also said he was in the childs life "OFF and On" "come visit from time to time"

    She should have got reimbursed for her wasted trip because he could have called mom and said im keeping him here. Also, mom definitely raised him and dad was around when it was convienent thats just a fact. Otherwise, the father would have tried for partial custody long ago and both parents would be cooperating. Sometimes a parent, usually a father, will wait until a child is a teenager to really step up. When the child can take care alone and not need constant supervison.

    The son didn't say he wanted to stay. He said, "My DADDY wants me to stay, so I'm going to stay". No son, your Daddy did not want to pay child support any longer. If the Defendant really was putting his son first, he would have done things properly and stress free through mediatiom and court. Edit: He didn't show up to court because he doesn't really want his kid. And, what kind of BS was he telling the Police to get them to say the court order didn't matter and he should keep the child? Plus, this child is saying he's going to "kill himself"?!? Whaaaaat is going on?!?

    That's exactly what all of it came down to. He didn't care about anything until he had to pay child support, and came from CS court. So I'm guessing he has to pay a lot, and he hates it. He figured he could get the child and seize having to pay up. If he actually cared, he would have showed up to court when she petitioned for full custody. He did ZERO and even used him having to pay child support as an excuse for why he didn't show up.

    I think the main key factors flew over some of your heads. 1. Parents who do not have a custody order in play do not "allow" the other parent to do anything. They are both on equal ground regardless of where the child stays. 2. The child said he didn't want to go back with mom (probably because dad is more fun to be around). 3. He consulted a lawyer and the police. 4. Mom waited until she had a court order for full custody, and the father released the child back into her custody. The sad part about this is that the father didn't show up for court after he made the moves he made. Hopefully, they figured out a parenting plan.

    The father mishandled this situation. It's called communication!!! He breached the verbal arrangement and tried to illegally take the child!! I'm willing to bet during that time he was withholding the child he was ignoring all her calls as well so why when behaves just like him he wants to cry wolf. Nothing about this woman came off bitter or malicious. The child wasn't in danger or being mistreated so why take that route. It was unnecessary and precalculated. Any child would be upset if their parents were always going back and forth. At 12 you have no maturity to make decisions of that magnitude. The father could have went about this differently.

    I also don’t think judge Milan is being objective. To presume that a mother is fearful of her son having contact with dad is insulting because she sent the child to live with him for the summer which was the agreement. I’m not sending my child anywhere I feel he would be in danger… unfortunately they are not actively coparenting. They are in fact sharing a child. Sad

    Yea she was wrong period! Courts let the child decide at 12 who they want to stay with in my state, maybe it's the same in their states too and that's why he hollering the child decided it's fun with me, surely the kid said the same thing in previous years during visits if that's how he felt so why didn't the defendant bring it to the plaintiff before, why not just have a conversation with the lady.

She did in fact had a right to press kidnapping charges against him, but chose not to. She's been more than fair. He has been in and out of the childs life and ONLY decided he wanted the child when he had to start paying child support. Now all of a sudden he wanted full custody?     There’s nothing wrong with the father wanting to step up but he was completely out of line for how he went about it. If the son did express that he wanted to stay with the father, it was the father’s responsibility to have a conversation with the mother and discuss the situation. Him just deciding to uproot the kid from the unofficial custodial parent was outrageous.

    This happened to me with my son because the dad didn’t want to pay child support so he took my son and thought that I would have to pay him support but when he found out I didn’t have to pay him he told me to come get my son or he would get me arrested for abandonment. I went and picked up my son and he’s now 29 and wants nothing to do with his dad . Divorce can be a menace

    This was just wrong on all levels. Mom clearly said that the dad has been in and out their son's life and he didn't dispute that. Now all of a sudden he think he has some entitlement and to a point yes he does because he is the father. But he handled that wrong completely and should have never taken him away like that. That should have been a conversation that he should have brought to mom's attention so that they can come to an agreement or understanding and if they can't then let the courts handle it. He just made a whole decision without including the mom and causing a very stressful situation all the way around. He handled that allll wrong.

    When the father mentioned child support and having to pay for his son's schooling, I said that's the reason he wants custody.     The good thing to know at this point is that if he was born in 1999 the son is 25 years old and a grown man now. He can make his own decisions. We won’t get to see or know the truth but the real parent has definitely shown up in his life. Lmfao and the child also knows the truth.     Yeah I don’t agree with JM on this one. They agreed for the child to come and go on certain dates. He decided unilaterally to keep the child. She didn’t go down there acting a fool, she went to court got all her ducks in a row and went to get her son. Clearly he didn’t have the child’s best interest in mind bcuz the boy said he doesn’t get to see his mom, yet after she did all of that to get him back and he refused, all she asked was that she see him and he said no??? To the mother that’s raised him and is fighting for him? That was cruel smmfh. She should have gotten back every penny she spent in travel to get her son. If not from him, then from the city since their cops don’t respect court orders…

    I say let him stay usually things turn once they stat awhile. Rules change once you live there 😊

    I can't stand when the judge went off on the mother she didn't do a damn thing wrong! She let her son go to his father for a month and he was dead wrong for keeping him like that Hasn't been around for the kid she's been raising him alone for 12 yrs yet the judge went off on the mother

    Notice when he's with mom, then he gets to see dad, but when he's with dad, he's completely separated from mom, not allowed to see her. That's NOT best for the child. He just did this to weasle his way out of paying child support.

    Honestly this a hard one for me to comment on without having a personal connection to this case. I was raised by my momma and I’m thankful and appreciate her for the great mother she is and great job she did raising me as a single mom during my younger years .. But on the other hand, I remember at that same age, being a young boy wanting to live with my father, always looking for him. And hoping he would come take me to live with him or even come see me… Only difference my pops was living his life(in another state) but was going through his own stuff, he couldn’t be the father i needed at that time.. This a tough one for me, I don’t agree with how he handled it, I think he should have ask her, maybe drove down and had a face to face discussion with her and their son and not just called her & told her what he was going to do… but I see nothing wrong with a man raising his son especially at that age, that’s when we need our fathers the most!!!

    I agree !! I have two boys and I I want them to both have father figures in their life and I don't want 100% of the responsibility I don't want my kids to hover over me and only think I'm there for them I want them to know they have both parents in their life and I need to trust that the father can make them into the man they need to be

    That mom did NOTHING WRONG!!!!!! She went to court and drove states away to get her kid! While the fun part time parent didn’t bother one drive for a court date….. bless her and god give her strength

    If son wanted to stay with dad, why couldn’t they just talk it out? At 11-12, he probably should be with his dad as long as he’s a responsible adult. They went about this all wrong.

    I agree, it's just hard to determine if that was what the child really wanted. Should have done this through the courts. Sad all around.

    I don’t agree with this ruling. I’ve been a single mother for 11 years. My son is 11! His father decided to be a part of his life periodically nine months ago. He drinks a lot and most times is verbally abusive. God forbid I tried to give him a chance and allow my son to stay for a weekend and he tells me he’s not coming back because he doesn’t want to!!! I would lose my mind!!!! They had an agreement he should’ve abided by that agreement. He can not be trusted.
