1. The payment was listed fraudulently to hide what it was. It was paid to Cohen as income rather than a repayment to hide its nature. That's not something you'd do by accident as it meant paying Cohen even more to cover the income tax he'd pay on it. It was specifically done that way to fraudulently obscure the nature of the payment. That's a misdemeanor. 2. Doing so in order to gain an unfair campaign advantage converts the misdemeanor to a felony. In other words, the characterization as a "hush money" case is misleading. That's not really what it's about. It's really about election fraud and Trump cheating to get elected.
