    Steve, I am the attorney who has filed the lawsuit in Michigan. The governor’s orders do not specifically ban the use of motorized boats however the department of natural resources has use the governor’s orders and implemented a rule banning the use of motorized and electric powered boats.

    @@stevelehto I have called the DNR three times on this and they are claiming it's in there, then you question them and say it's in the FAQ and I tell them that's not law, they then tell you to "call the Governor then or the Michigan Attorney General. Would you like their number?"

    From what I see, a ban on fishing boats with gas engines may not be in the Executive Order, but it appears a large number of over-zealous officials don't know that. Apparently it will take someone higher up in the State, (a judge maybe), to clear up this obvious misunderstanding.

    Darn. Towards the end of the video, Steve started a sentence with, "Short story, there is no law against (pause) being out in a motor boat...." I was SO HOPING his statement would have been: "Short story, there is no law against motorboating."

    The laws are enforced inconsistently which causes confusion. Poorly written laws are often open to interpretation by police and others and there lies the problem.

    Lehto is failing to realize that most people don't want a run in with a law enforcement officer. You may get a ticket, in parts of CA it's up to $1000 and may include jail for social distancing violation, and what if the encounter escalates! The order is a bit nebulous and that leads to confusion and press conference statements only add. LEOs are trying to enforce the order and may make errors. Not good. Lehto says, no problem, it's a bogus ticket. Only problem is now you have to challenge it and perhaps take a day off (assuming we go back to work before the fine is due) and go to court. So I'm actually completely for filing this suit. Perhaps the governor could amend her executive order or clarify at a press conference and save all the citizens of Michigan a little heartache. Also, and Steve glosses over this, the specific part talks about "exercise." I could see an officer saying "driving around in a motorboat is 'not exercise'. Anyway, ambiguous laws, even slightly ambiguous, lead to confusion and lawsuits.

    @@Nickvec I agree, and I just posted a comment basically saying the same thing. Ordinary people do not want to be fined or arrested. Personally, the less interaction I have with law enforcement and the legal system, the happier I'll be.

    If they've offered interpretation stating they view boats as banned and law enforcement is going to take that interpretation into account for enforcement proposes there's a problem. While you may be right and win in the end that's a pretty hollow victory given the disruption and financial impact to your life that you've already suffered.

    @@stevelehto Patience. You will, that's about guaranteed. Enforcement overreach can and will happen, as it has here and in other states for similar matters. The situation is simple: as a lawyer you care mainly about what the law IS. As an average Joe Boater, I care mainly about how it is ENFORCED, especially at this juncture. Most people don't have resources to waste educating law enforcement officers through the court system. Those with play-time and play-money can play house or court or whatever they think is important; the adults in the room have to discern, with prudence and a strong moral compass (and God willing an excellent memory), how to allocate their severely curtailed discretionary resources NOW. Now is the time for serious, dependable leadership from Lansing on down, not passive-aggressive administrative subterfuge. If I get a ticket for going out on my motorboat, will you provide your legal services gratis to defend my case? Put your money where your mouth is. Make said offer to all in a video. By doing so you will change the minds and hearts of many disillusioned Michiganders who regularly watch your excellent content

    As an American, it is my constitutional right to imagine that I own a motorboat. The fact that my boat is imaginary in no way diminishes its' value to me, nor does that fact impinge upon my God given right to imagine myself boating. In short, both God's law and secular law defend my right to indulge nautical hallucinations. (Salutes the ensign as it retires and dives into the briny deep.)

    Do you get awarded attorneys fees when you have to appear in court for something that is clearly not against the law like the boat example? Or do you still, even if you did nothing wrong, have to carry the financial burden of wasting your time in court for nothing?

    Outside a squarerigger, sailboats can be sailed single handed... Maybe not at full sail, but any bermuda rig certainly can be sailed single handed, which is the rigging used for pleasure boats.

    My neighbor has this same mentality as the lawsuit/seeds/etc.. ppl. He will say with conviction that the dear leader is telling the truth, if you casually bring up a whopper, "oh , that's just how he talks." He's a good neighbor, I like him, but he is from Florida, lol

    I agree with you. But went up around Crystal and they have police tape blocking the launch ramp. At Wabasis Lake in Kent Co the county yanked out the docks and posted signage “no motor boating”. I think there’s some unclarity somewhere.

    Been to the launch at lake erie metro park and it is posted as to no motor boats per Governors order. Now I feel this is an overstretch of our government. The main issue is who's going to defend me in court for free.

    Speaking of seeds... I was in Menard's today to get some handicap equipment for my ma, and right out on the main floor (not in the nursery section) they had a display of seeds, but it was all wrapped up with "caution tape" and unavailable to purchase. I couldn't help but to think of you, I was even going to take a pic... but I didn't want to ruffle your feathers. Sufficed to say, it's not only common folk misunderstanding the Gov's order... it's retailers as well.

    I think the suit makes sense in forcing some court to make a clear statement. Police have sometimes overstepped the words of the executive orders and tried to enforce personal interpretations by lower-level officials that aren't reasonable. The scope of what is enforced right now does not match the scope of the orders. Some non-essential businesses continue to operate in violation of clear requirements while some permitted activities are assumed to be prohibited (like protesting).

    It would make more sense to find someone who was actually ticketed for this and pursue it that way (fighting the ticket itself). At this point you are asking for an interpretation of a law in light of statements made by people in the gov't.

    BOATING/HARBORS Non-motorized boating, such as canoeing, kayaking and sailing, falls within the outdoor activities permitted under the "Stay Home, Stay Safe" Executive Order. However, the use of a motorboat, jet ski or similar watercraft (includes gas and electric motors) is not permitted for the duration of the Executive Order, which is currently set to expire at 11:59 p.m. April 30.

    Steve, their point is to prevent the fools who don't know how read the law from trying to endorse the law improperly. Why have police cite people, require a trial in front of a judge when the whole thing is bogus. They are suing to stop that from happening to us.

    Crappy reporting, leads to disjointed quotations from the complaint. I don't think that the reporter came frame a complete and logical thought, which leads to even more confusion when people read the article, or worse, get excerpts passed along second and third hand. What a sane lawyer would be seeking injunctive relief of is sloppy and/or arbitrary implementation of the executive order by a state agency or agencies... It is entirely plausible that DNR employees are taking it upon themselves to make things up as they go, and as we have seen many times, there are people who when given a little bit of power let it go to their heads - even find enjoyment from being the evil Barney Fife... I dunno Steve, maybe, since the plaintiffs are in the same state as you, you could have reached out in a phone call and asked them what they are actually doing? Or gotten a copy of the lawsuit filing from the court, and read that before getting all dramatic? After all, they might still be disjointed and illogical, but at least you would have better confirmation of that than what came out of the word salad from the news article...

    My County (Lake County, CA) ordered our lake closed to all boats. Our lake (Clear Lake) is full of Bass and is used by fishermen from around the U.S. They wanted to keep the tourists away. It has worked because we have much less cases of the virus compared to nearby Counties. Some residents complained saying it should be open to locals, but then the Sheriff would have to spend time checking out residency of every boater on our huge lake (largest in CA).

    I guess I don't understand. If there is a stay-at-home order (ban on all activity accept this) and there is an "exemption" list that "allows" certain activities, how is that not a ban of those things NOT on the list? i.e. motorized boating

    I believe they filed this suit to prevent over zealous actions by department of natural resource employees and Law enforcement officers. As the quoted district attorney stated other officials may not interpret it the same as he does. Granted I would likely win but lose 300-500 bucks taking a day off from work to do so.

    So I'm listening to Steve, and I'm reading the comments. Let me tell ALL of you, including Steve, that the boat launches are CLOSED. If your boat is in a slip, you cannot take it out of the slip. I fish the Detroit River 20+ times a year in the spring and this is prime time. I fish with my children that live in my house... no social distancing required. There is no reason whatsoever for people to be stopped from going in a motor boa and if your so thick-headed to dismiss this as rumor, I feel sorry for you. If you think this isn't happening you are 100% WRONG. The U.S. Coast Guard does not enforce Michigan law, they enforce Maritime law. If they catch you on the Detroit River right now, as I'm typing this, they radio the DNR and they show up in Boat in 5 minutes and WRITE YOU A $1,000 TICKET. End of story. Search Captain Nick on KZread and watch the video yourself. You can also read stories on the fishing forums on Michigan Sportsmen and get more of the same. I watch Steve's videos because they are informative and educational, but you are simply wrong. For the record, I used Steve Lehto in a lawsuit back @ 2007 and won (thanks Steve!), so I highly respect your opinion and professionalism. I am going to make an offer to you that will make quite a good You Tube show; I will take you out on the lake in my fishing boat and we can record the Police or the DNR come after us in my boat or have them meet us at the boat launch upon our return, and see what happens. They WILL write me a $1,000 ticket, right in front of your eyes and on camera and you can accompany me to court, for free of course. (I know some you are going to scream "social distancing", at which point I will offer to take my 14 year old son and Steve can stand at the dock). All the snickering and comments from people on here that don't fish or boat is really disappointing. The MUCC is a great organization, with a whole bunch of smart people involved with it, and they don't deserve the back-handed treatment. They're not a bunch of backwoods, camo wearing, Tabaco spitting red necks. So if they are filing suit against these DRACONIAN measures, it's for a good reason. This whole "Covid-19" situation has been handled wrong, and as far as I'm concerned, most of the population of this state and the rest of the country are sheep. You've ruined millions of lives and business. Gullible sheep.

    As I read you statement I am interested in why you can't pull out of your slip. As you stated the ramps are closed. Is your slip closed too? What law are you quoting that pulling out of your slip is in reference too? They can write many tickles to include not having a fishing lic, no safety gear in your boat, your boat not registered. but if everything is in good order than what is wrong. Let me ask a hypothetical situation. If you pull your boat out of a slip in Wisconsin and sail into Michigan waters is that a violation. You did not use a launch in Michigan or even a slip?

    I think the biggest problem here is misinformation or more the disconnect between the actual executive orders and how they’re relayed/reported even from the governors themselves. I’ve personally seen this both with the Governor of Michigan and New York, my state. The executive orders are what matters unfortunately the governors describe or personally report their orders as something else. I’ve seen the governor of Michigan talking about not allowing the sale of paint, other non-essential items, etc. despite thus not being directly identified in the orders; thus is were some people got the car seat and other issues. I think they took what the governor said as what the case was, not what the orders were. I’ve seen this as well in NYS where our governor said masks were required to be work despite the order stating that they weren’t required to always be worn. The law including executive orders can be difficult for some to understand because “and” and “or” mean very different things in the law which not everyone grasps. The problem I gave is faded on the intent of the governors because if they are knowingly and intentionally misrepresenting their orders with how they describe them it’s wrong; I do cut some slack because not all are smart or trained in emergency management and may just not understand the orders as they were given to sign and are just repeating the order as they understand it. That’s why it’s important to go to the source of the law (executive order) directly unfortunately the media and people aren’t doing this and some are seemingly taken advantage of this to mislead people. The problem with this is it shouldn’t fall to the people to challenge false arrests and penalties in court because the people get harmed in the mean time. And in NYS the courts are closed for non-essential business so people can be in limbo until this is over with. Ask the Japanese American how their unconstitutional internment was during WW2 because while it was wrong while it was happening the government did it until the Courts told them they shouldn’t of. This is the complaints now that won’t be resolved for dome time. Just because politicians and the government can do things doesn’t mean they should.

    My take is the law/order is somewhat ambiguous. It specifically says "physical activity is permissible", but law enforcement could construe a motorized boat as non-physical activity as _YOU_ are not powering the boat. Thus a row boat would be "legal" to operate, but a motorboat would not. Perhaps the lawsuit is seeking clarification of the ambiguity of this law. 🤷‍♂️ Perhaps the company was specifically told they couldn't sell motorboats by some government agent. I have been hearing some really insane shit, like in PA the service department of a dealership could be open to maintain vehicles ,but the sales department was not allowed to operate as it was deemed "non-essential". But what happens if your car is totaled and you have an insurance check and want to buy a brand new car instead of some used beater? I would not consider this lawsuit frivolous just yet. Any lawsuit that challenges the power and authority of government is a good thing. It serves to let government know that their power _IS_ limited.

    This is from the Michigan DNR website. “BOATING/HARBORS Non-motorized boating, such as canoeing, kayaking and sailing, falls within the outdoor activities permitted under the "Stay Home, Stay Safe" Executive Order. However, the use of a motorboat, jet ski or similar watercraft (includes gas and electric motors) is not permitted for the duration of the Executive Order, which is currently set to expire at 11:59 p.m. April 30. Any outdoor activity, including boating, must be done in a manner consistent with social distancing, and individuals should use only their own equipment to prevent the transmission of the virus through the touching of shared surfaces. In addition, persons not part of a single household may not boat together. State harbors are closed through at least May 15. There are no services available, including bathroom buildings, electrical, fuel, pumpouts, etc. and no slip reservations can be made.” It looks like the DNR disagrees with you on a couple points. Glad I sold my boat. I just want to go and fishing.

    When those tasked with enforcing rules( real or not), think there is a rule and they enforce a rule(real or not). There is in practice a rule. Like always, a useful interpretation is needed and most often it takes a lawsuit in order to get bureaucrats to relinquish back our freedoms.

    Hey Steve, after watching this video, I e-mailed both the Governors office and the DNR for claification. The DNR finally responded by simply saying contact the Governors office or the Attorney General. Interesting that The DNR website states motorized boats are prohibited from use , yet the enforcers of that now refuse to comment. Thanks for another great video with fantastic information.

    Steve Lehto: I have the feeling from a non lawyers perspective that the exceptions were listed because it was easier than listing all of the actually banned activities. Unfortunately this leads to confusion And yes those weren’t listed either which could be interpreted as being banned also.

    Steve Lehto I didn’t say they were on a list of banned activities. I’ll put it another way...if an activity isn’t on the list of exceptions it can be reasonably interpreted that it falls into the category of banned activities even if there isn’t a specific list of banned activities. If the executive order failed to list every outdoor activity as being banned or allowed then legally it should be ok to perform any activity not specifically listed?

    It’s almost like some exclusive guild has had virtual control over the enactment, enforcement, and interpretation of the law for so long that others can’t figure out what’s actually in those thousands of pages. Of course, that’s not true or by now such an organization would surely have made the laws much better and more easily understood by everyone. :)

    Steve Lehto No tickets but law enforcement over stepping their bounds definitely. You covered the girl and the instagram account. So it is not far fetched that a sheriff or deputy thinking their fallowing governors orders ,to ticket someone. KZread is full of officers not knowing the law, enforcing what they think is the law. In these times the governor should stick to the facts of the law.

    Ok i looked the order and in section 2 it states " all individuals currently living within the State of Michigan are ordered to stay at home or at their place of residence." then it give some exceptions in section 7 "Subject to the exceptions in section 7 of this order" section 7 said in part, " Exceptions. Individuals may leave their home or place of residence, and travel as necessary: To engage in outdoor physical activity, consistent with remaining at least six feet from people from outside the individual’s household. Outdoor physical activity includes walking, hiking, running, cycling, kayaking, canoeing, or other similar physical activity, as well as any comparable activity for those with limited mobility." If i was telling the judge what crime was committed i would site section 2 of the order, and that there was no exemptions for power boats and would affirm that it was the intent of the law noting statements that the Governor said. this is assuming that is what the governor said. This is not hating, its how i read this and how every person with out a law degree would likely read this. Could you help clarify this. think you :-)

    There is nothing in that executive order that says you are allowed to breathe while you are canoeing. So I guess you have to hold your breath.

    Steve, your point is certainly well founded and while I agree with your interpretation of the executive order it’s clear that the official position of the state of Michigan is different than your reading of the order. Given the official statements made on the Michigan.gov web site regarding how the state is interpreting the order it seems to me that the lawsuit is justified. Because clearly the government of Michigan is interpreting the order to include a ban on motorized boats.

    Steve, you taught us that laws typically have definitions of terms. It appears that in this case both the governor and the litigants think that 'operating motor vehicles' (e.g. cars, boats) does NOT fall in the exception clause of 'physical exercise' (e.g., running, hiking, kayaking)

    Im sure they write a ticket for violating the " Stay at home order". You have to stay at home except for these physical activities... Doesn't specifically say you can "motor boat", but it does say you can canoe. I don't live it Michigan, but the prosecutor can say "boating is not physical activity". They are suing for clarity. Btw, if you're boating in a "house boat", would that apply since its technically a domicile.

    I had a call at work from a Michigan resident talking about this boat thing specifically but add the because boat launches are closed and that is how you get a motorized boat in the water that the law is discriminating against motorized boat owners. I had to hold my tongue as a professional but was rolling my eyes at the thought. She mention other off the wall theories that have been already mentioned on you other shows too. I bet even stranger things are to come.
