Lawrence: Justice Kagan shares our crisis of faith in SCOTUS

MSNBC’s Lawrence O’Donnell shares his own crisis of faith in the Supreme Court that he revered before the Roberts Court corrupted legal scholarship to the point where he believes the Republican justices are “just making it up” and, as Justice Elena Kagan expressed in her dissent, are violating the Constitution.

No, American so-called Democratic voters deserve the blame. they threw a temper tantrum and threw their votes away on independent candidates or didn't vote at all because Hillary was the nominee and not Bernie. Go look at the swing states in that election, I did. The upsurge of votes to 3rd party candidates from elections prior proves that a lot of people did a 3rd party "protest vote" and in almost all of those cases the number of new 3rd party votes was higher than the margin Clinton lost by in those states. So-called liberals threw every cause they claimed to care for under the bus and handed the White House to a domestic terrorist criminal for 4 years, also handing him 3 SCotUS pics. This blame lies squarely on their heads. Blaming Republicans is like blaming a snake for biting you when you get too close to it. An animal is going to do what an animal is going to do.

Not just McConnell. True, he used rules he made up to block Obama's nomination, but the true string pullers are Leonard Leo and the Federalist Society, backed by the BILLIONS of dark money anonymous donations allowed by the Roberts court ruling in Citizens United. All the judges appointed by Trump, including 3 SC Justices, were handpicked and presented to Trump by the Federalist Society.

Let us not forget that Neil Gorsuch's Mom is Anne Gorsuch. She was a Colorado state representative, and was part of a caucus known as the "House Crazies", because they wanted to fundamentally change government (into a far right-wing authoritarian regime). She was later the EPA administrator under Reagan, in the early 1980's, and she personally slashed that agency's budget by 22%. She also fired career employees (on her own whimsy) and hired industry puppets to cover those positions. And her legacy? Well, she became the FIRST cabinet member to ever be held in CONTEMPT of CONGRESS for illegal actions that benefited the owners of a $1.6 BILLION dollar Superfund site. Neil has an axe to grind ... and he's grinding it down to the handle ... taking it out on the citizens of the united States of America. Neil Gorsuch is not qualified to be a Supreme Court Justice. He was hand-picked by Mitch McConnell and the Federalist Society (who really aren't very 'federalist', at all) to lay waste to the U.S. justice system. He's the quintessential bull in the china shop. Or chimp with a loaded gun ... or grenade.

On my first day in Constitutional Law as a second year law student, my professor, a judge, asked the class, “What is the Constitution?” There were so many excellent answers, but each was met with a “No.” After so many good answers, the class sat baffled. Our professor finally said, “The constitution is whatever 5 out of the 9 justices say it is.” Um what? During that year, he also kept drilling us to pay attention to who made up the court at the time a decision was made. That would usually predict the outcome. And here we are with a 6-3 Court that was Frankensteined together by the Federalist Society just doing their thing.

In all fairness it is not up to the court to independently check the facts presented to it. This should’ve been done by the lawyers opposing this decision. It is a gross failure on their part that they didn’t bother to check the facts being put forth by the opposition. I would think that is a basic responsibility of any lawyer. As for those that presented the bogus facts there should be consequences; although let’s face it, there rarely are.

@@g11rfe87How can you possibly trust Trump with our nation's most important defense secrets? EVERYONE who worked for his WH administration has said he's a literal danger to our national security and is not fit to hold any office. The only former official who has stuck by his side is Mike Flynn and I'm sure it has nothing to do with receiving a pardon.
