I am quite astonished to see that all the car youtubers are advising how to get discounts by bargaining but completely ignore a sure discount, which is legally correct. Let us explain it. When a car is sold, two incidents are involved therein -- (1)sale of car and (2) its registration & insurance. The 2nd part is independent of the first one but incidental. When the invoice is raised showing the ex Showroom price, then the sale is complete. So, if any discount/benefit is offered by the company or dealer, then it has to be adjusted at this point only. The Law says this. Section 15(3) read with sec9(1) of the GST ACT 2017 clearly prescribes ---' any discount before or at the time of sale shouldn't be subjected to gst and it shouldn't be part of the price of the good. That means any such discount should be deducted before the levy of gst. But it is seen that all the car dealers are deducting the discount amount from the final amount pays by the buyer( Ex Showroom price + road tax + insurance) which is completely illegal in view of the said provisions. As a result, buyers are unnecessarily paying 28% gst, 5.5%/10% road tax & insurance on such a discount amount. This is not a meager amount which is nearly 40-45% of this discount. Suppose a company offers 50k on the car price, then the buyer has to pay nearly 23k extra if the discount is not deducted from the invoice before the levy of gst. Actually, due to the provisions of the GST Act, the buyer can get this extra benefit by default. Last month, I challenged this with the T.C.MOTORS Kolkata while went to view Nexon Creative. It's Sales Manager admitted this legal provision but refused to follow it as they (dealers) collectively have been following this illegal practice for a long time. I can't elaborate it on this little space. Please make a video on this issue to create awareness among the buyers. JAGO GRAHOK JAGO
