    Doubt it. She probably can’t have a bank account, either. She’s a habitual offender and needs jail time. She’s lying about that check!

    Usually I agree with this judge,but it seems to me that she's a career criminal. Why's she only getting treatment? No time? What's the lesson here? Please correct me if I'm not understanding

    Because most defendants who commit retail fraud either steal to make money for drugs or steal when they are under the influence of drugs due to lowered inhibitions and lack of care of consequences. If you get to the ROOT CAUSE of why they are stealing, then you have a better chance of correcting the behavior by making them go to treatment to address the root cause of the criminal behavior. It doesn't always work but that is why you don't see much jail time with people who steal and have drug issues. I'm a recovering addict that has been arrested for retail fraud. This is exactly what my therapist and attorney have both explained to me.

    Thanks for your input. I still believe if one commits a crime, he should also be taught a lesson by going to jail. Have seen so many who knows to play the system by accepting treatment over jail time. It's becoming a game that's a revolving door

    ​@@GunzBlazin88that may be what your counselor and lawyer told you and that may be the reason why they sentence that way but it does not mean that it's a fact that most thieves steal to buy drugs. That's an assumption that courts make based on badly conducted research or their own personal belief not supported by evidence. It's more accurate to say that most drug addicts steal, not that most thieves are addicts. In reality, most thieves just don't wish to pay for something they want to have and drugs don't even factor into it. Also, while in the minority, there are many addicts who wouldn't dream of stealing to support their habit. Myself for example, I never stole one single thing from anyone or anywhere to pay for my addiction. Not one time. Have not met too many folks like me in that regard though. Most addicts are dishonest pieces of crap.
