Who is the minor testifying in the Karen Read trial?
O'Keefe took custody of his now-13-year-old nephew and 16-year-old niece after their parents died. The children testified for the prosecution and described yelling and arguments between O'Keefe and Read, which they said became more frequent in the weeks leading up to O'Keefe's death.

You keep saying it was 2 years later when they got rid of their phones. Both Higgins and Brain got rid of them same day 8 months. 1 day before the order.

Geeze, I wish people would listen to the actual testimony. Brian Albert said he didn't get the letter until after he "upgraded" his phone. Higgins said he got the notice and maintained the phone until the defense lost their motion. Then, he threw the phone away. If everybody was defying a "court order" why are they not wearing orange jumpsuits for contempt of the court or obstruction of the court? A: Because the defense made this phone thing an issue MONTHS AFTER the death occurred and the court DENIED their ability to get the phones. And, the court and/or the defense never actually "served" anyone with proper legal notice which would have been trackable and then you could PROVE when and if the witness got the notice.

@artt3165 he said he didn't receive the letter, and in the same conference call, Brain and Higgins admitted they didn't have their phones. Lot phones upgrade or thrown away same month. Not 2 years later.

@@artt3165 So, there was no way that Brian Albert or anyone else could have been tipped off by "friends" in the PD or DA's office? All the butt-dials and getting rid of phones at or around the same time seems a bit suspicious to me, no smoking gun but darn suspicious.

When the defense waits 7-8 months to ask the court to allow them to get the phones and they just happen to do that right as the new iPhone comes out knowing that a lot of the phones in the case are iPhones and then complains because the people upgraded/changed phones and/or phone plans. Yeah...... cry me a river. But, like Rick, I've been around lawyers and I've seen the games get played. You want to be suspicious of the witnesses but, I'm just as suspicious of the lawyers for the defendant.

@@artt3165 It may have taken 7 to 8 months to determine which people's phones the defense team would want and why. The defense team could not have simply gone to a judge and ask, "Can you give us access to all the phones of everyone around Karen Read that night?" I think Karen Read's behavior is suspicious, too. I've been watching this trial since day one, and there's A LOT we don't know about that night. There are A LOT of funky things about the Canton PD (missing videos to say the least), the Alberts, and the McCabes. There are VERY few witnesses that are openly answering the defense's questions. If one is going to look with a wide lens of suspicion, then it must also be applied to people other than Read. It's likely that Read did it. It's also likely that someone beat the tar out of O'Keefe and left him in the snow. However, I have yet to see any evidence that proves beyond a reasonable doubt that Read did do it. I, too, would like to determine the truth, but I think we are going to be disappointed and come up empty. Nevertheless, I'd rather 10 guilty people walk free than one innocent person be convicted. Further, I'd like to see justice for O'Keefe. Unfortunately, the State did such a horrible job, starting with the Canton PD, that we may never see justice for O'Keefe ☹ I think that failure lies solely at the feet of the State.

Just before the Karen Read case, I thought that the cops in the George Allan Kelly case were horrible. These Canton PD idiots make those folks look great!

I had a Uncle and a couple of friends across the state line into Tennessee, they have to take their trash off. They don't have pickup in certain areas there.

At the very beginning of the trial we learned that it was Karen Reads dad that called in for her to be evaluated. I guess she was saying she couldn’t live without him and he dad was worried about her. When the EMS workers were questioned at the beginning it was very apparent they did not agree with this decision. But it seemed like to me the EMS workers thought this was something the cops were doing and they may not have realized it was Karens dad that made the call.
Love it when Rick covers a trial. Always a good breakdown on who’s doing what and why. It would do a lot of people a lot of good to learn that stuff as there is so much Tom foolery going on and you’re average juror probably doesn’t have a clue. Who knows maybe they would even stop some of the BS if they knew the jury saw right through it.
It doesn't matter whether you save it or not. The cell phone provider saves all text and phone calls and data.

Interesting case. What is ALSO interesting is the amount of You-tube lawyers thinking she is not guilty. Most of it is running holes thru poor Police work. Not sure of who did it, but Karen is a fatal attraction type.

Indeed. The "lawtube" is approaching this as it should be approached. Did Karen do it? Likely. Can the State prove beyond a reasonable doubt that she did it? They have yet to do so.

Well people tend to go for conspiracy theories. I've never quite understood why. The beauty of a good conspiracy is confirmation bias kicks in and you can see evidence of the conspiracy everywhere you look after a while. I just got into the phone issue because I couldn't figure out why if everybody was "destroying evidence" they weren't in orange jumpsuits for obstructing the court. Turns out the defense decided to send an untraceable "preservation letter" to several witnesses in the same month the new iPhone was released. Which was 7 months or so after the incident. So.... you can't actually prove when anybody got the letter to preserve their phone and you sent it just before an upgrade cycle. Now .... surprise, people upgraded and changed carriers etc. .... just more proof of the "conspiracy at work." That just looks like lawyer tricks to me.
This is why I trust Rick. He just wants the truth and I can relate
The yes or no questioning trick usually has an assumption in the question that the attorney would *like* the jury to agree with them ( the attorney) about. Q: You'd agree with me that Karen Read is being framed and you're one of the framers, right? There's NO winning regardless how you answer. The question assumes the witness is framing Karen Read so his answer really doesn't matter. It's just another way to get the idea Karen Read is being framed before the jury. The prosecutor would object because the question calls of a conclusion (not allowed) or it's compound (has 2 separate questions in it which is not allowed) or whatever but, that doesn't matter either because it's out there in front of the jury and it implies this witness is "in on it."

Instead of blaming the ususal suspects ( the dog or random strangers ), today KR and her defense choose to blame " MS " It's Multiple Sclerosis's fault KR's blood achohol level was above the legal limit at 9:43 am. Absolutely ridiculous! Justice for John O'Keefe and his loved ones ⚖⚖⚖

How do you explain the missing footage from the library at exactly the time she was driving by. Or the missing footage from the Sally port. Or the fact that Jen McCabe called John's phone five times right after midnight and when both phones were checked, the calls were reflected in John's call log, Jen had deleted hers. Too many coincidences ain't no daggum coincidence. Behaviors don't lie, and the behavior of all of these people was way off. Quit being a big dummy Rick. Lol.

With all the talk of how bad the snow was, I am not sure I'd wish that upon him 😉 When he first brought up the trial in his LIVE, I said that he needs A LOT more information than he has.

As far as history on my phone, it's set to keep messages and things for the minimum amount of time the iPhone allows (30 days max). So.... if you subpoena my phone 7 months from now it's not going to have anything on it that's on it right now. If you send me a letter that can't be tracked in September when the new iPhone comes out, I may have a new phone by the time your letter gets to me. And, without tracking you can "claim" I got a letter I never got and pretend I was supposed to have gotten it the day you wrote it. So..... whatever

Howdy Rick. Personally I still think Karen did it, drunk and stupidly. On purpose ? Accidently ?? I don't know, but I'm pretty sure it wasn't with deadly intent. Pretty obvious, IMO, that she later realized there was a big problem when he didn't show up later that night. Then knew exactly where to look. I can't buy the BIG CONSPIRACY. People please don’t go by the three drinks in an hour, .06 I am or was 180 pounds 5 foot eight. I had one shot of tequila and four Heineken’s over the course of probably three hours and blew 0.09 I have never been a big drinker mainly on special occasions but I was a teenager or I’m sorry 24 and didn’t know any better. The stupid cops cuffed me took me to the station without doing any roadside sobriety test I didn’t know any better so I blew.09 no accident involved no victim. It’s not worth it lost my job really messed up my life for a couple years. Have a good one gun people

I am so sorry that happened to you! If you blew close to your last drink, that might explain the 0.09. Fortunately, I had a couple of criminal attorney friends (both were judges at one time) who advised a bunch of us: NEVER BLOW and NEVER GIVE A BLOOD SAMPLE....just take the ride and be out in the morning.

In Missouri the law says if you refuse to blow, it an automatic 1 year license suspension. Or it was the last time it was an issue. I blew 0.14..... expensive

@@wldtrky38 License revocation for not providing a sample (e.g., blow, urine, blood, etc.) is a civil process, and one gets his or her day in court for that. Also, if one's license is revoked for not providing a sample, he or she can still be permitted to drive for like up to 12 hours per day to get to and from work and to and from the grocery store, etc. Further, in the license revocation process, your attorney can get question the arresting officer on the stand, which may provide him or her with information to better advise you or to help you in your criminal trial.
