Justice Lokur: 'Supreme Court Not Fulfilling Constitutional Role Adequately, Needs to Introspect'
In the first outspoken criticism of the Supreme Court by a former highly regarded judge of the Court, Justice Madan Lokur said he is “disappointed” by the Court’s functioning. He said “It is not fulfilling its constitutional functions adequately.” He said “the Supreme Court of India is capable of doing a good job but I think they need to introspect, they need to sit down, brainstorm and figure out how to go ahead.” He said: “Certainly it should be more pro-active than it has been.”
In a 28 mt interview to Karan Thapar for The Wire which will go up on The Wire’s website between 9.00 and 10.00 PM tonight, Justice Lokur answered a range of questions covering the Court’s inadequate enforcement of the right to life of migrant workers, its prioritization of cases on the basis of which some are heard immediately and others indefinitely deferred and the inadequate exercise of its power of judicial review over govt policies and action.
Speaking to The Wire about the 3 weeks the Court took to dispose of a petition on the right to life of migrant workers, Justice Lokur said: “Yes, I think the Court let down these migrants. Certainly.”
Referring to the Court’s anodyne request to the govt to “take such steps as it finds fit to help the migrant workers”, Justice Lokur said: “ I think the Court should have and could have gone much further.” He said for the Supreme Court to say “whatever steps you’re taking is good enough is not an answer particularly in a situation like this.”
Asked by The Wire whether he agreed with Chief Justice Bobde’s stand (expressed in an interview to The Hindu on 27/4) that “this is not a situation where declaration of rights has much priority or as much importance as in other times”, Justice Lokur said: “To say that fundamental rights are not so important today because of the prevailing situation is the wrong way of looking at it.”
Justice Lokur said views similar to Chief Justice Bobde’s had been voiced by the majority in the ADM Jabalpur case but time had proven the minority view of Justice Khanna to be correct. He said: “You can’t say today let’s forget about the right to life. If you can’t forget about the right to life during the Emergency I don’t see how you can forget about it today.”
Speaking to The Wire about the way the Supreme Court has deferred cases to do with migrant workers or NREGA payments but heard within 15 hours Arnab Goswami’s petition seeking protection against multiple FIRs, Justice Lokur said “it was very very wrong of the Supreme Court to have taken up that case without it fitting in the category of extreme urgency.”
He said: “Given the situation nothing was more important than the right of the migrants wanting to go back home, their shelter, their food, their wages. This was of crucial importance and extreme urgency. Against that you place a case where (perhaps) 10 FIRs are filed. What is the urgency? The police have not even acted upon these FIRs. The possibility of an arrest is almost zero…if you compare the plight of the migrants, the plight of the poor, as against this there is just no comparison at all. I think it’s very very wrong on the part of the Supreme Court to have taken up that case without it fitting in the category of extreme urgency.”
Asked if such prioritizations were a reflection of Chief Justice Bobde’s priorities and thinking, Justice Lokur told The Wire: “The buck has to stop somewhere. Either it stops with the Secretary General or it stops with the Chief Justice…ultimately the buck has to stop somewhere…it would be a good idea if the Chief Justice conducts some sort of enquiry to find out what went wrong.”
Speaking to The Wire about how the Supreme Court has repeatedly deferred all the constitutional petitions pertaining to the change in status of Kashmir and the Citizenship Amendment Act, Justice Lokur said: “It’s difficult to understand. These cases are very important because they have the character of affecting a very large section of the people. Huge sections of society are impacted. These cases should have been taken up on a priority. I’m frankly not able to understand why that priority has not been given to these cases.”
Justice Lokur spoke in very similar terms about the Supreme Court’s repeated deferral of habeas corpus cases. He said to The Wire: “This is a matter of extreme urgency. A person is kept in detention without a trial for months together. These habeas corpus petitions should be heard. How much time is it going to take? One hour? Two hours? May be a day? Why not hear them?”

Thanks Justice Lokur and also Karan Thapar for the interview because of the reason that the present CJI seems to be with the Govt. and not with the constitution.
SC was so prompt in hearing Arnab Goswami and kept pending all the petitions on CAA, Election Bond and other Constitutional matters... This itself speaks volume about the functioning of SC...
Justice being done as advised by the ruling pty and the Sangh.
Such a nice and linear person . I watched interview of Justice Gogoi. Now I must say justice Lokur is humble and seems have to no false ego of being retired Judge of SC.

Ex-Justice Madan Lokur, It was a pleasure listening to you. It was a modest and humbling way of putting across a view which is not so palatable but speak it such a way that without crossing the Laxman Rekha, say it subtly and yet say it succinctly. Always make it a point to listening your interviews to learn the art of putting across a view without causing acrimony and rancour.
*Whenever i watch Karan Thapar sir, i always remember that historical interview with modi ji in which he runned away* 😁😅

I think he wants to be fair to the judges who deliver justice in these trying times. It's easy to make sweeping comments like there is no hope for the SC etc but the truth is till everyone goes to the other side there is always hope despite glaring injustice.

It is quite easy to identify a media cell daily wager doing his troll job by the type of language and arrogance in his/her tone ... Anyways it is not their fault ... it is the shortcoming on the part of their trainers ... Would suggest the media cells executives of both the major political parties to please hire some decent trainers. I strongly believe that there should be special classes in every village and city to teach our constitution and rights and how courts and parliament administration and government of India should work And what are the ways or channels available to raise the concern for common people. I think same as how workers go around to raise awareness about family planning or vaccine against polio. Please make your program on this and ensure it is in Hindi.

Pre emptive mindset towards CAA 4.providing clean chit to Go Gogoi in sexually harassment case intrinsically 5. Over exhaustive mindset of Judges. They r just doing as per s current govt only ...They don’t have any authority now....RIP SC😔

When you are surely capable of doing something which matters and uphold the constitutional duty and gives great degree of relief to the affected people and surprisingly you are not doing so then what's called that is Apex court of India. Thanks to the Wire for this wonderful interview.
I've high esteems for High Courts but very sceptical about Supreme court.

Besides The Wire's unbiased and fearless journalism, which is quite frankly brilliant, I especially look forward to Karan Thapar's interviews. Such relevant questions which go unanswered otherwise.
Karan sir U have my respect for the way u do interviews & ur attitude
Karan, your interviews are so enlightening that they must reach to every Indian but the language of your interviews is English which limits your audience. I really think that these interviews must reach every corner of India. Please do them in Hindi so that so many illiterate or half literate population (including our politicians) and literates can understand.
There is only one option left with the citizens, post lockdown come down on streets, it's a question of saving the very spirit of India else India will be permanently pushed in the darkness of dictatorship.
Justice Lokor has an extremely Beautiful Image as a Judge of the apex court of the largest democracy of India
Karanji as usual and as per best of your ability you have asked each and every question very-very well and very and candid and honest answers given by honrable justice but his mild smile on the question and answer is a real slap on SC and judjes and there lofabl attitude and judjments
Prashant Bhushan hit the nail on the head. Supreme court gives out an appearance of doing favor instead of discharging constitutional duties which they must. The court in the past always followed open specific principles and procedures that was not usually covered by mystery and suspicious behavior.

Its not about only two people... all this is happening due to their organized and planned organization RSS and their affiliates and associations, individuals who are present in every important institution of the country, with their Fascists and Racist ideology to convert the country into Aryywar Hindu Rastra... We all need to standup to save our democracy, our country, our rights before its too late...

Like Fari S Nariman had said, God Save the Supreme Court. And J. Lokur has been extremely diligent in not having uttered anything that would be prejudicial to the dignity of the Highest Court as an institution, but at the same time has brought out the improprieties in a very elagant, rational manner. God save the Supreme court, and if he still has the ability, God save this Country.

Not only this one, but all of the constitutional institutions have polluted completely. Did these policy makers ever realised the consequences?😡😡
Every time a petition is filed in any Courts, the Govt. says it needs weeks to respond, and Court grants them those time. By the time next hearing comes things have passed and damage has been done.....
Hope the good sense prevail and SC starts hearing those very important and urgent pending cases right from abrogation of article370, 35A, CAA... and delivers its Constitutional duties towards We the people of India... Whole country is watching, whole world is watching... Jai Hind...🇮🇳

S this is the quality of a judge justice Madan lokur we are now missing in the current set up in S C so there's no hope for the common man to get a justice from the top court people had high hopes but moved to no hope zone .
