Judge Makes Key Ruling in Alec Baldwin ‘Rust’ Movie Shooting Civil Case

Attorneys representing Alec Baldwin and El Dorado Pictures appeared in court on Tuesday after they filed a motion to suspend proceedings in their civil case. Baldwin’s defense asked the judge to wait until his criminal case is settled before continuing with the lawsuit against him and the production company for the fatal shooting of cinematographer Halyna Hutchins. The famed actor was indicted on one count of involuntary manslaughter in January.

    When Baldwin did his police interview he showed his knack for talking too much. He was even laughing a bit as well as trying to "school" the cops in how movies and production work. Every lawyer I've ever talked to says you should have a lawyer present. At worst... you only answer the question asked and never provide more information than what you are asked.

    Shame Alec Baldwin took a lacks in such a serious issue. My personal opinion he doesn’t ,or isn’t accepting what happened as he did fire the gun and admitted to this when interrogatored. Anyway, he didn’t know that the woman was dead, but those detectives took him through a lengthy process questioning him~~ then they told him she was dead~~~Hey 👋 they knew this before questioning Alec who should have LAWYERED UP STAT & zipped 🤐it. .

    Which accident? You refer to the version where he had the trigger already depressed enough that when he cocked the gun and released the hammer it fired (as intended by the design)? Because otherwise it's quite deliberate to pull the trigger to fire the gun, which isn't quite accidental imho.

    This entire accident had absolutely nothing to do with pay. Where in the world did you get this from? It had to do with her carelessness, negligence, and inexperience. HG worked on only 3-4 sets as the principal armorer before Rust.

    ​​​@@ebogar42- Several staff reported that Alec was on the phone excessively during the firearms training on set. Further, it was clearly Alec's responsibility to do the final check of the ammunition in the firearm. According to eye witnesses, Alec did not even begin this final check, which was completely his responsibility. This is why he has been criminally indicted. Obviously, several people were criminally guilty in this tragedy. This includes Alec.

    Not "suspend" but "stay" the proceedings. Common practice is when a defendant in a civil matter is also a defendant in a criminal matter, the civil matter is "stayed" pending resolution of the criminal action. Otherwise, the defendant's testimony in the civil matter could be used against him in the criminal matter.

    No 5th amendment in civil case. They applaud others having to deal with both at the same time but will move heaven and earth to keep themselves out of the traps they create for others.

    Showing Baldwin shoot a blank round immediately AFTER the director calls 'CUT!' is shady. If he had ear protection in for the blanks, then he may not have heard it called. And if he was going without ear protection, then the previous shots he fired prior to director calling 'CUT!' could have deadened his hearing ability for a number of minutes.

    Well that means they’re not getting paid for airing the video. Sometimes I don’t do a lot with certain videos, but other videos they do A heck of a lot, including having to pay some of the salary for a cameraman to go record during trials and such. Plus other things.

    We've seen an entire trial and a woman found guilty for handing off a loaded gun.. Now lets see the trial of the person that fired the gun killing and wounding people. Not to mention he wasnt just an actor..he was the financier of the film.

    You don't need to be a lawyer but it was very dry. Essentially, this is one of multiple civil cases filed against production/Baldwin and he ruled that much of the discovery process is to be delayed until after Baldwin's criminal trial 'concludes' this summer. Primarily, it's to delay Baldwin being questioned under oath by the plaintiff to avoid such depositions potentially influencing the trial jury. Whether this is truly necessary is another question and I could definitely see why the plantiffs would object to the idea. Baldwin's attorney is likely confident they'll win the criminal trial after the recent verdict and I'd imagine that could influence some of these cases. If he loses it could be problematic but civil cases could extend beyond the criminal trial either way.

    @@444_GodsGirl The industry practice is that the actor does NOT need to check the gun. They wouldn't necessarily even know what they're checking FOR. That's the whole point of having an armorer on set. Why have the armorer there if the actor is legally required to know everything the armorer would provide?

    Don’t let the fact that Halyna Hutchens is dead be any inconvenience to Alec Baldwin. Ms Halyna Hutchens no longer has a fifth amendment privilege because Alec Baldwin pointed a gun at her and pulled the trigger. It’s sounds like all this hearing stuff is getting in the way of Alec Baldwin scheduling. Alec Baldwin’s unwillingness to hand over his phone and allow access to all is very telling that Alec Baldwin has something to hide. Ms Halyna Hutchens didn’t have any protection, why should Alec Baldwin have protection? 😔❤🙏🏻 God bless Ms Halyna Hutchens❤️🙏🏻

    Baldwin's legal team have one major obstacle, Baldwin himself. He talks too much and likes to take control. I picture proceedings, in both cases, where we hear a lot of objections. On one side trying to stop him talking, and from the other to needle and annoy him into saying more. Should be very compelling stuff.

    Cases like this rarely change things in a corporate setting. Drugs and film making go hand in hand, they always have, as do most high profile and money rich professions. You can't change the culture within an industry that quickly.

    My favorite Millhouse episode was when he got a job acting as radioactive man’s sidekick: Fallout Boy!! The episode was about how acting caused Millhouse to give up his friendship with Bart, so Millhouse quit the job just before the elaborate last scene, where he was meant to stop a river of acid from engulfing Radioactive Man. I won’t tell you the ending but for those who’ve seen it “My Eyes!!! The goggles do nothing…”

    Baldwin was in charge, responsible for the safety. He chose to ignore protocols. As Hannah was responsible as armour with gun safety, Alex is responsible for following protocols and safety on set.

Hannah was hired because of her expertise with these particular guns and gun practices associated with them, not because she was cheap and inexperienced. $2500/week is not cheap.     “i did not pull the trigger. I would never point a gun at anyone. I know better. I have used guns for many many years. I feel no guilt! First interview talking to wife arranging going out with family the next day!! Where is his heart? His concern for a dead woman? An injured man? A terrifying shooting? NONE! He did not clear/warn crew before practicing. Video shows him pulling out Gun, pointing it and finger on the trigger. Hello. He will get on the stand! He will not resist.

    Idk how it is in Hollywood, but regardless...anyone who grew up on a farm knows more than Hannah and Alec seemed to know. Always treat a gun as if it is loaded, never point it at anyone ( aim at ground) unless u intend to harm that person.

    When did responsibility of a fire arm fall on someone other than the person holding the gun. She failed as the sets armorer but he failed at making sure the firearm was safe either. I was taught that you dont rely on someone else to tell you its safe. If rounds are in said gun I had to make sure said round was the proper round that was suppose to be in it. Thats the first thing you do is check the gun when handed to me.

    As an EP, Baldwin knows all time in a film shooting is money. He appears to have been reckless in some of the footage. One piece of video shows him rushing the armorer to reload faster. Pleading the 5th won't help him in NM.

    The convicted woman, Ms. Gutierrez is only getting about 18 months in jail for killing someone with her negligence. Sentencing is in June. Live Ammo is not what any Actor expects to have come out of a "Cold gun."

    Can't the bullet casing be traced back to a particular box, purchased by a particular individual? I've not heard any of the trial cover this avenue. If someone on the set bought live rounds and brought them in to use, it might indict them in manslaughter.

    It seems to me that common sense dictates that if he admits and all witnesses testify that he so much as pointed a gun at a victim he is criminally responsible for what happened. He had no business holding a gun if he is truly that ignorant of basic gun safety.

    I watched most of the trial for Hannah. She handed Alec the gun and should have checked it right before she handed it to him. She would have caught the live round. She would have seen it either in her hand when loading them, or when looking at the cylinder from the front of the gun. The whole gun ammo set-up on the set was sloppy and unorganized. She was inexperienced. And I couldn't believe how little emotion she showed all through her trial. But Alec was also Pushy, Rude, Belligerent and in a rush. He acted like he just wanted to be somewhere else. To get it done, like the movie was an inconvenience. I also can't believe why Alec wouldn't have always checked the guns he used himself as well. I certainly would. To point any gun at another person even in a movie is a serious endeavor. And his total lack of emotion was even less than Hannah's at the shooting site. He just left the church and didn't even assist the others helping Halyna after she was shot. Not even holding her hand. I would have been beside her in the helicopter! If you have ever seen the movie Heat.. remember how many rounds were fired in that street shootout scene with automatic weapons? And know one was wounded or killed. Rust was just a few single action revolvers and lever guns. Now that's the difference in safety and professionalism! And if Alec claims he didn't (pull) the trigger.. then with his thumb on the hammer he depressed the trigger. Then let the hammer slip off his thumb. I was a hunter for over 40 years. I am 65 years old. Back when I was in my 20's I was deer hunting with some relatives. We were all standing in a circle in a woods road waiting for daylight. My brother in laws brother (inexperienced) was loading his lever action rifle and decided to lever in a round. He let the hammer slip. The gun fired right in the center of the circle of men throwing dirt in the air. Its a miracle he had it pointed at the ground and not at one of us. I was standing beside him I'm glad I wasn't out in front.

    everyone is on a witch hunt against Alec Baldwin just because he's Alec Baldwin. He was handed a gun by the armorer whose job is to make sure the gun was safe. He trusted that process. He didn't kill on purpose, it was a terrible accident. A nightmare for anyone who could have been handed that gun by that armorer.     This whole case has been interesting. The female atty for the DA's office needs to stomp her glasses into the ground and get a new pair of bifocals so she isn't constantly flipping her glasses up/down. I'll bet she could even get a pair donated. Although she got a conviction on Gutierrez, which did not require much talent, she needs to do a dramatic change in appearance and professionalism. She appears an amateur. If I were AB, I would not be sleeping well.
