    Such things happen regularly in courts. At times it becomes difficult to explain very simple things. Tempers run high. The government advocate was not wrong... But he is no doubt bit short tempered or irritable. If a lawyer is constantly interfered or interrupted he will lost his cool or balance. Centuries back it was said that a judge must hear patiently.

    True. However, my observations with respect to this judge is, he asks very pointed questions to the advicates/solicitors. When they do not respond or start brow beating he can get impatient, and rightly so.

    The hon'ble judge is bit harsh in imposing cost, as the learned advocate is only putting some facts before the court. The court has already rejected the contentions in his order. Then why cost is imposed.

    I really like this judge, the way he speaks firmly, it's amazing. in Kolkata courts require these kind of judges, matter won't last long and people get justice fast.

    What is he doing in Bihar high court if he doesn't even know Hindi? Language barrier seems to be a huge issue when 90% of documents are Hindi and need to be translated, where there can be a many a clerical errors in translation.

    Lawyers are expected to be articulate in the language in which they argue their causes. Most of them can barely speak English, the required language of the high and Supreme Court.

    Unfortunately, many Advocates are not sincere towards their clients. Sometimes, even if the truth is with you, only because of the carelessness of the Advocate the case goes against you. I had an experience and I took permission from the Judge and I argued my case myself and got a favourable order. If I was not alert or illiterate, I would have lost the case ever after I was on the right side of Law. After 1.5 years of the case, I was byheart with the facts and dates which saved me. This is the irony.

    @I am Sorry It was a civil case. I took permission from the judge in presence of my Advocate. The judge allowed me to have my say and it was very important point my Adv missed.

    @I am Sorry What procedures? Milford Milford saying in between?. It is upto the judge to permit the Plaintiff to say few points infront of his Adv. Yes as I said earlier, at some point of time I started to feel that who is the Adv? Bcz I used to teach the Adv on the date of hearing. I am not saying they do it deliberately. But they take up all cases and they hv no time to study the case perfectly.

    Lawyers should come prepared and focus on the limited point of the case to bring clarity and solution. But what a colossal waste of Court's time on such cases, caused by poor governance at the District level.

    Why judge so much rush, lawyers always come prepared. Issue is with judges, they start making preliminary assumptions.and try to drive and control the proceedings and try to guess the submissions even befor advocates speak. Judge must limit his prejudiced/judgemental behaviour he must listen patiently and allow lawyers to drive and submit their arguments and not to guess their arguments before submissions.

    As per indian constitution english is the language to be used in high courts. However the laywers are not fluent n comfortable using English. I wonder how they passed the bar exam ? The judges lack of patience is understandable.

    Legal Profession is the only profession where the regulation has diluted a lot. The quanitity of lawyers being churned out from every nook of the country has led to the dilution of the quality. We need to have strict compliance as well as standard exam for qualifying the same.

    Laws are very simple to interpret but judges make it complicated.And now a days every thing goes wonderful and scrutiny or interpretation of evidence on record does not run with the Law but it walks with set of mind of a judge and therefore we can not get justice but receive decision.

    Judge behaviour is very rude having no sense of insulating anybody as there is no personal matter here and be remain independent in Judgement process. If any misbehave noticed then proper action must be taken by another judges bench on this type of roughness and not be tolerate because this is the matter of Justice on the basis of pure humanity. Very shameful.

    He dont want to waste time hearing the whole story, thus to save time inorder to take a faster decission, it is quiet natural that brilliant justice asks random questions like this. Th ability of a learned and good advocate is that he should be deeply thorough with the facts of the case, so that he can utilise the opportuniy, when gets a turn! When the judge is trying hard to do the homework, the Advocates should do their part well too, by staying away from procastination! 😂

    As judges get transferred any where in India they are not expected to know all languages of India the most common is English next comes Hindi. The local courts should adjust to honorable judges .and Don t expect judges adopt

    @@abhishekawasthi3827 if u think language of judiciary is english then u cant be more wrong. Below HC in every state there r many courts which work in local languages only. In Gujrat lower courts do everything in gujrati so is the case in keral so in TN. So technically english is a thing qhich is imposed by HC only. All papers r in local language HCs get it translated and then proceed .

    Most lawyers speak to influence, a Judge sees through all the bullshit and tries to stick to the facts of the case. If facts are not presented in a direct manner when questioned - Judge may tend to talk in an aggressive way😀

    Cases should be heard in regional languages as it is seen in this case its inherently difficult for the lawyers to communicate in English. Language is a means of communication and if proper communication does not take place using the language which is not the mother tongue of the communicator the whole objective of communication becomes futile. This can be detrimental in a profession like law where proper communication of one's stance is so important.

    Judges get transferred all over india, they may not understand regional language of the place they are transferred to. Forcing hearings to take place in regional languages of the court will increase the problem of the language barrier even more.

    The honourable judge is a brilliant one with Police mind and knowing all practical cum Law procedures. Thus, he cannot be tricked by anyway! For the reason above, he dont believe things so easily & he randomly asks random questions, which make the unprepared Advocates to wet with sweat, some lose coolness like this! However, Patna Court has a good asset with them!

    Poor fellow from the petitioner's sise. He just missed to apprise/convince the court that there is no departmental order wrt placing the petitioner as Accountant in the light of the final order of the court. That's why the contempt.

    I have been to taluka court for justice, The judge advise me to become a person to whom i had accused , what a shame, these corrupted juge just give date after date, and the next judge told me, if i have paper of my land and i pay the land tax, it does not mean the land belong to me, which means if a bad person put a gun on your head and tell you to go out and you leave your home and he occupies it then you go to court and such shameless judges give you sermons to become a person like that bad person, how do you feel ? I do not believe in this judiciary system of india, these corrupted police and judges are real terrorist of india . I hate this entire judiciary system of India which just entertain the bad people and bad mafia. Only the God is judge in india, the police station where i had filled the complaint , he did not took me to court and the court closed, because i had not given him rupees. I think money is the judge of india, the more you spend the quickly you get results. Billions of cases are pending which is crime in itself.

    Attitude of judges are inherent from British era, the way they is to sentence our Indian’s. Still advocates need to address them as My Lord. They need to speak in regional or Hindi language.

    senior lawyer was irritating, unclear and reluctant. He blamed judge for his own unpreparredness. Senior lawyer should not be like this. He should have been fined for sure.

    सीधी बात नो बकवास: वकील हिंदी में ही बोलना चाहते हैं और मीलोर्ड इंग्लिश में। एक mismatch है। समस्या गई तेल लेने, हमारे देश में पद आपस में ही लड़ते हैं। दूसरी बात आप कोर्ट से लेकर संसद तक देख लें, बात को साफ तरीके से बोलने ही नहीं आता। More noise less substance.

    Abe chal be fukat gayan mat pel. All these are allowed. Nothing was done and said wrong. Abi tune dekha aur suna hi kya h. Its considered unethical by the judge to apply contempt on lawyers for behavior, attire n other reasons. Lawyers are future judges of courts and both work hand in hand. Court contempts are meant for disobedience of court orders thats it except that everything else must be dealt with patients and forgiveness

    why he took office at patna high court, where most of even college grad can not speak fluent english. He should request for transfer and hold office in south states or in metro citites where most lawyer can speak english.

    Its sad to see that In Indian courts you are not allowed to argue in your mother tongue just because judges aren't comfortable, we see in other jobs there clearly mark the knowledge of regional language for certain govt. jobs failing to do that you can't be appointed there then why can't the judges be asked to have knowledge of regional language or at least they should keep a translator with them for this purpose instead they ask the advocates to use one.

    Judges from different parts of the country are posted to different states. If you keep posting only judges of that state to the high court, it can bring in cultural bias when any one party in the litigation is from some other state. Also, judges can get transferred or rotated based on tenure or personal preferences. You cannot have homogenous bench because the law needs to be applied uniformly across the country, which requires bringing opinions and judgement from varying schools of thought.

    Abe andbhakt here the judge is not allowing to argue and submit the arguments at all by the lawyers and you are talking about allowing it in hindi language. Wat language makes a difference when judges judge/guess/assume more and listen less to the arguments. Courts are meant for hearing they must listen EVERYTHING calmly and not try to rush to conclusions.
