It Rained Money on a Busy Highway

It was raining twenty-dollars bills on a California highway and lots of people stopped to scoop them up. Thousands of dollars in cash fell out of a Brinks truck near Carlsbad. Folks pulled over and jumped for joy as they picked up the money, just like they won the lottery. Two people were arrested at the scene with the cash they collected and the FBI is studying videos of the incident to find others.

It should only be considered "theft" if the armored truck guards or the police were on the scene actively trying to secure the money. I saw an empty truck in the video. And money was still strewn all over the highway the following day. The sheriff is just trying to intimidate people into turning the cash in. Legally I don't think a case would stand up in court. Besides, armored truck companies and banks have insurance precisely for situations like these. This is misplaced/damaged property.

No. It's definitely theft if they took it and didn't return it. You knew it wasn't yours, you still took it. The end. Even if they were collecting money the next day or two from the scene that doesn't change that you took money that wasn't yours.

Hypothetically speaking if I were driving, and happened upon a scene where there was money on the road, and I see people grabbing it could I be charged if I get out and pick it up as well? If I arrived after the brinks truck was gone, where exactly is the crime? Doesn't robbery require intent? Hypothetically speaking I just saw money on the ground and picked it up. It's not like I actually saw the money fall out of the truck, if the truck just left the money isn't that a case of abandoned property, and negligence on the truck's security? Seems like an illegal arrest to me, but I'm no lawyer, I'm just curious about the robbery charge. If I drop a twenty dollar bill on the street, I can't just claim someone robbed me.

Exactly. Malum prohibitum. You're not stealing money, you found money on the ground. The charge would be "failure to return lost property" which is a misdemeanor in CA. And even then a defense could be 'it was money falling from the air, i dont know who it belonged to and had intended to return it to its rightful owner.' You can take all the time you want to returning it as long as you can convince the judge or court that was your intention (i.e. dont shout out you're going to spend it at Sizzlers, dont put it in your bank). In the meantime, stash what you can and avoid jail by turning it in to the CHP and clear your name. Not that I'd recommend anyone ever do such a thing, that would be illegal.
