Since it was established in 2002, all 30 cases brought before the International Criminal Court have involved African nationals. So is the court being used as a colonial tool? VICE World News talks to experts to find out.

    I can answer why they decided not to go against the UK. Probably cause the UK contributes a big percentage of the courts budget. The answer to these things is always money.

    The ICC only has the powers that members give to it. In the end it is just a show to create an illusion of small justice. What is the yearly cost of it? Is it adequately staffed? Historically, have member countries respected its ruling? I'd like to know the answers.

    @@luhevieira This argument covers way more then just engaging in wars. Isolating prisoners, police brutality against civilians and even the persistent campaigns from certain media to dehumanise and discriminate certain groups of people within their own country could be considered torture in some cases. Especially if the victims of those actions get denied the chance to stand up for themselves and search for restitutions afterwards.

    Russia got tried for its crimes in 2008. The majority of wars are fought in Africa and the Middle East, so you’ll definitely see those numbers go up. Plus many of these wars are one African group against another African group. I fail to see why they are bias.

    @@Walmart1 How? The only people who care about prosecuting war criminals are Europeans, Americans, and other Westerners - that's why the ICC gets most of its funding from them. The very concept of "war crimes" and the associated legal ramifications was wholly created and supported by them, and exported to their former colonies. Non Westerners, thus have no business accusing the ICC of "racism" or being "colonial" when, without it, there would be no war crimes prosecutions at all, or even any idea that war crimes exist.

    I always wanted to work for the International Criminal Court, I even had my final year project on the ICC. But upon completion it was clear that they weren't interested in Africans working for or with the I.C.C just prosecuting us Africans that's all. After much uproar Fatou was placed in the position she is currently but still Africans are over looked during employment of prosecutors, support staff, researchers etc.

    I know a guy, a friend of mine who was in the military in Afghanistan. Now, i'm going to be vague to protect his identity, but he told me how a Royal Marine patrol drove through his unit's position as part of their patrol route. When they had driven about three kilometers they drove into a village he and his unit had been building a relationship with during his deployment. They had never taken fire from the village during his deployment. The British Marines open fired on the villagers, killed 15 civilians including several children. The next time his unit drove through that village, there was an IED. The British later claimed the Americans shot first and they both were engaging armed targets but his unit had no weapons capable of shooting out that far, let alone at the world record range for a sniper kill. The American troops had never fired during the event. Before the massacre he said the Brits would kill the Afghans livestock for no reason on several occasions.

    The problem lies, as highlited, in the conventional and voluntary base of internazional courts jurisdiction. The court is not racist, it's simply impossible for them to prosecute crimes committed by powerful states, because they don't allow it

    Exactly this. Like they said at 9:57, those prosecuted were simply the losers of a conflict and were handed in by the victors. The victors most likely had their fair share of war crimes but they wont be handing themselves in any time soon. The fact they they blame it on racism shows that they rather think emotionally than logically.

    International "law" always works that way, because it can't be any other way. Countries have a military to defend their sovereignty, so the ICC just plays pretend prior to executing whoever they get handed.

    If you study international relations, one thing to learn among the first is, that the international system is in itself anarchistic, since there is no true authority above the national states. There might be some rare regional excemptions like the EU, but on a global scale there is no legal binding authority to obey that actually has the force to make the states obey. The great powers cannot be forced to submit to anyone and wont be for any time. That is just a sad fact that is not complementary with things like the International court. Idealism can only go so far as power interests allow it to go.

    Russia got tried for its crimes in 2008. The majority of wars are fought in Africa and the Middle East, so you’ll definitely see those numbers go up. Plus many of these wars are one African group against another African group. I fail to see why they are bias.

    The clip showing the soldier shooting off the bridge was from the Democratic Republic of Congo in 1998 at the beginning of the Second Congo war. Those were FAC soldiers (Congolese government soldiers supporting President Laurent Kabila) shooting at a suspected Tutsi RCD rebel or sympathizer near Kinshasa in the province of Bas Congo during the rebel offensive on the capital. At that point in the war the FAC were engaged in fighting with the Rwandan and Ugandan army and their proxies, at that point it was the RCD(who were mostly Tutsi). The FAC were fighting off the offensive on Kinshasa in Bas Congo (Operation Kitona) as well as the RCD (10Bde Goma, Led by jean Pierre Ondekane) mutiny and Rwandan and Ugandan invasion in the east of the country. The FAC managed to successfully defeat the rebels in Bas congo preventing the capture of Kinshasa mostly due to the support of Zimbabwe and Angola. For the rest of the war the FAC fought the Rwandans, Ugandan and proxies along a front that divided the country into two from Dongo in Equateur Province to Pweto in Katanga until 2003. There was much in fighting and divisions amongst the rebel groups and well as local uprisings (Mai-mai militias) within foreign controlled territory which still continues to this day.

    Lawyer here: There needs to be a couple things to happen, of course a crime of war, crime against humanity or torture, but there also needs to be impunity in the country of origin, so unless both of these happen the ICC won't get involved. That said there are open investigations against Bush and US soldiers and UK soldiers that were involved in crimes of war and torture in Irak, to the extent that they can't leave the US without risking being arrested and presented to the ICC.
