Hi Brian, thanks for asking a great question. Technically, you are legally allowed to work while collecting permanent disability benefits since it is not a wage replacement like temporary disability. However, it may not be advisable depending on your particular case. You should always consult with your attorney before looking for work to make sure that it won't cause any issues. If you do go back to work, be cautious not to exceed your work restrictions otherwise you risk aggravating your medical condition to the extent that you need additional treatment or time off work, in which case the insurance carrier may try to argue that your new job caused new injury.

The employer denied responsibility so my claim was denied and I was constructively terminated. I have continued with the process and the QME validated my psyche claim. My understanding is that I will have another QME eventually to determine PD. Meanwhile, time has gone by and I have not been working but I have continued school - primarily online. I did a paid internship with accommodations including a very flexible schedule and fully online. It did not aggravate my injury. I have no money coming in. I am concerned that the temporary work will hurt my cIaim and eventual hopeful settlement. Any advice? THANK YOU SO MUCH FOR SHARING YOUR EXPERTISE SO GENEROUSLY> Appreciated, appreciated, appreciated!!

Seek legal help. If you haven't received benefits you have a timeline before you can't do anything about it. You an always go back to another trucking job but if it makes your health/situation worse, is it really worth it?

There are ways to determine the extent of your injuries despite having pre-existing injuries. It's best to not deal with this alone and seek a lawyer for help. Things can and will get complexed. Best of luck, if you're in CA you can always reach out to us 800 606 6999 or chat online via pacificworkers.com

I told my attorney about it and they asked if I worked in a call center or a bullpen and I said yes and then she had me fill out the paperwork but didn't really explain anything else. I don't even want the benefits.
