Is DEI Illegal After the Supreme Court’s Affirmative Action Decisions?

The U.S. Supreme Court’s decisions about affirmative action at Harvard and UNC have raised questions about the continued legality of employers’ programs and initiatives to advance Diversity, Equity, and Inclusion (DEI). Is DEI illegal or unconstitutional? What can employers do to advance diversity?

    DEI is illegal. Existing Federal Law prohibits discrimination against hiring an employee based on sex, race, religion etc. DEI is the hiring practice based on sex, race, religion etc.

    No. Diversity Equity Inclusion are legitimate goals which does not mean affirmative action. Diverse work force in sales, for example, can be more profitable. If you have all color, all ages, you may want to reflect that to make for a diverse work force. Equity may mean hiring a blind person and giving them special equipment and services that permit the blind person to contribute. And you as a seeing person might complain. For example there may be a no pets police, but the blind person may be allowed to bring their dog. You cannot bring your cat to work. If that's the case, you are not being discriminated against because the company wants to ensure equity and give someone who is blind extra help. Inclusion may mean getting various age groups, sexes, etc that are reflective of society. For example, a retailer might hire men for positions as cashiers when typically you will see women in that role. DEI is legitimate. And limited minded people who see only their own as merited need to be challenged if we want a just society. The supreme Court did not end DEI. They said how these universities had implemented it was flawed. And so schools like Harvard will go back to the drawing board and fix their issues is my hope. DEI is hard work to achieve. Schools like UNC that were giving it lip services and not doing the hard work to achieve fair and balance will fold and claim it's against the law. I hope not. But that's my expectation.

    @@joeboxter3635No. Joe Biden flat out said he was going to choose a black female as his running mate, automatically disqualifying roughly 90% of the American adult population. This is illegal. We’re now beginning to see how DEI hiring practices can have catastrophic consequences as Vice President Harris will soon put the final nail in the coffin for the Democratic Party.

    You described DEI wrong - "Diversity" stands for using skin-color, sex & sexual preference instead of merit for structuring society, which means there are winners and losers based on these categories. "Equity" is the idea that people should be the same and not be able to choose for themselves if that means they can be different from others. "Inclusion" is essentially a warped exclusionary hierarchy of believes that you either support or are not included. A better and more honest way to describe DEI would be how it is implemented: Discrimination, Exclusion & Intolerance
