This is well explanatory. The fact you are able to talk about real estate agents, and draw the distinction between contract of service and contract for service. The illustrations are apt and help give form to the law of agency in its abstractions. I have also adopted similar approaches in my video on agency on my KZread channel, Ori David Consult.

Watching in 2019 as additional prep for a test tomorrow on Agency and Trademark. So interesting to see you discuss Contract of Services v Contract for Services under the heading of Agency. We did it separately. Also interesting how Barbados law differs from US law.

A genuine independent contractor can still be an agent for the purposes of agency law. There is a distinction between vicarious liability and agency. An employer can be vicariously liable for the actions of an employee, but not the actions of an independent contractor. A principlal can be made liable by the actions of an employee AND an independent contractor, once it can be established that he is the principal's agent. The principal is bound by the action of his agent, provided that they are within the scope of the agent's power, that is derived from the P's authority, whether the agent be an employee or independent contractor (or even a minor).

Great info. I am applying this 'fudiciary agent concept' to marriage and doing my own pre-marital counseling. By chance you have contact for biz/real estate law in Indonesia? I'm Christian expat here.

If there is vicarious liability, will the Principal be accountable for the acts of the Agent?
