The Insolvencyand Bankruptcy Code was introduced as one of the biggest insolvency reforms, at a time when the Indian banking sector was suffering from an NPA crisis. IBC came with the promise to rectify this, and bring uniformity to India’s scattered bankruptcy laws.

A question - Can an operational raise an IBC provision to a PSU or govt. owned enterprise for not paying their dues? Is it permissible in the court and what is the legal recourse in it? Also is it possible for a buyer/purchaser to force an operational creditor or service provider to not permit an IBC provision as part of the engagement contract to prevent the trigger for a bankruptcy filing from their service provider?
